PLANNING BOARD MEETING
January 22, 1962
On Monday, January 22, 1962, at 7:45 p.m. the
Lexington Planning Board held a regular meeting in
its office in the Town Office Building. Present were
Chairman Soule," members Bryson, Grindle, Mabee and
Meyer, and Planning Director snow.
Taken under consideration first -was the draft ANNUAL
of the Planning Board's 1961 Annual P,eport. This REPORT
draft was revised, approved, and sent to the Select-
men for printing.
Messrs. Flye and Shepherd, representing the
Lexington Office Center Trust, a subsidiary of Cabot,
Cabot & Forbes Co., met with the Board -from 8-05 to
8:20 p.m. to discuss the latest revision of the Min-
uteman Research Park definitive subdivision plan.
They were informed that in order to have said plan
approved on January 29, the following matters would
have to be in order: (1) a permanent turnaround shown
on the lot layout plan, sad turnaround to conform to
the plan and profile of the proposed subdivision road,
(2) a slight modification of the drain system in the
proposed turnaround as recommended by the Town Engi-
neer, (3) bearings and distances of all courses around
the perimeter of the easements shown on the lot layout
plan, (4) receipt of a letter from Mr. Carroll, Lex-
ington Superintendent of Public Works, stating that
said modified subdivision plan met with his approval,
and ("5) receipt of a"properly executed bond in the
penal sum approved by Mr. Carroll and guaranteeing
performance of required work in said subdivision.

Considered next and approved by the Board was ARTICLES

were the minutes of its meetings held on January 8
and 15, 1962,
In response to the Planning Director's letter
of January l5, 1962 (see minutes'of Planning Board
meeting of said date) to Lloyd C. Goodrich of 10 Sum-
mer Street, the latter and his brother, E. "Lester,
met with the Board from 8:30 to 9:00 p.m. to discuss
the problems of subdividing their land regist ered as
Land Court Case No. 23315A and the possibility of Lex -

ington acquiring some of the Goodrich land as an addi-
tion to the so-called 'Whipple Hill recreational area.
After a discussion of the correspondence in"re-
gard to this case, the Goodrich brothers indicated on a
print where they were willing to have the land subdivided
what land they would be willing to convey to the Town
and where there might be an exchange of land to improve
the shape of existing lots shown on said plan. They said
that they had purchased this land in 1948 at $400 per
acre and on the same basis would like this much for the
land to be acquired by the Town in addition to four per-
cent interest on their investment and reimbursement for
taxes which they had Paid. They said that they would
also like the town to acquire Lot 4 shown on said plan
provided a house was not built on said lot. It was
agreed that it would not make a desirable house lot and
should be added to the other town land for recreational
purposes. It was further Agreed that Mr. Snow would
prepare a study plan showing a proposed_ subdivision for
the consideration of all and that on the basis of this
plan the Board would make the Goodrich brothers an
offer for the land it was desired to acquire.
The Board next reviewed Mr. Henry W. Hardy's
PROPOSED revised text of January 15 In regard to proposed
ZONING amendments to the Lexington Zoning By-law for C 3,
BY-LAW CH 1 -and CM l districts. The Board approved this
AMENDMENTS text." Mr. Snow was asked'to inform Mr. Hardy that
the Board would like to have for its next meeting
this text and all additional material in the Board's
draft of September'24 combined into one text for ad-
vertising purposes.
Attention was called to a draft of a letter
ROUTE 2 the Board of Selectmen wished to send to Chief Engi

lic Works in regard to possible Lexington road con-
nections to State Route 2It was reported that the
Selectmen wished an immediate response to the Select-
men's draft, It was decided that the recommendations

ground. Not having heard from Mr. C. Henry Jackson
since he last met with the Board on September 11,
1961 (see minutes of Planning Board meeting of said
date), Mr. Snow was asked to prepare for the Board+s
consideration a letter to the School and Standing
School Building Committees seeking their opinion in
regard to the recommended acquisition.

Town Counsel Stevens met with the Board brief -
17. He called the Board's attention to the fact that
two petitions, each signed by more than ten registered
voters of Lexington, had been filed with the Board of
Selectmen requesting that articles be placed in the
warrant for the 1962 annual town meeting. Mr. Stevens
stated that one petition sought the rezoning of the
Waltham Street Garden Apartment district to an R 1
district, and the second, the rezoning; of the Lexing-
ton Tnvestment Trust land off SpY%inT? Street from an
R 1 district to a C3 district Later during the
meeting the Board drafted a letter to be sent to all
trose persons who siirned said petitions and who the
Town Clerk had certified as registered voters, call-
ing attention to Section 19 of the Lexington Zoning
By-law setting forth regulations in regard to amend -
4 n7 said by-law. (See ^.ddendum.l
The following Form A arnl3cat,on for determi-
nation of Planning Bonrd jurisdiction was considered
next:

Upon motion duly made and seconded, it was
unanimously
VOTED: that the Lexington Planning Board determines
that the plan accompanying Form A application
x`62-3 does not require approval under the Sub-
division Control Law, and that said plan be
so endorsed.

Notices of neti.ti ons to be heard by the Board
of Appeals on February 13 were read. It was reported
that the Town Counsel had ruled that the petition of
the Lexi-ngton Motor Inn was out of order and that plans
for the nrorosed additi.on to said Inn must he sub-
mitted to the Board of Appeals for a determination un-
der Sec. 5 (g) 5 of tie Town's Zoning By-law. Tt was
decided to take no action on tre other petitions

the Town Counsel's letter of January 17 to the Town
CARROLL Clerk informing them that the Carroll lots No. 13,
LOT POR Block 151 in the so-called Meagherville subdivision
PUBLIC had been acquired on November 15, 1961 by the Town.

1961, the lot being recorded in Middlesex South Dis-

Dear Sir or Madam:
It has come to our attention that a petition, on
which ,your signature appears, has been received by the ,
Town requesting that an Article be placed in the warrant
for the March Town Meeting for the purpose of rezoning.
The Planning Board wishes to inform ,you that no
amendment to the Town's Zoning By-law can be adopted
by a town meeting until after the Planning Board holds
a public hearing on the proposed amendment and has sub-
mitted a report with recommendations, or the time for
such a report has expired.
The Planning Board shall hold a public hearing
when requested to do so by a netition si_pned by not less
than 100 registered voters. Attached is a copy of See -
tion 19 of the Lexi.n(*ton Zoning By-law for your further
information.
