On Yondaz-, T,Tovember 6, 1961s at 7:15 n.m. the
Lexi_nrton Planning Board held a re7ular meeting in
its office in the Town Office Building, present
were Chairman joule, members Bryson, Grindle and Mabee,
and Planning; nirector snow.
The Board considered and annroved drafts of
renorts to be nresented at the snecial town meeting TOWN
to be held later in the evening, these reports hav- MEETT7G
ing to do with Articles 6, 7, A, 9, 11 and 12 on the
Town ..7arrant for said meeting. (See addenda.)
T'istributed to the Board were preliminary
drafts, dated TTovember 1, 1961, entitled "Hartwell
Avenue Area ?oninp� Study Cost and Revenue Analysis"
and rrepared by W. Seymour Archibald, Jr. of
Charles M. rva.ns Fc Associates, Consultants in Pub-
lic Administration and Finance, Boston. Mr. Snow
asked that each member of the Board review the
draft to see if there were any points which it was
thoum_ht should be clarified or any noi.nts and/or
data which should be added before a final draft was
nren^red.

There was presented for the Board's consider-
ation a draft of a letter, dated T'ovember 6, 1961
and addressed to the Chief Engineer of the State De-
nartment of Public '!oars, said letter having been
nrepared by Lexington's Sunerintend.ent of Public
'orks with reference to a nronosed connection of
',.'ort? -en Road to the Cambridge -Concord Highway

(State Route 2). (See minutes of planning Board
meeting: of October IO, JQ61.) The Board anproved

the draft which it was understood was to be
ted to the Board of Selectmen for consideration and,
if annroved, far the signature of the chairman of
the latter Board. (Se,e, addendum.) Mr. Snow stated
that it was his understanding that if the Crief

determine the exact location of 'Worthen Road from

The nrorosed laying out as town ways of the
ways enumerated in Articles 6 to 9, inclusive, were
referred to ane anrroved by the Planning Board and
the Planninm Poard recommends acceptance thereof by
the Town.

LAW PROPOSAL By ARTICLE 11 OF THF SPFCTnL TOWN MFETING
OF 70IF TR 6, 1961
On November 2, 1961 at 7:30 n.m. the rlanning
Board held a public hearing on the -)ronosal to amend the
Lexington Zoning By-law set forth in Article 11 of the
warrant for the Sneci-al Town '.'fleeting on November 6, 1961.
Apnroximately 28 members attended the hearing which was
duly advertised according* to law.
The nronosal involves the rezoning of abort 43
acres of land from a single family residential (R 1) dis-
trict to a Special Commercial (C 3) district.
The land area bronosed to be rezoned is under the
ownership of Cabot, Cabot & Forbes Co. and is located on
the southwesterly side of Marrett Road and the northwest-
erly side of the 7orthern Circumferential Fighwa7 (Rt.128)
The LexinTton Planning Board recommends that the
Zoni_nf^ '37T -law be amended. as set forth in Article 11 of the
"arrant.

The reasons for tris recommendation are as follows:
1. Tbis section of land anneers from its location and
tono7ranhv to be best suited for ni.lrnoses set forth in
the nronosed amendment. It does not encroach anon the
adjacent residential area and follows the general
scheme of the 7)lanni.ng ?hoard to provide sites on the
westerly side of 'route 12 for non-residential uses.
2. That it is desirable in the interest of the general
welfare of the town as a whole to increase the sources
of local tax revenue from non-residential nronerty.

At the hearing it was stated th^t some citizens would
not be able for various reasons to build a fall -out shelter
on their lots other than within the front, side and rear
yards where at present no structures are nermtted to be con-
structed and that town officials would not want to be in a
nosi_tion to deny citizens the r'mht to protect themselves be-
cause of these circumstances. A comment was made that under
the nronosed amendment to the Zoni.nf BTT -law a person could
build a fall -out shelter ani,where he pleased even though he
mi>Mht have room to build it within the rresent restrictions
of t.' -)e bylaw.

'he Lexington Planning; Bo^rd held a public hearing
on ?November 2, 1°bl at (i:) -I0 n.m, at the request of the
Board of 'electmen to consider a nronosal to amend the Lex-
ington Zoning 37 -law in such a manner as to nrovi.de for the
construction of underground fall -out or blast shelters with-
in the required hard areas as set forth in Article 12 of the
''arrant for the Sneci.al Town Meeting to be held on November
63 10'1. Tn addition to the Planning Board and its staff,
27 persons attended the hearing. At said hearing no nrono-
nents anneared to sneak for the nronosal; no one spoke in
onnositi.on to it.
At the hearing it was stated th^t some citizens would

the Board of Appeals Tt was pointed out that there
might be hundreds of neonle who would want to build shelters
where they could not meet tY,e Zoning '37T -law requirements and
the auestIon is whether this nroblem should be controlled by
the Board of ^pneals or talen care of by a change in the
Zoning B7 -law. It was noted that to date there had been
only one _petition before the Board of Appeals for a variance
to build a fall -out shelter which would not meet present
yard regulations but that the hoard world be very burdened
in its work if there were large numbers of petitions for
variances of this nature and a consequent delay in hearing
said petitions.
The Planning Board recommends the adoption of
Article 12.

Dear Mr. McCarthy:
Deference is made to the meeting held on Tuesday.. October
31, 1961 at vour office concerning the connection of Worthen
Road to polite 23 which was attended by the following; per-
sons: F.J.HoCarthy, Mr. Cox, Mr. Hue, Mr. Olson, Mrs. Morey,
Mr. aoule, Mr. Carroll, Mr. Snow and I --Tr. Staples.
At this meeting; the following items were discussed:
1.) It was generally agreed by all present that the loca-
tion of the 'r.terchange proposed by the State Tepartment of
Public 'Torks as shown on the plan accompanying; the letter
from Geor-e C. Toumnouras dated September ll�, 1061 was the
most acceptable solution to the problem.
2.) The State officials amreed that the entire cost of this

.nterchanre would be borne by the Commonwealth of lass.
3.) The State officials agreed that the connecting road
from the south side of the interchan?e to 11altbam Street
near the ':Tait' am 1, ne would be handled in the following
manner:
A.) The State Denartment of Pubiic '-forks would do all
of the engineering to make the lavout and the State would
construct the road, with all costs of construction borne
T the Commonwealth of t,7ass.
B.) The Town would be responsible for making the land
tapings for this road and would assume the entire cost of
any land lama nes .
4.) The State officials stated that the Town would have to
be entirely responsible for the layout, land acquisition
and construction of 'Torti-en Road from Marrett Road to the
northerly end of the nronosed interchange.
5.) The State officials stated that if the 74orthen Road
interchnnce was constructed as pronosed, it would mean
that a new overpass would be constructed at Waltham Street.
The cost of this bridge would be entirely borne by the
Commonwealth of ".`ass. There would be no connection be-
tween '?.ou.te 2 and '%Taltram Street.
6.) Tt was stated by the State officials that if the Town
of Lexinr^ton accented the location of the Worthen Road
interchange as shown on the elan referred to above that
the State Department of Public ':Torks would grant access at
this location for the construction of liortren Poad even
if, in the interim, Poute 2 has been made limited access,
the understandi_nr beinf- that when Route 2 is actually con-
structed the interchanme will be built with a connection
to '°Torthen Road.
7.) It was sugmested by Town officials that Worthen Road
from Bedford Street to Poute 2 be designated by the Bureau
of Public Roads as a Pederal aid secondary highwa-%r. The
State officials agreed thr.t this could be done. However,
they said that i_f it were done that the ores-nt Route 4
and 225, and Waltham Street, since they run apnroximately
parallel to 'Torthen road, would then probabl7T be eliminated
from the secondary Federal Road system and would be made
neligible for Federal aid. Trey also stated that since
the requests for this type of Federal aid far exceeded the
funds available that the chances were Noor that the Worthen
'
Road -,reject would be apnr.oved as eligible in the near
future.
