HomeMy WebLinkAbout1960-09-26PLANNING BOAPD 1v:EETING September 26, 1960 A special meeting of the Lexington Planning Board was held on Monday, September 26, 1960 at 7:30 p.m. in the Boardts office, Town Office Building. Present were Chairman Burnell, members Grindle, Mabee, Meyer and Soule, and Planning Director Snow. The purnose of the meeting was to consider and act uron the proposals whch had been referred to the Planning Board by the Town Counsel, namely, the establishment and acceptance of layouts as town ways the ways enumerated under articles 6 through 24 as set forth in the warrant for the special town meeting to be held later in the evening. Upon motion duly made and seconded, it was unanimously VOTED: that the Lexir_rrton Planning Board approves the layinc* out as town ways of the ways enumerated in Articles 6 to 24, inclusive, ' of the Warrant for the September 26, 1960 Special Town Meeting, and that the Board recommends the acceptance thereof by the Town. After so voting, members of the Board signed three reports which had been prepared for their con- sideration and for filing with the Town Clerk at the town meeting. (See addenda.) Mr. Snow renorted that after the Planning Board conference that morning with Mr. Emilio Spag- nuola of Kingston Homes, Inc, and his attorney, Mr. Sleeper, the Town Counsel had prepared as requested by the Board an instrument wherein Kingston Homes, Inc., successors in title to Isco Builders, Inc., granted to the Town an option to purchase for `12,000 the nine -acre tract of Kingston Homes land adjacent to the former '•T'llard nronerty. (See minutes of July 25, 1960 Planning Board meeting.) Mr. Snow also re- norted that just prior to the ^ln nning Board meeting said onti_on instrument had been executed. Mr. Snow exhibited a print of a plan which he had prepared, said plan being entitled ' "Portion of Newton V. & Josephine D. Crandall Land Recommended for Acquisition for School, Playground and Recreation Purposes," and being dated September 23, 1960. Mr. Burnell said that the offer made to Mr. Lynch was that the Town acquire Parcel B 1 shown on said plan for $32000 and other consideration, these being the abandonment of the existing drain and public travel easements across Parcel A 1 and that portion of the sewer easement across said parcel northerly of and ten feet distant from and parallel to the center line of the Vine Brook sewer. Mr. Burnell also stated that Mr. Lynch had said that Mr. Crandall wanted the abatement of the Middleby Road sewer betterment against his property and a connection without any charges to the Vine Brook sewer. Mr. Burnell further stated that both he and Mr. Snow had said in reply (1) that they did not believe the Board would agree to Mr. Crandall's request, (2) that in the Board's opinion Parcel B 1 wasn't worth more than that which the Board offered, and (3) that if it was found that an agreement could not be reached with Mr. Crandall the Board would no doubt abandon its proposal and recommend construction of a driveway to town land over the exist- ing easement for public travel. Mr. Burnell concluded ' by stating that at th;.e end of the conference Mr. Lynch said that he thought some arrangement could be reached in regard to the matter and recommended the Planning Board srpceed with Article 5 in the warrant for that ni_nht's special town meeting.
