May 20, 1957
A regular meeting of the Planning Board was
held in the Town Engineer' s Room, Town Office Build-
ing, on Monday, May 20, 1957 at 7:30 p.m. Present
were Chairman Grindle, Members Burnell, Jaquith and
Soule; Planning Director Snow and Mr. Howlett of the
Staff.
The minutes of the meetings of April 22 and MINUTES
May 6, 1957 were approved.
Also approved were the following bills sub-
mitted for payment: Spaulding-Moss, drafting sup- BILIS
plies--13.45; Bruce E. Howlett, rofessional services
for period ending May 20, 1957--97.00.
The following Form A anplication was taken
under consideration FORM A
#57-49, submitted May 16, 1957 by Frank M. HODGDON
Hodgdon, plan entitled "A Compiled Plan of
Land in Lexington-Mass.", Scale: 1" = 60' ,
dated Apr. 6, 1957, Miller and Nylander, C.
E. 's & Surveyors
Accompanying the application was a letter from
Mr. Hodgdon dated May 16, 1957 in which it was stated
that he felt that the Board was obliged by law to
sign the plan and if it did not do so every member of
the Planning Board would be faced with a lawsuit. Mr.
Snow stated that he had discussed with Mr. Stevens
the subdivision plan and the letter together with Mr.
Hodgdon's deed to his property. There appeared to be
no charige in the facts presented previously in regard
to this and similar applications except, it was
pointed out, that in addition to the plan being a sub-
division, Mr. Hodgdon apparently had no rights over
the land now or formerly owned by the Commonwealth of
Massachusetts, Magnuson, and others.
It was moved, seconded and unanimously
VOTED: that the plan accompanying said application for
determination of Planning Board jurisdiction
does require approval under the Subdivision
Control Law.
After the vote was taken, there was read to the
Board, approved by it and signed by the Chairman, a
draft of a letter dated May 21, 1957 and addressed to
Mr. Hodgdon, in which the vote was set forth and in
which it was suggested that if Mr. Hodgdon still be-
lieved the plan did not require approval that his
attorney discuss the matter with Lexington's Town
Counsel.
Taken under consideration was the application
BATTLE for approval of the preliminary Battle Green Village
GREEN plan submitted May 8, 1957. Mr. Jaquith moved, Mr.
VILLAGE Soule seconded the motion and it was unanimously
VOTED: that the preliminary subdivision plan entitled
"Battle Green Village, Lexington, Massachusetts,"
dated May 1, 1957, be and hereby is tentatively
approved.
Taken under consideration was the application
BATTLE for approval of definitive plan of Battle View Park,
VIEW PARK Section II, submitted May 20, 1957. It was decided
SEC. II to hold a public hearing on said application on June
10, 1957.
Notices of petitions to be heard by the Board of
BOARD OF Appeals on May 28, 1957 were discussed by the Board.
APPEALS It was decided to take no action on any of the said
petitions except that Mr. Snow was asked to examine
the details concerning the Joseph Monsignore petition
as it related to any proposed subdivision in the
vicinity and report to the Board his recommendation as
to whether or not the Board should take any action
upon said petition.
At 9:45 p.m. Mr. Stevens came to the meeting and
REGIONAL the Board discussed with him a revised draft of an
SHOPPING amendment to the zoning by-law for the proposed regional
CENTER shopping center. Mr. Stevens left at 10:35 p.m. at
which time the Board met with the Selectmen to further
discuss this proposal.
The meeting adjourned at 11:00 p.m.
