PLANNING BOARD MEETING
Wednesday, Feb. 23, 1955
Present: Adams, Grindle, Hathaway, Irwin, Jaquith - Snow, Stevens.
Meeting opened at 7:45 o'clock.
Seabury -
The Seabury hearing was discussed. It was the concensus of opinion
that too much land was being asked to be rezoned since it is the use of the
land which would be okayed, not any particular plan of development. It was
thought that such a large area should not be opened up for building apartment
houses since present plans are not binding on either party. Mr. Stevens was
asked if the requirement for sewer could be varied, and he stated that he did
not believe so since the law specifically states that connection with a sani-
tary sewer be required in an apartment zone. Mr. Seabury was warned of this
fact when he first indicated interest in developing the Bashian property. It
was the decision of the Board, therefore, that it would not recommend this
amendment to the Town Meeting as it would be unwise to approve something which
would not comply with the zoning by-law.
Techbuilt, Inc.
Plan presented for preliminary approval by Techbuilt, Inc. dated
Feb. 7, 1955, Miller & Nylander, C.E.'s, north side of Route 128. Mr. Bath-
away moved, Mr. Grindle seconded, and.-it was unanimously
VOTED: to disapprove the above plan since there is only one recog-
nized means of access to the subdivision.
Cahill
Mr. Cahill and Mr. Joyce appeared with subdivision plan for develop-
ment of land off Lowell St. and formerly known as the "Hull" property, on
which they wished tentative approval. Mr. Cahill was told that if on March
7 he brought back Form B properly filled out and furnished other necessary re-
quirements that the Board would consider granting tentative approval of plans.
Marshall
Mr. Roger Marshall, Mr. Damon Marshall, and Mr. Winfield Caouette Jr.
appeared for informal discussion re: plans to use the "Fuelite" building,
corner of Marrett Rd. and Waltham St., as a bakery and office. The Marshalls
have a contract whereby they furnish meals to several large plants, notably
Raytheon's several factories, and they are in need of a central location for
an office as well as a place where they can manufacture bakery products. In
this connection they plan also a small retail store and lunchroom. There
would be no Sunday operation, and parking facilities would be in the ratio
oft 1.
Board of Appeals Notices
Mr. Adams read the notices for Board of Appeals hearings on Thursday,

Feb. 24th. With regard to request of Mr. Yeomans for permission to sub-
divide a lot of land into two lots, it was believed that this should come under
the jurisdiction of the Planning Board rather than the Board of Appeals. On re-
quest of George E. Smith for permission to erect a carpenter shop in the rear
of 10 Muzzey st., it was felt the Planning Board should oppose this as a fire
hazard. Mr. Adams will attend the hearingsand represent the Planning Board.
Buse
The Board took up the matter of the application of Antonio Base and
Lillian Bisa for approval of a definitive eubdivision plan entitled "Sub-
division Plan of LtM in Lexington, Mass., belonging to Antonio Busa" and dated
January 6, 1955. iJpon consideration thereof, on motion of Mr. Hathaway, seconded
by Mr. Grindle it was unanimously
VOTED: that since the land that is to be subdivided is to be used only
as a site for a substation for the Boston Edison Company, the
Board hereby waives in this instance only the provisions of its
rules and regulations requiring the construction of streets and
other improvements; and
VOTED: that the definitive subdivision plan entitled "Subdivision Plan
of land in Lexington, Mass., belonging to Antonio Buss" and dated
January 6, 1955, be and hereby is approved, subject to_the follow-
ing conditions:
That the parcel shown as Lot A shall be used only as a site for a
substation of the Boston Edison Compares and shall not be used as
a site for any other type building unless and until the Planning
Board shall approve a plan showing a subdivision of other land now
owned by said Antonio Busa which will provide one or more Kays to
furnish access for vehicular traffic to said Lot A.
That the parcel marked "Easement" is approved only as a right of
wny and easement for use in connection with the use of Lot A. as
such substation,and is not approved as a way or easement for use
with any other land and is not approved as a way on which any
dwelling or other building may be erected.
DeVries Construction Co.,Inc.
The DeVries Construction Co. having submitted performance bond in proper
order, and other requirements having been met, it was moved by Mr. Irwin, seconded
by Mr. Jaquith and unanimously
VOTED: that the definitive subdivision plan entitled "Section Four Sun
Valley, Lexington, Mass., owned by DeVries Construction Co., Inc."
dated January 21, l955, Kenneth B. Oates, C.E., be and hereby is _
approved.

panied
by a plan dated Feb. 16, 1955, Miller & Nylander, C.E.'s, scale 1" = 401.

control law."
