Mr.Bidwell asked the Board of Survey to withhold approval on the grounds that the development would impair the values of property owned by his clients, I1iss Robinson, I1Irs.Willard and IIr.Carl Bolter. He said he had no criticism of the street layout as approved by the Planning Board. His criticism was in regard to the character of the homes likely to be built by the developer. He contended that the Board of Survey could withhold approval until they had a chance to de- termine the character of the homes to be built. The Board of Survey indicated contended by I17.Bidwell. No decision bond. that their powers did not extend as far as was made as the developer had not filed a The Board met with the Board of Survey and with Pdr.Ryder. E4r.Ryder indi- cated satisfaction on the roposal that the town build a street through its property (taken from Ryder on Waltham Street to the now isolated acreage. He also indicated, however, that he had suffered a greater loss through the taking of the other right of way to Park Drive and asked that this right of way be re- turned. The Board of Survey suggested that he put a price on the damages due to the loss of the right of W. Mr.Ryder insisted that he wanted the right of way and that if he couldn't get it the damages would be very great. He was told that a street through the right of way would not be desired. Yx.Ryder than said he would confer with his brother as to the price to be set for damages and would advise the Board of Survey on this point the follow- ing LIonday. It came out in the discussion that IIr.Ryder could not build a street through to Fair Oaks because while he had formerly awned property bordering on that section he had "lost it in the land courts."
