PLANNING BOARD MEETING
February 17, 1941
A regular meeting of the Planning Board was held on
Monday evening, February 17, at 7;30 P. M. All members were
present. The minutes of the previous meeting were approved.
The Board received a copy of the 1940 report of the Town
of Winchester Planning Board.
The Board received a copy of the article to appear in the
Town Warrant (amending Article V9 Sec. 2a) as approved by the
Town Counsel,
Mr. Kimball reported a reply from Mr. Swaim, of the Concord
Planning Board, acknowledging his letter outlining the develop- Master
ment and use of a master plan. Mr. Kimball stated that the Plan
Concord board will arrange to meet with this board in the near
future. A copy of Mr. Kimball's outline for Mr. Swaim is to
be filed for reference.
Mr. Kimball reported a letter from Mr. G. H. Delano]
Project Engineer for the Mass. Dept. of Public Works, thanking Parking
the Board for our report on automobile parking in the business Survey
center. This was turned over to their Traffic Engineer,
Mr. Copell, and request made for a copy to file.
Mr. Kimball reported a letter from Mr. William E. Bennett,
Attorney, of this town; this outlines the recent decision ren-
dered by the Mass. Supreme Court on "spot zoning", which pro-
hibited a change in use of a lot located within what is essen-
tially a residential district. This was discussed from a stand-
point of its possible bearing to similar cases in the Town, and
is filed for reference,
Mr. Greeley reported that he conferred with the Appropria-
tions Committee, on the Budget Plan data, and that they have
requested that we send twelve copies of the report to Mr. Russell
for the members to study individually. Mr. Sheldon will notify
this Board when they can meet with us as a group; they should
like it to be on March 20, if not before.
The Middlesex Turnpike question was brought up, and it
was stated that it was possible that nothing would be done for
two years. There is the possibility of its development as a
military highway if the United States become involved in war.
Mr. Ellis is willing to keep in touch with the State Dept. of
Public Works and Rep. Ferguson on this matter.

The Board is to be represented, by letter, at the hearing
on the proposed Bedford airport before the Ways and Means Airport
Committee of the State Legislature. This is to be to the
Chairman of the Committee, and prepared by Mr. Nickerson.

Mr. Miller and Mr. Rix appeared before the Board with a
revised layout of land at the west corner of Waltham Street and
"Four
Marrett Road, comprising 14 lots aid known as "Four Acres%
Acres"
This layout was reviewed, and tNo prints requested; one for the
Board's files and one for the Board of Survey. The motion was
made and carried that the Clerk the Board of Survey by

letter that the Planning.Board approves this preliminary plan
as a layout, and in full provided the Board of Survey considers
that the problem of surface drainage and sewer extension is
simply provided for.

The Clerk was instructed to write Mr. Caouette, requesting

Board's files.
The Chairman of the Board of Selectmen appeared before

the Board to present 4 copy of House Bills 435, 436, 437, and

438, regarding legislation on bill -boards. The Board is re-
quested to study these bills and report to the Selectmen on
the advisability of their recommending their adoption. It
was Voted that the Planning Board write Mr. Charles ,E. Ferguson
as our representative, to wit that the Planning Board desires
to go on record as favoring these bills.
