September 2, 1937
A public hearing was held in the Selectmen's Room of
the Town Office Building, Lexington, on Thursday, September
2, 1937 at 8:00 P. M. Messrs. Greeley, Kimball, Ferguson,
Ellis, Kraetzer and Nickerson were present.
The Board organized before this hearing and Mr. Greeley
was elected. Chairman and Mr. Kimball Clerk.
The Chairman declared the hearing open and the Clerk
read the notice of hearing which appeared in the August 19th
issue of the Lexington Townsman on the following amendment: -
To amend the Lexington ironing By -Law and Map as follows:-
By changing that part of Section 1. which now reads,
"and as shown on the zoning map prepared by J. Henry
Duffy, Town Engineer, and filed with the Town Clerk
March 17, 1924, and all amendments thereto, which map
as amended is hereby made a part of this By -Lav," to
read as follows:-

Cosgrove, Town Engineer, and filed with the Town Clerk
August 12, 1937, and all amendments thereto, which map
as amended is hereb7 made a part of this By -Law.
Mr. Kimball made the motion that inasmuch as there was
no one present appearing in regard to the hearing, the hear-
ing be declared closed. The motion was seconded and the
Chairman declared the hearing closed at 8:05 P. M.
Mr. Kimball read the report to be presented at the
Town Pveeting on this amendment and as there were no objections
or corrections, the Chairman declared it accepted.

' PLANNING BOARD HEARING
September 2, 1937
A public hearing was held in the Selectmen's Room of the
Town Office Building, Lexington, on Thursday, September 2,
1937, at 8:10 P. M. Messrs. Greeley, Kimball, Ferguson, Ellis,
Kraetzer and Nickerson were present.
The Chairman declared the hearing open and the Clerk
read the notice of hearing which appeared in the August 19th
issue of the Lexington Townsman on the following amendment: -
To amend the Lexington Zoning By -Law as follows: -
By changing under Section 3. (b), C.1 Districts, paragraph
11, which now reads: "On the easterly side of Bedford Street
the property known as the Carbarn property, extending from
Bedford Street to the Railroad property, and on the westerly
sid-1 of Bedford Street extending southerly from a point oppo-
site the northerly boundary of the Carbarn property to Reed
Street and of a depth of 100 feet from the westerly line of
Bedford Street." to read as follows: -
11. On the easterly side of Bedford Street beginning
at a point on the northeasterly side of Bedford Street said
point being northwesterly and distant 145 feet from the south-
easterly terminus of a curve of radius 816.4 feet and extend-
ing along Bedford Street for a distance of 285 feet and extend-
ing in depth to the Boston & Maine Railroad and on the westerly
side of Bedford Street beginning at a point on the southwesterly
side of Bedford Street said point being northwesterly and dis-
tant 154 feet from a stone bound marking the southeasterly
terminus of a curve of radius 866.4 feet and extending south-
easterly along Bedford Street to the northeasterly side line
of Reed Street and of a depth of 100 feet from the adjacent
side line of Bedford Street.
The Chairman stated that this section referred to the
now Public lo;orks Building property and the hearing was to
change the wording of the Zoning By -Law.
The motion was made and seconded, that as there were no
persons appearing in regard to the hearing, the hearing be
declared closed. The Chairman declared it closed at 8:15 P,M,
Mr. Kimball then read the report which the Planning Board
is to present in regard to this amendment at the Town Meeting,
' The Chairman asked if the Board was in favor of the report, and
it was unanimously voted to accept it.

A public hearing was held in the Selectmen's Room of the
Town Office Building, Lexington, on Thursday, September 2, 1937
at 8:20 P. M. upon the petition of Diary G. Mullen and Mary C.
Welsh. Messrs. Greeley, Kimball, Ferguson, Ellis, Kraetzer and
Nickerson were present. The petition was to amend the Zoning
By -Law and Map by changing from an R.2 District to a C.1 District
the parcel of land described as follows: -
Beginning at Fottler Avenue on the easterly side"
of Massachusetts Avenue, extending southerly 265
feet, thence turning easterly 190.24 feet to the
Railroad property, thence turning northerly along
the Railroad 265.38 feet to Fottler Avenue, thence
turning westerly along Fottler Avenue 174.34 feet
to the point of beginning:
The Clerk read the notice of hearing which had been pub-
lished in the August 19th issue of the Lexington Minuteman and
sent to property owners which the planning Board designated as
being affected by the proposed change. '
The following people were present in regard to the hearing: -
Dir. Anselm C D.ullen, tlason H. Stone, 27 State Street, Boston,
attorney representing the petitioner, Henry P. Dooley and James
F. Prendergast.
Mr. Eason H. Stone, representing the petitioner,'presented
pictures of the gasoline station at the Rest Inn and stated that
the present buildings are becoming greatly in need of repairs
and the petitioner proposes to erect a modern gasoline station
which willhave a lubritorium and proper equipment for servicing
automobiles and selling gasoline. The proposed building Is to
cost approximately $3500.00. It is proposed to construct brick
buildings of colonial type similar to the majority of the Town
buildings. It is felt that it would be an additional service
to the'public and at the same time it would not impair the
Neighborhood. He stated that there was a small unsightly wooden
building between the present cement building and Fottler Avenue
used for loading of range oil which has been considered in the
proposed layout and it is felt that this equipment could be
housed within the walls of the proposed building so the wooden
one could be done away with. It is proposed to set the new
building and pumps further back from Ptia.ss. Avenue,
Dir. Mullen stated that the new building will set back 50
feet from Niass. Avenue and forty feet from Fottler Avenue, 16
feet back from the present building.
Er. Kimball stated that while this petition is advocated
for a filling station, it brings into a commercial zone, a non-
conforming use. He also stated. that the arguments presented
were in regard to the gasoline station but the petition brought
before the Town included the whole area.
Mr. Stone replied that it was not the present intention
to make any material change to the Rest Inn outside of repairs
which will be made from time to time.

Mr. Mullen stated that if the building burned, it would
be beyond their power to repair it and that they are trying to
safeguard their interests. 'He said that before the Zoning Law
was adopted, Ieir. Emery told them that if they would allow the
`Lown to get a segment of the circle on Fottler Avenue and agree
not to build within it, he would see that°this Rest Inn property
was put into a business district. Mr. Iuiullen then stated that
the segment of the cirele.on Fottler Avenue, 30 feet, was taken
and they were under the impression that their land was in a
business zone but leter found that it was residential.
Mr. Greeley stated that the plan of the proposed gasoline
station called for wood siding and Kr. Stone replied that the
present intention is to build'of brick.
Mr. Greeley asked if there were -any others who avished.to
speak in favor of the change.
Messrs. Prendergast and Dooley both stated that they
wished to be recorded as being in favor of the change.
N'.r. Greeley asked for other speakers in regard to the
hearing, as as there were none, declared the hearing closed at
8:45 P. M.

PLANNING BOARD MEETING
September 2, 1937
Present:- JJessrs. Greeley, Ellis, Ferguson, Kraetzer, Kimball,
and Nickerson.
The Board organized and Mr. Greeley was elected permanent
Chairman, and ivir. Kimball as Clerk.
Hearings were conducted at 8:00, 8:10 and 8:20 P. M. on
proposed amendments to the Zoning By -Law. Detailed report is
separate.
Following the hearings, the Board reconvenied for
regular business.
Organiza-
tion
Reports and recommendations on three proposed amendments
vis: adoption of the revised map, description of C.1 District
on Bedford_ Street and enlarged business area at Lowell and By -
Woburn Streets, were read and approved. Laws
It was reported that the Board of Survey had not accepted
the original layout as petitioned, for a dead end street near
Marrett Road and Spring Street and were taking no further action
on the subject. The Board feels that considerable time having
been spent in developing an alternative plan, the subject should
not be abandoned and the Board of Survey is to be contacted to
determine desirable steps to close the matter
A brief discussion of lot areas developed the need for
a map delineating existing recorded plats, as a base for
intelligent action. The Clerk presented an eight hundred
scale town map on which lotting and land use has been completed
for about a third of the Town.
The Board voted to place a sum, not to exceed fifty
dollars, to be used if necessary and under the direction of
the Clerk, in obtaining and transcribing plats of record at
the Land Court.
The meeting adjourned at 10:10 P. M. until Thursday,
September 16, 1937.
