July 9, 1937
a public sleeting of the Planning Board was held in the
Selectmen' s Room, Town Office Building, Lexington at 8 ;00 P. M.
Iessrs . Kimball, Fraetzer and Ferguson of the Planning Board
l-ere present The Secretary, Eleanor M. Lowe, was also present.
The follo' ing persons were present at the meeting Idr.
Irving Currier, Howard Munroe , .,.r. John Heffernan (Currier ' s
attorney) , and Lr. & Iurs. Albert E Olsen.
Ir. Kimball was elected Chairman pro-tem, and kr Ferguson
was elected Clerk pro-tem.
The Chairman pro-tem stated that an amendment to the Zon-
ing By-Law required fourteen days ' notice in the local paper
and notice by mail to those property owners designated by the
Planning Board as being effected by the amendment . A hearing
is held before the Planning board , which is required to report
and make its recommendation as to what action shall be taken,
before the Town Meeting. That means that any citizen may bring
in any petition for amendment, and the Board must hear the party.
There is no tire limit in which the Board must act .
Lir. Kimball said that r. Currier had presented a petition,
on account of which this meeting was called, and it was presented
at a tire when it was expected that there would be a Town Meet-
ing early in the summer. That meant fast movement by all
parties to get the petition in and to get it before the Town.
The result was, without placing the blame anywhere, that the
amendment on which this meeting was called, was not in conformity
with the context of the present Zoning By-Laws . The Chairman
pro-tem said that tnere vas nothing in the petition that was Lowell &
not legal, but there vas doubt if it accomplished what Lr. Woburn Sts
currier desired. He said the t as far as he knew now, there
would not be a Town Meeting before the second of August, at the
earliest possible date , and it probably would not be until a
reek or so later . He said tnat it was the feeling of the Board
that , unless there ,Jas opposition, that the Hearing on Irving
Currier 's petition should be postponed until a later date .
Due notice would be given to the property owners . He asked if
there was any objection to this procedure .
Mr. & I, rs . Olsen stated that they would not offer any ob-
jection. Messrs . Lurrier, Heffernan, and Munroe said that they
would not object .
kr. Ferguson moved that the hearing on this petition be
postponed until aurust 6, 1937. Mr. Kraetzer seconded the
motion and it was so voted.
Discussion centered around the wording of the proposed.
amendment and draft copy- prepared which appeared to be
sufficiently descriptive and consistent with similar articles
IIin the Zoning By-Law . It vas definitely understood that the
Board was advising in the construction of the paragraph but
not the subject matter and was not committing itself as to sub-
sequent action.
I:_r. Gordon Robinson appeared before the Board to discuss
informally a proposed lotting plan of his propert-- on Hancock
Street . This was considered in connection with a tentative
layout made by i,_r . Cosgrove of the section bounded by Hancock
Street , Revere Street am the Railroad property and sone
changes in alignment and increased lot sizes were suz,gested.
The Board advised Lr. Fobinson to la-7 out his lots with at
least one hundred foot frontages and to the full depth of his Robinson
property. property
The property in this neighborhood being owned by several
different persons who are not interested in opening up their
land, it is impracticable to consider the locality in more than
a very general manner and to suggest a trend toward which lay-
outs should lead.
The meeting was adjourned at 10:15 P . H.
