Mr. Duffy directed attention. to House Bill 205, being an act relative to laying out and care by the Cor=onwealth of Freeways, etc. A Freeway being a highway, access to which is permissible only through regularly laid out streets or highways. This bill.apparently seeks to take care of situations such as we hope to protect along the Concord Highway, Mr. Wrightington is to be asked whether he feels that act can be construed as retroactive to existing highways or only applicable to future ways. Mr. Borden expressed the opinion that there was grave danger of attack on the grounds of con- fiscation. Note 1/25/36:- Mr, Roland Greeley tells the clerk that he attended the hearing on the above bill, that the only opposition was from one speaker who raised the question of its being retroactive and that the bill is so loosely drawn in this respect that the members of the Regional Planning Committee are of differing opinions on this point. A new bill in more definite form will probably be presented by the Mass..State Planning Board, The Town Counsel is to be requested to prepare an amend- ment to the Zoning By -Law to provide for a fifty (50) foot setback on the Concord Turnpike, Mr. Cosgrove has prepared a map covering the sections adjoining the Concord Turnpike but owing to the press of other work has not been able to make any suggested layouts. The informal hearing on Limited Apartment Buildings was discussed and it was voted that in the light of Mr. Merriam's request of January 21, 1936, to establish an R.3 District, there will be prepared an amendment to the Zoning By -Law pro- viding for such district and the Planning Board will insert an article in the Town Warrant and will hold a hearing Feb- ruary 28th on an amendment relative thereto. In addition, it was voted that the Planning Board desig- nate the area as affected by Mr. Merriamts petition to change the property on Oakland Street from an Rol District to the proposed R.3 District, and within which it is necessary to obtain the signatures of owners of 50 percent in valuation of the property to be as follows: The area included within that bounded by Meriam Street (both sides), from the southerly side of the Railroad right of way to Abbott Road. Abbott Road (both sides)o to Oakland Street. Freeways Concord Turnpike Limited Apartment Buildings Oakland Street (both sides) to Merlam Street. Also the property between the railroad and the northerly side of Mass. Avenue to and includ- ing all property abutting on Depot Square. The proposed amendment, drawn in 1934, to provide an R.3 District was reviewed and a provision added to permit such districts abutting the railroad right of way. Mr. Wrightington approved the change and suggested slight modifications in word- ing of other parts. Meeting adjourned at 11:10 P. M. Respectfully submitted, Clerk Pro Tem.. 1
