June 11, 1934
IIA hearing was held in the Selectmen's Room of the Town
Office Building, Lexington, Monday evening, June 11, 1934, at 8:00
P . M. Messrs. Duffy, Greeley, Scheibe, Glynn and Robinson were
present.
The purpose of the hearing was to consider the following
proposed amendments to the Zoning By-Law:-
"By substituting for Section 3, C.1 Districts, Article 18,
the following:-
"18. Upon the southerly side of Massachusetts Avenue beginn-
ing at the westerly line of Wallis Court and extending westerly to
a point opposite the easterly line of Mariam Street, and of a depth
of 100 feet from the southerly line of Massachusetts Avenue, through-
out."
By substituting for Section 3, C.1 Districts, Article 17,
the following:-
"17. Beginning at the junction of Fletcher Avenue and
Woburn Street, and extending southerly to and westerly along the
northerly line of Massachusetts Avenue to the easterly line of
Meriam Street and throughout its entire length extending norther- Mass.
ly to the Railroad property."

Mr. Duffy explained that the hearing had been called by the
Planning Board and stated that a previous hearing had been held Bearing
on the same matter, the purpose being then to change from a 0 .1
District to an R .1 District all the land on Town Office Building
side of Mass. Avenue from Vine Brook to Fletcher Avenue and Woburn
Street and on the other side of the street from Wallis Court to
Winthrop Road extending back 100 feet. The Town Meeting voted
to change the Town Office Building side from a C.1 District to
an R.1 District and voted not to change the other side. He also
stated that the Planning Board felt that both areas should be in
a Residence Zone .
Mrs.Sexton, speaking for her mother, Mrs. T. J. Leary,
announced that Mrs. Leary feels the same as before and would
like to see the property back in a C.l District. She stated that
they bad three offers for business, a gas station, stores and an
undertaker's establishment. The Fire Department also inquired
for a price as it was the proposed site for the new fire station
at one time, and she had stated $18,000.00.
Mrs. E. J. Thivierge stated that they would like to see the
zoning remain as it is so they could have a business of their own
there at some future date . She also remarked that she thought
it aught to be their privilege after paying taxes as a business
district.
IMr. Duffy read a letter from Mr. Nathan Bidwell announcing
the objections of the Hunt Heirs of the section being changed
from a C .1 to an R .1 District.
Mr. Duffy also read a letter from Daniel J. O'Connell to

the effect that he did not want his property on Yass. Avenue changed
from an R.1 District to a C .1 District unless the triangular lot

of land was changed from a C .1 District to an R.1 District.
Mr. Greeley stated that from his study of zoning, figures
show that Lexington has enough business for 25,000 to 50,000
population.
Dr. Barnes stated that he has had several chances to sell
the lot below his house for stores for four times the amount he
I paid for it but thought the Town buildings should be protected
from stores. It was his feeling that he should get some redress
if put back in an R.1 District because be paid taxes for business
property.
Mr. Robinson remarked that a lot of traffic is going to
be taken from Woburn Street and Mass. Avenue because of the new
circumferential highway and there will not be as much call for
gasoline stations then.
Mr. Duffy asked for further statements and as no one wished
to speak, the hearing was declared closed at 9:00 P. Y.

Mr. Greeley was also asked to get new statements from the
Selectmen and the Baptist Church on this matter.
The meeting was adjourned at 9:45 P. M.
