A meeting of the Pla.nnin6 Board was held at the Town Office
Buiidine on Friday, October 27, I963, at b:00 P.M.,the following
were present: Messrs. Duffy, Mi.1ne,Kimball, Glynn and Robinson.
The records of the previous meetinE of October 20 were
read and aproved.
LOCATION OF FILLING STATIONSS
idr.Duffy opened the dissuasion of regulations governing
the loc,-..tion of gasoline filling -stations with respect to public
buildings,schools,churches,etc „ reading; extracts from the Sonine
By-laws of the Town of Great Barrington, section I6 of which
deals with these matters in amanner reflecting various recent
court decisions, and which may thefore be regarded as a safe guide
in drawin- up similar regulations for incorporation in our own
By-law.
A comparison of the uses permitted in C.I districts, as
outlined in Section 4 of the Lexington By-law (Page b), was made
with those of the Great Barrington By-law, and it was found that
the two are for the most part in agreement.It was the general ' c opinion that while gasoline filling. -stations and 6ara.ges should
remain subject to regulation by the Board of Appeals, as our By-
law now specifies, automible salesroons, when operated independent
of agarage or service -station, can properly be allowed in any
C.I district and may well be permitted under paragraph 2 of our
C.I section,along with retail stores of other lines of business,
Some difference of opinion developed relative to tire and battery
stores, which usually include a certain amount of service to
customers, it being the feeling that if this service were carried
on in the street adjacent to the store, some traffic hazard
might result.
The proper distance from public buildings, schools and
churches, at which gara;es and filling -stations shauid be located
was duscusse4 various distances from 200 to 500 rept were sug-
gested. It seemed that 300 feet was reasonable, and was usually
accepted as proper in other Towns where regulations of that
sort are in effect. It was also agreed that a set-bacx of 20 feet
from the street line was desirable, to allow for servicing cars
off the street and entirely on the premises of the garage or
filling -station.
Upon motion, dul;T seconded, it was thefore
VOTITD: That the Board adopt, sub,ect to the approval of the
Town Counsel, the following amendments to the Lexington 'oning
' By-law:
Under Section 4, in C.I Districts, article 2 after the
word "stores" add the word "salesrooms" so that the article will
read: "retail stores, salesrooms, and shops for custom work...".
Also, in the same section, to delete article 6(c) and to

substitute threfore the following: "(c) Public garageq automob-
ile repair -shops, storage- battery service-stptiones, retail
' gasoline or oil stations, 6reasinE-stations, oj' any of their
appurtenances or accessory uses; except that none of the fore
Going, nor any driveway for entrance or exit of automobiles in
connection therewith, shall hereafter be located so that any
part thereof is within fifty feet of any residence district,
or within three hundred feet of the property used by any public
school, or private school, public library, church, hall of
public asse,lbley, historical building, monument, o -r museum,play-
eround, o% institution i'or the aged, the sick or dependent, or
for children under sixteen years of age, ^very filling -station
structure,pump, or greasing -stand shall hereafter be set back not
less than twenty feet from the established street line, and no
fillin-- shall be done except to cars standing on the property
of the filling -station,"
It was decided that at the next meeting of the Board on
Novenber third, the matter of the frequency of the presentation
of petitions relative to any one project would be considered;
also reoulQ.tions relative to the use of premises, particularly
with respect to the removal of sand, gravel, or loam, or other
uses which mi6ht cause undue damage.
