HomeMy WebLinkAbout1981-10-141 1 1 BOARD OF HEALTH MEETING OCTOBER 14, 1981 The regular meeting of the Board of Health was held Wednesday, October 14, 1981 at 7:15 p.m. in Room G-1 of the Town office Building. Members present were: Mr. James W. Lambie, Chairman; Michael S. Erdos, M.D., Linda Roemer, Ph.D. and George A. Smith, Director of Public Health. Minetes of the September 14, 1981 meeting were approved as read. Virginia Brady, R.N. of the Visiting Nurses and Community Health Association came into the Board Meeting to discuss several things. She explained the new schedule for the high blood pressure screening clinics. One week (on Thursday) at Greeley Village, one week at Vynebrooke Village, one week at Council on Aging and one Wednesday at the Sacred Heart Rectory (room in basement). The fifth week, when there is one, will be used for diabetes screaning clinic or a hemoglobin clinic. Virginia Brady said she had talked to the Council on Aging Director, Joan Melcher, and she was in agreement with this schedule. Dr. Roemer felt the clinics should be in the same places each Thursday of each month and not to be changed around. It get confusing for the elderly. Mr. Smith said the notices of the new schedule will be put in the elderly citzens citizens bulletin. We will have some schedules made up but they cannot be put into the water bills anymore because they have gone on computer. We will put some at the blood pressure clinics, Town Clerk's Office, etc. Mr. Smith reported that the Flu Clinic will be held tomorrow, October 15 and the Pneumococcal Clinic will be held on November 12, 1981 He said everything is going smooth for tomorrow. We have two volunteers to register the people. Virginia Brady said that there will be six nurses coming up. They will all fill syringes and when the clinic starts, three will give the shots, and three will continue to fill syringes. Mr. Smith said next year we may have to charge a fee for the vaccine shot. He told the Board that it cost over $300.00 for 150 doses this year. He said we will have to add money to our Fy83 budget to pay for the vaccine. Mr. Smith doesn't think people will mind paying something because this year when they called, they asked how much it would cost to get the shot. Vitginia Brady told the Board that Jayne Tapia, R.N. would like to do four hours of counseling a month for Town employees in regard to any health problems. Mr. Smith said he thought that would be a good idea. Mr. Smith asked Virginia Brady how she was doing with the Cambodian refugees. X91_ 92 OSCAR CORMIER SUB- DIVISION Virginia Brady said she is having a hard time locating the sponsors and the Cambodians cannot speak good English. Mr. Lambie asked how the letter was working out that had been put in use several months ago. The letter that the Health Office sends to let a person with a communicable disease know that the visiting nurse will be calling on them. Virginia said that it helps. At least it lets people know that the nurse will be coming. Virginia told the Board that Jayne Tapia had applied to use Cary Hall on December 1st. for a "Town Awareness" health clinic for the Lexington residents. Virginia Brady, R.N. thanked the Board and retired. Mr. Smith discussed with the Board the subdivision plans of Oscar Cormier. Mr. Cornier wants to build a subdivision way up on Grove Street. Mr. Cormier plans to build 20 single houses on these parcel of lands. There is water and sewer available to service this subdivision Dr. Roemer asked where the access is. Mr. Smith replied, "At the Grove Street/Burlington Street area". Mr. Lambie asked if they are putting in a retention pond. Mr. Smith said that there is a pond there now. The Board discussed briefly the subdivision in regard to the water, sewer and drainage that would be the Board's interest. At 8:00 p.m. Mrs. Virginia Fitzgerald Lovett and her daughter, Lisa, came before the Board. FITZ- Mr. Lambie stated that the 90 day animal permit the Board gave to Mrs. Lovett GERALD'S was up today. We indicated that if you have been keeping more than four horses HORSES there would be problems. Mr. Lambie said there has been six horses on your property for quite awhile and we only gave permit for four horses. Lisa Fitzgerald said there are only four horses there now. Mr. Smith said that all during the summer, there were six horses on your land because I checked every day on my way to work. Lisa said she was there (at the Board Meeting) to apply for six horses. Mr. Lambie said: "You have had the 6 horses all summer without a permit for six. We told you if you had extra horses on the land, you were to notify the Board of Health and you have never called to ask permission to bring in the two extra horses. Mrs. Lovett said she had been away all summer and did not know there were six horses there.- 1 1 Lisa told the Board that she owns six horses and she is going to have them there. She said she will fight to get them there and she won't stop until she get them. Mr. Lambie said that the Board has had an on-going problem with the manure storage, Also. Dr. Erdos said we are dealing with the problem of having six horses and not having enough land to keep them on according to the Board of Health Regulations. He said it states: 2 acres for one horse, 4 acres for 3 horses, etc., according to the amount of land. Asking for more horses effects neigh- bors, horses, stabling rooms, etc., he said. Mrs. Lovett said they use the Johnson's land. He has 5 acres. Dr. Erdos said, "I know you utilize that land, but the question is as far as regulations go - if you can really borrow land". Someone asked, "What about the stables?". Mr. Smith said, "There are only three stalls adequate to stable horses". Dr. Roemer asked if it was a practice to allow the borrowing of land? Mr. Smith said that they had allowed it once before, but that person has since moved away. Dr. Erdos pointed out if the abutters objected then, the Fitzgerald's could not use borrowed land. Lisa said that the abutters do not object. Dr. Roemer said we cannot assume the don't get complaints. Mr. Smith asked if the Board granted do we have you don't bring in 8 or 9 abutters do not object just because we a permit for six horses, what guarantee after that? Mr. Lambie said it really disturbs him that the Board granted a temporary permit for 90 days for four horses only, and that they had six horses there the whole summer. Mr. Lambie said the Board will have to discuss it more before any decision is made. He said the regulations have been violated. The Fitzgerald's just don't take the Board seriously. Mr. Lambie said a phone call to the Department would have made a difference. We would have known you were trying to abide by the Regulations. He told the Fitzgerald's they should have met with Barry Littleton. Mrs. Fitzgerald Lovett said that she did, but Barry gave them the run-around. He kept telling them something different all the time. Mr. Lambie said the Board will have to discuss this further. s Lisa Fitzgerald asked the Board to discuss a temporary permit for her to keep six horses. Mrs. Fitzgerald Lovett and Lisa thanked the Board and retired. Dr. Erdos said this situation is like a person building an extra room on his house and then applying for a building permit. He said when they had a permit for three horses, they brought in one extra then, now they have the permit for four horses they again do not abide by the regulations of the Board. Mr. Smith said a variance should be given (providing the Board grants a permit) rather than allowing them to borrow land from their abutters. He said this borrowing of land creates problems. Dr. Roemer said we shouldn't go along with this borrowing of land. Dr. Erdos said that the Fitzgerald's have to learn that the rules and regulations are to be kept and that they are for everybody. She hasn't shown any interest in following regulations for the past six months. Dr. Erdos said we should grant a temporary permit for four horses and consider adding a variance for using additional property. Dr. Roemer said she didn't like leaving the "door open". She said if the Board grants a permit for six, then she will bring in nine horses. Mr. Lambie said, "Issue the permit for four horses, period: If regulations aren't met, then we will make it three". Mr. Smith said if she is given a variance, it has to be filed with the Town Clerk. Do we all agree to give a temporary permit for six months and state that the request for six horses is denied? It was agreed to issue a permit for four horses only until April of 1982. Mr. Smith told the Board he had spoken to Captain Furdon about the fining of the Fitzgeralds for each day the extra horses are on their land. Captain Furdon said that she would have to be taken to court and let the court decide what to fine her. Dr. Roemer said when the horse regulations are taken up, she would like to discuss this "borrowing of land". It was decided that Mr. Smith would go over the regulations with each member of the Board. Mr. Smith said he had received a letter from Mr. Haroian of the Minute Man Associates Swimming Pool. He stated he did not need a lifeguard for the APRIL LANE pool at One April Lane. POOL 1 1 1 "95 Mr. Smith said that regulations state there should be one lifeguard for 20 bathers, 2 for forty users of the pool, etc. Dr. Erdos said the people do not use the pool because there is a charge of $165.00 a summer for its use. It is on a club membership and that the condo's do not own the pool. Mr. Smith said that most membership pools do have a lifeguard. People that join a pool club expect to have a lifeguard, especially with children. Dr. Erdos asked if the Board could make them have a lifeguard? Mr. Smith said he didn't see why not. The regulations state that one life- guard should be provided for 20 people using a pool. Mr. Lambie said we should have a pretty good criteria if we are going to enforce it. Mr. Smith said that he has put it on every pool permit that goes out of the office. Dr. Roemer said that we should decide and make a decision. Mr. Smith told the Board that the Town Manager would like all Boards TOWN -BY-LAWS to look at the Town -By -Laws. Mr. Lambie said that this Board has the power to define what waste material is. The Board discussed the changing of the animal regulations. What should be added or depleted. They will continue to discuss revising the animal regulations and each one meet with Mr. Smith with their suggestions.
