HomeMy WebLinkAbout1980-01-07HEALTH INTERN SANDERSON HOUSE - SNYDERS SMOSKE'S - HORSE PERMIT RE -APPLYING BOARD OF HEALTH MEETING January 7, 1980 The regular meeting of the Board of Health was held Monday, January 7, 1980. Members present were: Dr. William L. Cosgrove, Chairman; Mr. James W. Lambie, Dr. Michael S. Erdos and George A. Smith, Director of Public Health. Mr. Smith introduced Sandra Gabriel to the members of the Board. Sandra has joined the Health Department as an "intern" to help Mr. Smith with his inspections. Mr. Smith told the Board that Chief Corr had reported that during the past weekend, January 5th and 6th, there had been no activities going on at Sanderson House on Mass. Ave. The police had been watching it closely. Mr. Smith said he had talked to the Snyder's attorney and told him he had names of people that had gone to Sanderson House for dinner. Dr. Cosgrove said he had gone by the past weekend and he had seen cars there but Mr. Smith said the Chief of Police said they had not conducted any "restaurant business" that past weekend. Dr. Cosgrove stated that the Snyders should go before the Board of Selectmen for a common victualers license. Mr. Smith said the main permit should be issued by the Board of Health. Dr. Cosgrove said that the whole matter should be straightened out by Town Counsel. Mr. Smith reported that the Smoske's have filed another application to keep horses. He said that the Smoske's still have not been able to get together with the Freier's about the permit. Dr. Cosgrove said it should be treated like a new application and if the Freiers object we will not issue a permit. Mr. Smith said all horse owners have a horse get out once in awhile but the Smoske's horse get out every day. Dr. Cosgrove said the people living in the area have put up with enough all of these years with the Smoske's horses. Mr. Smith said the attorney for the Smoske's has been in contact with him and is trying to put something together. 1 1 1 Mr. Smith reported to the Board that Waltham Chemical has been contacted WOODPARK and will be coming to woodpark Estates to "rodent bait" on January 17th. ESTATES Mr. Smith reported that he has checked the house on Marrett Road where the "boat people" live. He said the rooms are small but they will only be there for approximately nine months. He feels they can utilize the rooms differently and make do while they are living there, so he does not object. The members of the Board were unanimous in their vote to allow the "boat people" to stay there. BOAT PEOPLE Mr. Smith reported that the Building Commissioner, Peter DiMatteo, had 33 SYLVIA received a letter stating that the house at 33 Sylvia had settled. STREET He also reported that the landlord had started the repairs and has done a lot of the work that he had requested to be done. Mr. Smith told the Board that the Town Manager had received a letter from a resident about the "gypsy moth problem" in the town. They do not want spraying but suggested mobilizing groups to pick the egg sacks from the trees. The Board discussed the problem of the gypsy moths and caterpillars and how aerial spraying is the only way to get after them but there are many people in town that are against spraying. The Board decided it is more of a Park Department problem than a Health Department problem because there is no health hazard involved. Mr. Smith said he would drop a memo to the Town Manager suggesting that the gypsy moth problem would be a Park Department problem. At 7:30 p.m. Mr. Fred Wright and Mrs. San Martino of the Mystic Valley Mental Health Association came before the Board to discuss the Budget. M.V.M.H.A. They stated they are asking about the same as last year from the Town. BUDGET It was a sum of $30,853. Mr. Wright explained that they had received an increase from the federal government and are requesting additonal monies from the State. Mr. Wright and Mrs. San Martino explained to the Board the different categories of their work at M.V.M.H.A. and of the agencies and groups they worked with in Lexington. Because they were not asking for an increase there was no further discussion of their Budget. Mr. Wright and Mrs. SanMartino thanked the Board and retired. At 8:15 p.m. Mrs. Virginia Fitzgerald Lovett, Mr. Frank Johnson FITZGERALD- and Karen Bresnihan came before the Board to discuss "increasing the LOVETT HORSE permit for one more horse". PERMIT Mrs. Fitzgerald -Lovett told the Board that Karen Bresnihan is in charge of the stable as Lisa Fitzgerald is away until the Spring. Dr. Cosgrove commented that the animal permit was in Lisa's name. Regulation for Animal Permits He questioned why the permit was not in Mrs. Fitzgerald's name. Mrs. Fitzgerald explained that the property will be Lisa's some day but the Board told Mrs. Fitzgerald she should have the permit in her name. Dr. Cosgrove said the permit should be revoked and Virginia should apply for the permit in her name. Mr. Johnson said that the Fitzgeralds used some of his land for the grazing of the horses. He stables a horse there also. The Board suggested that Mrs. Lovett re -apply for the permit in her name, as she has the stable on her property, and Mr. Johnson could write a letter stating she has his permission to use his property for grazing, etc. Mr. Smith said there is no problem giving Mrs. Lovett borrowed land but it should state "as long as land is available only" when land is not available permit should be revoked. The Board explained to Mrs. Lovett if she boarded horses from outside she would have to go before the Board of Appeals because this would be a business venture. When Mrs. Lovett sends in her application the Board will take it up at their regular meeting. Mrs. Fitzgerald Lovett, Mr. Johnson and Karen Bresnihan thanked the Board and retired. Dr. Cosgrove stated that he would like to stop "this borrowing of land" except in a rare case when someone almost makes it on acreage. The Board briefly discussed the animal regulations/amendments. It is now 2 acres for 1 horse. Mr. Smith did not think it necessary to have 2 acres for 1 horse but Dr. Erdos said he felt it was necessary and only "fair" to the horse. They decided to study the regulations further before making changes. Mr. Smith also mentioned that any variances given are suppose to be filed with the Town Clerk's Office but the Board has never done this. He also stated in order for anyone to have a horse and stable they must have a permit from the Board of Health. Dr. Erdos said they should go to the pediatricians and should also be distributed to nursery schools and kindergartens and first -grade parents.
