Mr. Smith reported that Mother Earth had cleaned up their place considerably MOTHER
and they now want to sell hot soup and hot cider. He stated that there is no water EARTH
upstairs. He is not in favor of his selling these things but he will go over there
and give it an evaluation. Wants to see just what his operation will be as he needs
hot and cold running water and they do not have it on the first floor.

BOARD OF HEALTH MEETING
NOVEMBER 5, 1979
The regular meeting of the Board of Health was held Monday, November 5,
1979 in Room G-15 of the Town Office Building. Members present were: Dr.
William L. Cosgrove, Chairman; Mr. James W. Lambie, Dr. Michael S. Erdos and
Mr. George A. Smith, Director of Public Health.
Minutes of the last meeting were approved as read.
Mr. Smith reported that the Heidke Subdivision plan has 22 items on it to HEIDKE
be updated. This is a small subdivision (4 houses) in the Young St./Webb St. SUBDIVISION
area.. There is town sewer available.
Dr. Erdos mentioned that it had been brought to his attention that the BOYADJIAN -
area is wet all during the Spring season. SYRINGE

Mr. Smith said that it would have been more our problem before the days
of Conservation than it is now.
Mr. Boyadjian of 43 Fern Street came in before the Board to ask for a
syringe permit for his wife, Brigitte. She uses these syringes in her work in
restoring pictures and works of art for museums and private customers. Chapter
94, section 27C says Board of Health has to give approval before a syringe
can be obtained.
The Board agreed to grant this permit - stating on the permit that the
syringes are to be purchased at one pharmacy only and the reason the syringes
are to be used.

Mr. Smith reported that our flu clinic was a success. We immunized
458 senior citizens, town employees and chronically ill persons. The de-
partae.nt gave some vaccine to the visiting nurses to immunize any persons
attending the well -elderly clinics that had not received the vaccine, and
wished to do so.
We also have distributed vaccine to all the nursing homes in Lexington
that had requested it so that their patients may be immunized.
The owners of Mother Earth had requested to sell hot soup and hot cider
at their store at 10 Muzzey Street. They had been selling milk without a
license but Mr. Smith advised them about it and they have since come into
the office and filed for a milk license.
Mr. Smith reported to the Board that he has given his permission for
Mother Earth to sell hot soup and hot cider.
Mr. Lambie asked about the hot water problem there. Mr. Smith said that
seems to be straightened out now but he has put restrictions on this operation.
At the end of the day any left -overs must be thrown away.
Dr. Cosgrove asked which business in the Mews had problems with storage
of their rubbish. Mr. Smith said it had been the LeBellecour not Mother Earth.
Mr. Smith told the Board that some of the products at Mother Earth were
unlabeled that they must have labels on everything sold there showing where
the products came from, what is inside the packages and the weights.
Mr. Smith asked the Board what was the date decided on at the last
meeting that the Smoske's permit would be revoked. The Board reminded him that
the horses must be out of there by December 1, 1979.
The letter from Mr. David Gennaro to Mr. John Holdsworth stating "that
the Holdsworth's could no longer borrow his land for stabling their horse
because he plans to put his property up for sale" was brought up before the
Board.
The Board voted not to renew the Holdsworth permit because without the
Gennaro land they would not have enough acreage to keep a horse.
Dr. Erdos said their permit should end.
Mr. Smith reported to the Board that Mrs. Vohl, mother of one of the
girls that stables her horse at Smoske's, went to the Board of Appeals Office
and ask for a hearing for a special permit to "board horses at their stable
before an animal permit can be issued to them.
Mr. Smith mentioned the Board of Appeals has been receiving several ap-
plications for hearings to put in swimming pools. He mentioned he has stated
if a pool is not in use over any lengthy period of time it should be drained
as it is a great "breeding place" for mosquitoes in the stagnant water.
Mr. Smith reported on the house at 33 Sylvia Street and all the repairs
that had to be done in order to comply with the Sanitary Code "Minimum Stan-
dards of Fitness for Human Habitation".
He said he had spoken with the woman at the time of one of the inspections

and had told her to call the Building Commissioner but she never did. Mr.
Smith had the Building Commissioner go down to this address with him to check
out the structure. Mr. Smith has made three inspections of this house and then
sent the landlord a letter stating all the violations.
He reported that the landlord has a right to have a hearing before the
Board of Health. They must file within seven days from the day that they re-
ceive his letter. The hearing would give the owner a. chance to have his case
heard.
Mr. Smith stated that there are no specific controls over the installation
of buried gas tanks. Mostly what exists amounts to recommendations by various HONEYWELL
State and Federal agencies. Honeywell has agreed to the recommendations that GAS TANKS
we have indicated we would like to see except the one requiring the installa-
tion of a berm which would have served to contain a sizeable spill. Honeywell
indicated that such a berm would interfere with snow removal. Honeywell they
would augment our recommendations though the use of monitoring cameras and
some type of an overtopping alarm system.
Mr. Smith said that he advised Honeywell to contact the City of Cambridge
Water Department and D.E.Q.E. to insure that their requirements are met.
At the present time Honeywell is formalizing their plans for these gas
tanks to be installed.
Mr. Smith told the Board he may have the representatives from Honeywell
attend our next Board Meeting.
Mr. Smith reported that he has had has had several complaints about the
Peking Gardens having cockroaches. He said basically he finds the restaurant PEKING
is clean. If complaints continue and the cockroaches are not exterminated, GARDENS
Mr. Smith said he would have to close down the restaurant for a few days and
have the whole restarant exterminated by a pestcontrol company - even if it
may mean having the carpets taken up and start right from the bare floors.
Mr. Smith reported that he -feels thatc.the;roaches are either being brought
in by the trucks that bring in the supplies or that the employees could be
bringing them in on their clothes.
Mr. Smith reported that the budgets we have will be approximately the same
as last year except the animal control budget. He will have to ask for more
money for that account because of the inflation with the prices of gas (heat)
and the light rates. Dr. Erdos asked about the M.V.M.H.A. budget. Mr. Smith
said that is sent directly to the comptroller's office.
Mr. Smith told the Board we are getting calls in regards to absestos and
also about the "sandblasting" of houses. One house was being sandblasted on
Barnes Place and neighbors were all upset. Sandblasting techniques are per-
mitted and loosely covered by Air Pollution Regulations.
Mr. Smith reported that "Mosquito control" has been included again this
year on the town warrant. It will go again before town meeting to vote on.
Mr. Smith told the Board that there are new rules and regulations under

Dr. Erdos asked what the major changes were.
Mr. Smith said Chapter II of the Sanitary Housing Code was about ';tenants
rights". If the Board of Health orders a house condemned the Board of Health
has to pay $200.00 towards the moving fees.
Dr. Cosgrove said it should be the owner's responsibility to get the
tenant evicted. Mr. Smith replied that it is.
Mr. Smith said we don't move anything but the Board of Health would have
to pay the money towards the moving fee.
Mr. Smith reported that a new law has been passed by the Legislature
that a dog must receive rabies vaccine before his owner can license it.
In Lexington we always require a license before the dog could get the
vaccine at our free rabies clinic. It will be a problem because we do not
have our clinic until May of each year.
One of the Board members suggested that the County Dog Officer be con-
tacted to see if we could get around that new law for this coming year and
continue out program as is for the present time.
Dr. Cosgrove said it isn't our problem - it is the Town Clerk's but Mr.
Smith said it is our problem as long as the dog officer works out of our
office.
Mr. Smith reported that the Building Commissioner came to him and want
SEALER OF to transfer the "sealer of weights and measures" to the Health Department.

MEASURES Mr. Smith stated that it includes taxi meters, bus meters, among other
type of scales and meters and he feels that this should not be transferred
to the Health Department.
Mr. Smith said this is an employee that works a full time job in an-
other business and does this on his own time. He is an employee that we
would never see.
The Board agreed unanimously that it did not have anything to do with
the health field and they are against having it transferred to the Health
Department.
Mr. Smith reported that he has received the applications for a health
intern and he is reviewing them at this time. He feels there are a few
qualified for the type of work he would like to have them do.
Dr. Cosgrove stated that he wants the animal control department moved
out of the health department office. He feels it takes away the health
ANIMAL employees from health work and that there is too much time having to be
CONTROL put into the dog work.

Dr. Cosgrove asked Mr. Smith if he would like the animal control
department removed from the health department and Mr. Smith stated it does
take him away from his health work quite a bit of the time.
Dr. Cosgrove said he has seen times when Mr. Smith has to spend more
time on dogs than he should have to.
Dr. Cosgrove had some papers to pass out to the Board Members showing
that every town around with dog programs and dog officers have all been

under the police departments of the towns and cities respectively.
The Board agreed that the dog program should be under the police depart-
ment but in any case it should be removed from the health department.
Mr. Smith reported that Mr. Freeman of Kerri Real Estate had submitted RIDGE
his plans for Ridge Estates II. ESTATES

Dr. Erdos said we only have to pass on the sewer and water.
The Board discussed his calling it "Planned Unit Development" (Cluster
Developing). It is single family homdi so it is still a subdivision.
Mr. Lambie stated it would still come under the same review as any other
subdivision that comes before the board for review.
Dr. Cosgrove asked how many houses would be in this subdivision. Mr.
Smith said there would be around 54 houses.
Mr. Smith stated he thinks Mr. Freeman should be invited into the next
board meeting to discuss this subdivision.
The Board members asked if we were responsibility for sewer and water
only or is drainage their responsibility also.
Mr. Smith said drainage was not the Board of Health's problem any more
not as much as it use to be.
Dr. Cosgrove and Mr. Lambie both stated they would like to check the
drainage on this subdivison plan.
Mr. Smith reported he has received some complaints about the chlorine
acidity at the Minute Man Vocational School pool. The chlorine is bothering MINUTE MAN
the eyes of some of the students there. VOC. POOL
Mr. Smith also reported that he had received some complaints about the
dumpster behind Mario's Restaurant. He said someone had complained about
the odor.
Mr. Smith had checked it out and everything was all right. The trash
collector has been coming on a regular basis.
