repairs are not made within 30 days a complaint will be filed in Concord
District Court.
Mr. Smith reported to the Board that a young fellow by the name of
Bass, 25 Valley Road, had come into apply for a massage license. He
planned to operate this business in a room at the Battle Green Inn. Fur-
ther checking showed that the people at Battle Green Inn did not know
anything about his plans.
Mr. Smith discussed this person with Chief Corr and they will keep
this person under surveillance.
The Kreb's School application to keep one pony was approved by the
Board.
Mr. Lambie said that there was a meeting of the Growth Policy Com-
mittee this week and he will attend as the Board of Health representative.

BOARD OF HEALTH MEETING
APRIL 5, 1976
The regular meeting of the Board of Health was held, Monday, April 5,
1976, in Room G-15 of the Town Office Building. Members present were:
Dr. William L. Cosgrove, Chairman; James W. Lambie, Dr. Charles Ellicott
and George A. Smith, Director of Public Health.
The minutes of the March 1, 1976 meeting were approved as read.
Mr. Smith brought to the attention of the Board the new Anti -choking
Regulations passed by the State Health Department. He also showed the
Board brochures on a "Throat -E -Vac" device. To date the State Health
Department has not approved any of the devices on the market and until
they do this law cannot be enforced. Each restaurant that has a dining
capacity of twenty-five or more must have a State approved device on the
premises.

Dr. Ellicott said as he understood it this device must be in a conspicious
place and hopefully a diagram showing how it is operated.
Mr. Smith said as he understood it more than one employee would be trained
to use this device so that an experienced operator would be on the premises at
all times.
Dr. Ellicott said he imagined these devices could be rather expensive and
he felt a pair of forceps would do just as good.
Mr. Smith said nothing had been approved -yet and when a device is approved
we will discuss this again.
Mr. Smith reported that there were.4 or 5 houses on Moon Hill Road that MOON HILL
did not want public sewer. Some of these people do not have problems with RD. SEWER
their septic systems right now but if this sewer is not carried out the full
length of the road now it could create a problem in the future plus being
very costly.
Dr. Cosgrove questioned Mr. Lambie about how the government felt about
public sewer extentions. He said he remembered Mr. Lambie saying that the gov-
ernment did not want too many more public sewers. Dr. Cosgrove went on th say
we had never had anything in writing concerning that.
Mr. Lambie said he understood that the M.D.C. was not looking for any more
towns to service but would continue to service all the towns they had even with
the new lines.
Mr. Smith said he remembered a time when the M.D.C. had stopped Framingham
and Natick from adding any new buildings to the sewer line.
Mr. Lambie said they were probable trying to control the flow.
Mr. Smith said he had heard that Mrs. Joan Cruthers spoke at Town Meeting
stating that the Health Director had not been very helpful. He felt the Board
should know because Mrs. Cruthers had been into the office a number of times
and had been given all the information she had requested. She also sat in his
office and made notes when he had been at his desk and she did not speak to him -
in fact, she had made him so uncomfortable he had left his office and went into
the laboratory to do his work. Mrs. Cruthers also feels that the Town should
only install sewers where it would not interfere with the open land. There is
still about 20% of the Town left to be sewered, some areas will never be
sewered because of the area.
Mrs. Cruthers also wanted Mr. Smith to recind his recommendations for the
areas that should be sewered. Mr. Smith explained that only areas having real
trouble have been recommended.
Dr. Cosgrove asked how bad Moon Hill Roadneeded the sewer.
Mr. Smith said most of the houses were having real problems and there was
just no place to go for repairs.
Dr. Cosgrove said the only thing we can do is stand by our recommendations.
Mr. Smith reported that Wild Acre Inn had trouble a week ago but they are
now on contract with Sububanite to pump the system every Friday. This should
taken care of the problem until the Selectmen make up their mind what they are
going to do.

Mr. Smith reported that Mr. Potter, building a house on Walnut Street,
had requested a variance to put his new house on septic system until public
sewer is available. He went on to explain that the building permit had been
issued because public sewer was supposed to be installed in time to service
this house, however, the bids just went out on this job so Mr. Potter has
applied for a temporary variance until public sewer is available.
The Board granted this variance but instructed Mr. Smith to try to
get more information as to when this sewer line would be installed.
Mr. Lambie said he had been thinking about the spillway and retention
pond proposed by Mr. Freeman on the Concord Avenue subdivision and he said
he felt this should be capable of handling a 100 year storm.
Mr. Smith said he would check this out.
The application for a permit to keep 3 horses by Robert & Marie
Rollins at 205 Grove Street was discussed by the Board.
In view of the fact that the Rollins' had enough land and there had,
to date, been no objection from the abuttors the Board voted to grant
this permit.

Mr. Smith explained to the Board that he had received a call from
the firm of Amicon questioning if a Mrs. Bernardine Clarke had a permit
to sell food.

Mr. Smith said he went up to Amicon and Mrs. Clarke walked in with
her basket of sandwiches and brownies. These sandwiches were carried in
the trunk of her car. The sandwiches sell for $2.00 each because they are
fancy roast beef sandwiches or tuna and pineapple. She is working out of
her home. Investigation showed that she did have a basement kitchen which
she used for just her selling food. This kitchen did check out all right.
Mr. Smith said he had her apply for this application and also told
her she must apply for a peddlers and hawkers permit. The sandwiches
must be refrigerated in her car so she has bought a picnic type ice box
at Sears and also blocks of ice which she can put into her freezer at
night. Mr. Smith said he would recommend that the Board restrict her to
about 15 sandwiches per day and 3 to 4 dozen Brownies per week.
The Board after some discussion agreed to grant the permit to Mrs.
Clarke with the conditions as set by Mr. Smith. If Mrs. Clarke does not
abide by these conditions her permit will be revoked.
Mr. David Zalago came before the Board to request a variance to
connect a new home he is planning to build on North Street to subsurface
sewage although public sewer is within 200 feet of his lot line.
Mr. Smith said that although public sewer was on North Street it
would create quite a hardship to connect this house to the public sewer
line. The percolation tests for this lot were very good.
Mr. Zalago presented to Mr. Smith the Miller & Nylander report for
this lot.
The Board voted to grant this variance providing the tanks and leach
area was located in the front of the house.

Mr. Smith said he felt that it was about time the Board of Health updated
their regulations. He suggested the Board look over the present regulations
and make some suggestions. The Board of Health Regulations have not been up-
dated for about 20-25 years and there have been many changes.
REGULATIONS
Mr. & Mrs. Gavin and another couple (names not given) came before the
Board to discuss their plans to take over Pete's Deli at Countryside. PETE'S
Mr. Smith explained to Mr Gavin that this establishment was in trouble
because it was so dirty and there were many violations to the regulations.
Unless Mr. Gavin was prepared to do a great deal of work and a great deal
of cleaning he could not approve this.
Mr. Gavin explained to the Board that they realized that this place
needed a great deal of work done on it but they wanted to take over the
operation without clising because of the financial part of the business.
They were prepared to do a great deal of cleaning right off the bat. He
went on to say he know that Pete was having trouble with the Health Depart-
ment but they were prepared to do a great deal of cleaning right away. How-
ever the extra toilet required would have to wait because of the hiring of
plumbers and etc. He continued to explain that he planned to carry on the
same type of operation but some of the sandwiches would be changed and pizza
and possibly a salad bar would be added. Mr. Gavin said some of the equip-
ment would be changed but it would have to be done as they went along.
Mr. Smith said they would need to install another toilet room.
Mr. Gavin said he realized that but he wondered if he could have some-
time before he installed the toilet roan.
Mr. Smith said he would agree to allow him four months but that was all.
He went on to say to Mr. Gavin he was going to have some problems because
we have had complaints regarding dirty dishes and silver ware. He suggested
Mr. Gavin attend the Food Handlers workshop to be held next week.
Mr. Gavin asked Mr. Smith to send him a list of all the things he wanted
done.
Mr. Gavin's partner said he had operated a place such as this in Nashua,
New Hampshire so he did know something about the operation.
The Board suggested Mr Gavin get the place cleaned up and they thanked
him for coming in.
Mr. Smith reported on the problems regarding the Giroux Building and
said he felt that we would have running complaints regarding this building.
The Deli-Shuss, Yentas Greed Restaurant, the Camera shop and eventually the GIROUX
new Chines Restaurant would all be calling. Right now the man in the BUILDING
Camera Shop feels that Mr. Giroux broke his word by renting to people run-
ing restaurants. He claimed he had moved from Bedford Street because be-
cause of the Pizza Shop. The fellow in the Deli-Shuss feels he has been
wronged because Mr. Giroux has rented to the Greek Restaurant and now the
Chinese restaurant. They do have to be watched because of the rubbish and
garbage disposal. Some work has been done on the ventillation system so
hopefully things will calm down.
Alexander's Pizza Store was discussed by the Board. Mr. Smith sent to ALEXANDER'S
all Board Members the file on Alexander's Pizza establishment prior to this PIZZA
meeting because Mr. Panagiotou, owner of Alexander's Pizza had been ordered
to appear before this Board. Mr. Panagiotou did not appear, did not send a
representative, and did not contact the Health Office to explain why he

would not appear at this meeting.
Mr. Smith said as the Board looked over the material in the file they
could see that this establishment was being operated in a very unsatisfactory
manner and he was fed up with the whole thing.
Last year Alexander had asked permission to take out one toilet because
he was going to enlarge his store and he was moving into the store next door
which would give hime the second toilet. He did not take over the other
store it is now rented to someone for an entirely different operation.
Mr. Smith talked of the number of problems he has had with Alexander's
during the past 2 years and he said he would like the Board's permission to
close this establishment if he could not get the problems corrected.
The Board after some discussion agreed that Mr. Smith should write
to Mr Pangiotou, owner of Alexander's Pizza, and tell him he has 30 days
to meet all the requirements of the Board of Health or he will be closed.
Mr. Lambie said he had been told that at the Public Works Building
PAINT in the Paint Shop the ventillation was very poor and apparently some of
SHOP workers had been affected by the fumes. He asked Mr. Smith to look into
the matter.
NOTE: A phone call 4-6-76 corrected this area to the welding shop.
Mr. Smith said he would contact the State Department of Labor and
Industries which governed this type of operation, also the Building Depart-
ment and Fire Department would have to investigate.
