The following permits were signed by the Board: Animal Permits Virginia Fitzgerald, 31 James Street, 2 ponies Mr. & Mrs. Francis Smith, 49 No. Hancock St., 2 goats Food Establishments Coyte's Diner, 1386 Mass Avenue, Arlington (Canteen Truck) Bamboo Hut, 177 Massachusetts Avenue - being held for inspection Alexander's Pizza, 180 Bedford St. Dunkin Donuts, 373 Waltham Street Arno's Delicatessen, 321 Woburn Street Bellino's Donut Shop, 141 Massachusetts Avenue A R A Services for Honeywell, 2 Forbes Road (Caterer) BOARD OF HEALTH FETING NOVEMBER 6, 1972 The regular meeting of the Board of Health was held Monday. November. 6. 1972 at 7:00 P.M. in the Conference Room G-7. Members present were: Dr. William Cosgrove, Chairman, Mr. James Lambie, Dr. Charles Ellicott and Robert C. Heustis. Director of Public Health. The minutes of the October 2. 1972 meeting were approved as presented. Mr. Heustis reported that the Boston Guild for the Hard of HARD OF Hearing was going to conduct a course in lip reading. The course HEARING will be 40 hours and run all day Tuesday and Friday for 4 weeks. He said he had spoken to Mrs. McGonagle of the Red Cross and a few of the Directors of the Nursing Homes. They all seemed very interested and thought some of their members might take advantage of this course. The Board suggested that Mr. Melbye of the Senior Citizens be notified of this course and anyone else that Mr. Heustis thought might be interested. Dr. Cosgrove reported that he had talked to Mr. O'Connell, Town Manager about the Mystic Valley Mental Health Budget, and MYSTIC as the members knew there was a sizable increase requested for VALLEY the coming year. He said he didn't think there was much need MENTAL for the Board to discuss this Budget until such time as there HEALTH is e meeting with a member of the Board of Selectmen. Town BUDGET Manager, and a member of the Board of Health. He said he felt that after that meeting notice would be sent to MVMHA to come up with a realistic request for the coming year. 456 POLIO CASE EXTRA HELP SANITARIAN REPLACE Dr. Ellicott asked if the Board could be certain that the Article for MVMHA funds would be included in the Town Warrant for Town Meeting. Dr. Cosgrove said the Article would be included either without a figure or with the same amount spent this year. An agreement could be reached before Town Meeting. The Board agreed to table the MVMHA budget until a later date. Mr. Heustis asked if there was anything new on the Polio Case. Dr. Ellicott said he could not add much to what the Board already knew about the Polio case. He went on to say that he was disappointed that the Christian Science people were only immunizing the school children and that the pre-schoolers were not being given the Vaccine. He suggested a letter of thanks be sent to Mrs. Hayward here in Lexington and also the Director of the Christian Science in Boston for their excellent cooperation during this emergency. Dr. Ellicott reported that Dr. Warren Taylor, a member of the Winchester Board of Health, had talked to him about sharing a sanitarian. Mr. Heustis had requested extra help in the Personnel Service Budget, and this might be one way of obtain- ing the extra help. Mr. Heustis said he thought Mr. O'Connell might have some- thing different in mind, such as a Junior Planner that would divide his time between the Planning Board, Conservation and Health Department working on Hatch Act Problems. Dr. Cosgrove said there really wasn't much the Board could do about this until they heard from Mr. O'Connell. He thought a letter should be written to Dr. Taylor telling him that we could take no action regarding part-time help until we heard from Town Manager. Dr. Ellicott said he had received a letter from Peter Clark. Director of Replace, requesting help from the Board of Health in regard to Veneral Disease and Birth Control. Dr. Ellicott said he had given Peter a list he had of free clinics, also.. Dr. Carey of Arlington, told him that most of the Drug Companies would supply free of charge all the antibiotics that he needed to treat these patients but this would have to be done through the local Doctors. Dr. Ellicott said he thought the Waltham Hospital had a free clinic but he would find out more about the service and if it was available to non-residents. CABLE Dr. Ellicott said a Mr. Page of Polaroid Corporation had COMMUNICATION been in touch with him discussing cable communication for Lexington. Dr. Ellicott said he really didn't know what Mr. Page had in mind. He said he didn't know if this was a public health matter or a matter for public education. 1 1 1 457 Dr. Cosgrove said Mr. Page could be asked into a meeting but he should have good concrete information when he does come in. The booklet describing the Multi-Phlsic Health Screening PHYSICAL Program offered at the Woburn Rehabilitation Center was dis- EXAM - cussed. Dr. Ellicott said this had been received by him and he INATION thought where the Town had discussed a Town Physician they might be interested in this service as a pre -medical work up before the Doctor saw the employee. He thought the booklet should be sent to Town Manager. Mr. Heustis reported that Mr. Mason's Attorney had been into the office and that Mr. Mason was going to pursue the matter of McDonald's horses. He had also written to the State Health Department asking them to over rule the Board of Health's MASON AND ruling. The Attorney had also been to Mr. Irwin regarding the McDONALD violation of zoning. Mr. Heustis asked if the Board thought he had to turn over all the records we have to this Attorney. It was agreed that the minutes of the meetings were public information but the correspondence and etc was our file and did not have to be shown upon request. Mr. Heustis said that Mrs. Freda Cooper brought in a letter PUBLIC regarding the need of a Public Health Nurse for the elderly. TheHEALTH Board said they would have to discuss this further. NURSE FOR` ELDERLY HEARING -BAMBOO HUT At 7:30 P.M. Mr Winchell P. Woo, President of the Bamboo Hut and Mr. Yee, Treasurer of the Bamboo Hut, came before the Board to dscuss the suspension of the Food Establishment Permit of the Bamboo Hut after an inspection had revealed an infesta- tion of cockroaches. Dr, Cosgrove asked if Mr. Woo had asked their lawyer to come to this hearing? Mr. Woo said they did not think it was necessary to have legal counsel at this hearing. He went on to say they were selling the Bamboo Hut and hoped that the Board of Health would allow the new owners to open as soon as possible because they were loosing a great deal of money because they were retaining all the help. Mr. Heustis asked what had happened to the house keeping program which was initiated after the last closing. He understood that Mr. Woo had hired an exterminator and cleaning people to come in on a regular basis and they would keep this place clean. Mr. Woo said he was sorry but he was to blame for the condition at Bamboo Hut. They have been so busy with the new operation in Wayland that they have not spent; any time here in Lexington checking the restaurant, he also let the cleaning people and exterminator go. Mr. Heustis said we now have an application on file to operate this place as the Bamboo Garden, this will be new ownership is that right? 458 Mr. Woo said "Yes". Dr. Cosgrove said we can't take any action on this new place until we get this matter straightened out. Mr. Heustis said the legal agreement between the owners of the Bamboo Hut and the new owners depend on the re -issuing of the Food Establishment Permit. Mr. Woo said he hoped that the new owners could get their permit as soon as possible. Dr. Cosgrove said there was nothing the Board could do until Mr. Heustis had made an inspection and found everything satisfactory. We have suspended your permit twice and you still do not correct the violations. We cannot have that going on. Mr. Woo and Mr. Yee retired after further discussion. Motion made by Dr. Cosgrove and duly seconded that the Food Establishment Permit to operate Bamboo Hut be revoked permanently. Dr. Cosgrove instructed Mr. Heustis to contact Town Counsel, Mr. Cohen, regarding the action taken by the Board and find out what action must be taken now on the new ap- plication for Bamboo Gardens. HEARING - CATALDO LAND FILL Mr. Ralph Cataldo came before the Board to discuss an extension of time on his permit to re-claim agriculture land on his farm. C.4.1 1 1 Mr Cataldo presented the Board with a map showing the area he wants to fill. He said he had talked to the Conservation Committee and they want him to leave 100 feet on either side of the brook, they talk of buying this land for an easement. He said his plans now are to keep the fill about 1 foot higher than the brook. At the present time there is no agreement with the Conservation Committee as to how high or how close the fill will be to the brook. The plans show the elevations to be about 156 to 157. Mr. Cataldo said what he would like would be a continuous permit. Mr. Sullivan. Engineer for the Town of Arlington. said this fill is spasmodic. It is good clean fill and usually me or one of my men check to make sure that is what goes to Cataldos. Mr. Heustis asked if they would respect the 100 feet ease- ment requested by the Conservation Committee, and if the fill was being placed in such a way to protect the brook from silt. He would recommend that the Board grant this permit extension with recommendation that Mr. Cataldo cooperate with the Con- servation Committee. 1
