on closing a place down. Should he close a place when he found
a number of violations right away, or should he come back to
the office and talk to them before he closed a place?
The Board discussed this and agreed that if a restaurant is
in violation on a number of things and have made no effort to
correct them then Mr. Heustis should close them until corrections
are made but he should call each Board Member as soon as possible
after his action so they will be aware of the reasons for closing
this establishment.
The Board discussed Part "A" of the annual report. Dr. Cos-
grove and Dr. Colburn noted a few corrections in wording, etc.
Mr Lambie suggested that the opening paragraph be shortened and
more written on Fluoridation and Drug Abuse.
The clerk appreciated these comments and will try to make
the corrections as suggested.
The following permits were signed by the Board:

BOARD OF HEALTH MEETING
JANUARY 5, 1970
The regular meeting of the Board of Health was held January
5, 1970 et 7:00 P.M. in the Heal':h Depar.;ment Office. `—rbers
present were Dr. William Cosgrove, Chairman, Dr. Charles Colburn,
Mr. James Lambie and Robert Heustis, Director of Public Health.
The minutes of the December 8, 1969 meeting were approved
as read.
The letter from the Middlesex Soil Conservation Service
regarding the reclamation of property owned by Mr. DeFelice,
22 Mellex Road, was discussed by the Board.
Mr. Heustis reported that Mr. DeFelice has agreed to do
whatever the Board requires to abate the nuisance of the un-
lawful dump on his property. He showed the Board the pictures
taken on September 23, 1969 and said there had been no change

in the conditions since t, hat time. The court had ordered Mr.
DeFelice to stop dumping in this area and he was to appear
again in court on the 30th of this month to see if corrections
had been made.
The Board agreed that the guidelines set by the Soil Con-
servation Service were good but that it was a little unreason-
able for this Board to order the type fertilizer and the plant-
ing of trees to enhance the property. The grades and the top-
soil to be used was reasonable and keeping the material et
least 10 feet from the Kiln Brook to prevent siltation was
reasonable.
Mr. Lambie said we still keep coming back to the Hatch
Act on these areas. Did Mr. DeFelice get an excemption on
this?
Mr. Heustis said Mr. DeFelice did get an agriculture
excemption after the fact. He went on to say he would request
the court for and extension until May 30th if that was all
right with the Board and he would write Mr. DeFelice e letter
stating what should be done to correct this area satisfactorily.
The Board agreed that this action would be satisfactory
and instructed Mr. Heustis to notify Mr. DeFelice.
Dr. Cosgrove explained that he and Mr. Heustis had met
with the Selectmen to discuss the request made by the Board
for a transfer of funds for the preliminary survey of the
public water supply for fluoridation. The Selectmen asked
if we would withdraw this request and put an Article in the
Town Warrant for a definitive survey plan. This would then
be followed by another article at a Special Town Meeting which
would no doubt be held in the Fall.
Dr. Colburn asked why the Selectmen wanted this done
this way, were they opposed to Fluoridation.
Dr. Cosgrove said they said that many times preliminary
studies are done and then nothing happens with them and it
just is an expense to the Town.
Mr. Heustis showed the Board some literature on Fluor-
idation and said it might be e good idea to send copies of
these booklets to all Town Meeting Members.
Dr. Cosgrove said he felt that at this time a series of
articles should be written for the. Minute Man Publication and
in this way bring some pressure on the Town Meeting Members.
Dr. Colburn said he felt the letters we have on file from
the Bedford Air Base and the Veterans Hospital Administration
favoring fluoridation should be published in the paper.
Dr. Cosgrove requested that a letter be written to the
Massachusetts Dental Assodiation requesting any material
available on fluoridation.
It was also suggested that Mr. Nitzberg who expressed
his interest in fluoridation in the Spring be invibed to the

next meeting to discuss the fluoridation issue.
The notice and explanation for Out of State Travel was
approved by the Board.
The order and letter sent to the Lexington Sheraton Motor
Inn was approved by the Board. SHERATON

Mr. Heustis explained that he received a complaint from
a woman who had attended a wedding reception at the Sheraton
Motor Inn, that five of the six guests at her table were ill
within 12 hours after the buffet dinner with stomach cramps,
nausea and diarrhea. This was an unconfirmed complaint but
as a safety precaution the Sheraton Motor Inn was advised to
curtail all buffets until proper refrigeration was provided
for this type of service.
Mr. Heustis went on to say he was not completely satisfied
with the conditions of this establishment.
The Board instructed Mr, Heustis to keep after them until
things were done to his satisfaction.
The letter and order regarding the coin operation on the
rest rooms at the Pewter Pot Muffin House was approved by the
Board. PEWTER

Mr. Heustis explained that the manager had a coin operated
lock installed on the outside door to the rest rooms in order
to prevent vandalism in the rest rooms and we had received com-
plaints about this. The State Sanitary Code requires that rest
rooms be provided for the help and they must be adequate and
convenient. The locked door was not convenient and therefore
the order to remove the coin operated locks was issued.
The letter of complaint from Mr. & Mrs. William Sullivan IVARSON
regarding the horses at Ivarson's, 22 Cottage St., was read HORSES
by the Board.
Mr. Heustis reported that he had made an inspection and
found 2 horses and 1 pony. The Ivarson's permit was for 2
ponies and 1 horse. Mr. Sullivan complained that the horses
banged the sides of the shed all night and that the horses
tethered on the property line. He also claimed that the shed
was on the lot line and therefore violated the zoning laws.
Mr. Heustis said he felt this was a family problem.
Dr. Colburn said he didn't think there was any action the
Board could take on this problem at this time. Both the Building
Inspector and the Police had been notified of the contents of
this complaint. He did, however, feel that a letter should be
written to the Ivarsons stating that a complaint had been received
and that some corrections should be made before renewal of the
permit is granted in April.
As a point of information to the Board it was reported that KELLEY
Joseph Kelley had made application for a permit to erect a barn 83 CARP
with 19 stalls for horses. He now has a permit for 8 horses. AVE.
The Building Inspector has referred this request to the Board
of Appeals.

The Board said they have no control over the barn to be
constructed but they would have control over the number of
animals he was allowed to have in the barn.
The Board requested that copies of the Andover's Health
Department Regulations for keeping horses be made and sent to
them so they could study them before the next meeting.
DUNKIN Mr. Heustis reported that Dunkin Donuts had submitted
DONUTS plans for a shop to be erectedon the site of Breslin's
Market at the corner of Waltham Street and Marrett Road. He
said he wondered if the Board had any feelings about such an
establishment so close to a residential area. In the past
we have had a number of complaints about the Bakeri frying
donuts and Dunkin Donuts does have the advertisement that
fresh donuts are made every 4 hours. This building may have
to go before the Board of Appeals because of the parking
area.
Mr. Heustis said he would like to write a letter to
Dunkin Donuts Corporation requesting any information they
might have or corrections they could make if the frying
operation caused a nuisance in this area.
The Bcard agreed that all that could be done before this
business opened to prevent a nuisance the better it would be.
The Health Officer's Report was checked and it was noted
that the milk counts on the whole were much better. Counts
from Cumberland Farm were still high.
Approval for the State for Fairlawn Nursing Home was
signed by the Board.
