Whatif the conditions we set forth are not acceptable to the Town of Arlington. Mr. Daley: If the conditions set down by this Board are not accepted by Arlington then we don't want them in this town. Mr. Heustis: It seems to me that there will be a split responsibility. Mr. Daley: The permit would be given to the Cataldo's and then it would be up to them to see that all the conditions were followed. Dr. Cosgrove: We will get a letter off Wednesday to Town Counsel and see what he has to say and then we will see if we can take care of this matter as expediantly as possible. Mr. Cataldo and Mr. Daley thanked the Board and retired. Mr. Heustis explained that there was approximately 600 rubella vaccine doses left after the clinics in the schools and he wondered if the Board would be willing to have another clinic at Cary Hall for kindergarten and grade 3. This would have to be on a basis of as long as the vaccine lasts, also RUBELLA a make-up for the 1st and 2nd grades. VACCINE MAKE UP The Board agreed. CLINIC It was voted that the next meeting of the Board would be held December 8, 1969. Meeting adjourned at 10 P.M. Dorothy Jones, Clerk BOARD OF HEALTH MEETING DECEMBER 8, 1969 The regular meeting of the Board of Health was held Monday, December 8, 1969 at 7:00 P.M. in the Board of Health Office. Members present were: Dr. William Cosgrove, Chairman, Dr. Charles Colburn, Mr. James Lambie and Robert Heustis, Director of Public Health. The minutes of the November 3 and 17th Special Meeting were approved as read. The Board once more discussed the application for a permit to keep a horse by Vernon Parsons at 65 Allen Street. PARSONS ANIMAL Due to the objection of the abuttors as was recorded at PERMIT the public hearing held on November 3, 1969,.the Board felt Mgt' d-6ffA n do T u'i6Ki must be set down regarding this permit. 312 Mr. Lambie: I feel this permit could be granted but that some point of land should be set down so that the horse would have to stay back away from Mr. Hopkins property. Dr. Colburn: If we set restrictions on this permit, we should set restrictions on all permits that have been issued or revoke all permits that have been issued. Mr. Heustis: I think this is rather an exceptional case, with extenuating circumstances. Dr. Cosgrove: Mr. Parsons mentioned 200 feet back, where that will locate the fenced area I don't know. I definitely feel we must set some restriction so that these people will not put that horse near Mr. Hopkins or the other people in the area. Mr. Lambie: I feel that Mr. Hopkins has a perfect right to object to the horse being tethered right outside the win- dow, I certainly would not like it to happen to me. I do feel we can grant this permit, Mr. Parson's has the land and it is a good place to have a horse. Dr. Colburn: I make a motion we grant Mr. Parsons a per- mit to keep a horse on his land at 65 Allen Street provided that a fence is erected which would confine the horse so that at no point would it be closed to the Hopkins residence than 10 feet from the proposed stable as shown on the plan submitted, and going from that point nearest the stable in a line to the north- west corner of the Hopkins property. The Board agreed and the motion was voted on and duly passed. The clerk was instructed to send a sketch of the area to be fenced with the permit and letter of approval. Lot #14 Carriage Drive was again brought to the attention of the Board, 1 LOT #14. Dr. Cosgrove: As far as I am concerned we have spent CARRIAGE LOT #14 enough time and the Town's money on this problem. It was DRIVE CARRIAGE my understanding that if Mr. Lucas, of Whitman & Howard DRIVE approved this lot and if the sanitary system and the swail was installed as shown on the plan approved by our engineer that was all there was to it. Now these people want a certified plan of the grades and everything else. I feel we have gone as far as we have to go. These people objected to the development of this lot in the first place. Mr. Lucas said that this system would not interfer or aggravate the problem that was already on these peoples lots. I for one feel that they are trying to remedy a situation that they have lived with for a long time. If the change of swail from 2.2 to 2.1 is agreeable to Mr. Lucas then I feel this is all that we have to do. I for one am against spending any more of the Town's money on this one lot. The Board agreed with Dr. Cosgrove. 31'_3 The request of Ralph and Joseph Cataldo for a permit to create a dump or Sanitary Land Fill Program on property owned BOW ST. by them on Bow Street, Lexington was discussed by the Board. DUMP This Sanitary Land Fill Program would be operated by the Town of Arlington to fill in low land in the rear of the Cataldo Farm. This land to be used for agriculture purposes. Dr. Colburn: In view of the letters from Town Counsel and the le,ter from the Planning Board regarding the Zoning of this type of operation I don't see but what we have no alter- native but to refuse this request. Mr. Lambie: The amendment to Chapter 515 stating that any dumping site must be located more than 300 feet from any dwelling would certainly cut down the area to be filled. I also don't understand why Arlington would want to use this land if they are spending the money to make a hydrological study of the Great Meadows with the Town of Lexington. Dr. Colburn: I move that the Board refuse this permit request to protect the public health, comfort and convenience of the citizens of Lexington. Motion voted and duly passed. Prior to this Mr. Heustis had to leave the meeting to meet FLUORI- with the Board of Selectmen to discuss the request by the Board DATION for a transfer of funds from the Reserve Fund to the Engineering Account for a Prelimimary Study for the installation of Fluor- idation equipment. Mr. Heustis reported back to the Board that the Selectmen were tebleing this request until they could check with Town Counsel on: (1) If it would be legal for the Board to use this amount from their expense budget and (2) What the implication would be if the Town Meeting voted the article on fluoridation down. Mr. Lambie reported that he had made a survey of the DRUMMER Drummer Boy Subdivision. I question if we have a right to have BOY an engineer's study done as suggested by the Planning Board. SUBDIVISION We would certainly need a lot more information if we did go along with it. Mr. Heustis: I have talked with Mr. Zaleski of the Plan- ning Board and he said they would like more from the Board than what we had sent to them which was the cellar elevations and etc. as stated in Mr. Lucas' report. Mr. Zaleski thought the Board should be concerned with what effect this subdivision would have on the area around it. Mr. Lambie: I don't think we are prepared to make a survey of drains and water impounding area. I don't believe we are responsible for this type of a survey for a subdivision approval. Mr. Heustis: The Planning Board was concerned if the de- veloper started filling in the area it would effect the exist- ing dwellings in this area. 314 STOP & SHOP BUTTRICKS Mr. Lambie: Mr. Lucas' report does not mention any fill, he stated cellar grades at/or slightly above the existing grades. Dr. Colburn: I feel this request from the Planning Board is unreasonable, they are just trying to get us to do their work. Dr. Cosgrove: I don't think we can do anything like that, we do not have the money for engineering fees to cover a survey like that. If the Planning Board wants that kind of work they should either have it done themselves or have the developer submit an engineer's report with his subdivision application. We can only be concerned with septic tank systems and drainage of lots, and etc. I would refuse ,to make any statement unless we have the advise of our engineer. Mr. Lambie: If the Planning Board is concerned about this area they can refuse this subdivision. Mr. Heustis: I think the Planning Board would like this Board to concur with them regarding their concern of this area. I did talk to Mr. Lucas about the cost of a study of the drains and water impoundment areas as suggested in the PlanningBoard letter and he said such a study would cost around 500. to $1000 dollars. About 80% of the work is done in the office from reports available and 20% of the work is done in the field. Dr. Colburn: I feel this should be turned right back to the Planning Board. We could say we share their concern re- garding the possibility of flooding and etc. but any engineering study such as they have suggested should be done either by them or by the developer. Mr Heustis reported that an investigation of a complaint regarding rubbish in the rear of Buttrick's Sandwich Shop and the Stop & Shop was valid. Since the ware -house fire Stop & Shop has been using trailer parked in the rear of the store for storage of goods. The disposal of the cartons has created a problem, also the dumpster people were on strike. This matter has been corrected. The Bamboo Hut has had a few problems and an order was sent the proprietor stating that corrections must be made or he would be notified to come before the Board. Mr. Heustis BAMBOO HUT reported that the hot water was not right but that has since been corrected. The other violations they are working on. He went on to say that it was very hard to observe the house- keeping operation at this establishment because they did not open until around 11:30 A.M. and all the workers arrived at the same time. Quite often there was no cleaning done the night before and this made it very difficult to see what was wrong. 1 1
