BOARD OF HEALTH MEETING
MARCH 10, 1969
The regular meeting of the Board of Health was held Mon-
day, March 10, 1969, at 7:00 P,M, in the Board of Health Office.
Members present were: Dr. William Cosgrove, Chairman, Dr. Charles
Colburn, James W. Lambie and Robert C. Heustis, Director of
Public Health.
The minutes of the February 3, 1969 Meeting were approved
as read.
Mr. Heustis reported that since the order to repair an 500 LOWELL
over -flowing sewage system at the dwelling owned by Paul Rosa STREET
at 500 Lowell Street had been sent he had talked to Mr. Rosa
who claims that when Laconia Street was repaired by the Town
of Lexington his leaching field was damaged by the work.
Copies of letters written to the Town Engineer in 1967
by Mr. Rosa stating the damage done to the leach bed and that
he helt it was the Town's responsibility to repair the damage.
Copies of correspondence to and from the Board of Selectmen
to •Salvatore Ferraguto regarding the finished grades of the
Street which were 8 to 10 inches higher than his driveway,
therefore, when it rained or there was a run off the Street
his driveway acted as a catch basin. He also was complaining
about the overflow from Mr. Rosa's Septic system as the
effluent ran into his driveway and stayed there.
Mr. Heustis said he had talked to Mr. Gray, Ececutive
Secretary, about this problem and at the present time it is
expected that public sewer will be available early in the
Spring. However, the only solution at the present time is
for Mr. Rosa to have this system pumped and keep it pumped
out until public sewer is available. Mr. Heustis said he
would make a dye test as soon as the weather permits to be
positive the effluent is coming from the Rosa sewage system.
The Board agreed this nuisance must be abated even though
Mr. Rosa was negotiating with the Town for damages.

cation for a permit to keep 1 pony and 1 horse was denied DELFINO
at the last meeting because of insufficient land, submitted
a letter from Mr. & Mrs. Sam Borella, owners of property at
9 Ward Street, granting Mr. Delfinio permission to use their
property for the horses in order to meet the required acre
of land.

The Board asked Mr. Heustis what he thought of this.
He replied that on his inspection of Mr. Delfinio's place
he was not handling the manure properly but in checking
out the abuttors he had received no objections.
The Board instructed Mr. Heustis to check out this
property on Ward Street and see if it was continuous with
Mr. Delfinio's, if it was the permit could be granted.
Mr. Patrick Montouri and Mr. Tierney came before the
Board to appeal the Board's decision regarding Mr. Montouri's
application to keep 1 pony at 6 Paddock Lane.
Mr. Montouri's home is located in a cluster zoning sub-
division, therefore, the actual house lot is not the required
acre of land to keep a pony. In the rear of this sub-
division is land bought by the Conservation Committee for
the Town of Lexington and it was because of this open land
that Mr. Montouri has asked the Board to reconsider their
decision, also the pony is not in Lexington during the
summer months.
The Board discussed this problem with Mr. Montouri and
suggested he contact Nir. Gray, Executive Secretary, to see
if the Town would grant him permission to use the Town owned
land for exercising the pony and riding, etc.
Mr. Montouri thanked the Board and said he would talk
to Nor. Gray and let the Board know what the Town's decision
was.
The letter from the State Health Department stating
FLUORIDATION that the fluoride content of the Lexington water supply
was below the optimum level for sound dental health was
read by the Board.
As the Board has already agreed that they are in favor
of fluoridation of the water supply they felt that the next
step would be to send letters to Hanscom Air Base and Bed-
ford Veteran's Administration Hospital to inquire if they
objected to the fluoridation of the water as both these
facilities buy water from the Town of Lexington.
Mr. Heustis said Mr. Burke has already located the
four places in Lexington where the water supply enters
the Town from the MDC lines.
The Board also felt that the Selectmen should be
notified that the fluoridation in the water supply is be-
low the optimum level and request permission to proceed
according to Chapter 111, section 8c.

Dr. Colburn said he would also like letters sent to Dom.
Dunham, Director Northeast District Health Office and Dr.
Donaldson, President of the Northeast District Boards of
Health Association requesting their statements in favor of
fluoridation as made at the Meeting of the Northeast Boards
of Health Association.
Mr. Heustis asked about giving information to Mr. Adams
of the Minute Man Press. The Board agreed that at the pres-
ent time there was nothing to make a statement about.
The letter to Mrs. Muriel York, 197 Grant Street, re-
garding the violations of the Child Care Center Regulations
was discussed by the Board.
Dr. Cosgrove said he had calls regarding this from Mrs.
York's father, Mr. Campbell. Mr. Campbell has also contacted
Mr. Lincoln Cole because he felt that the violations as listed
in the letter were not right.
Yr. Heustis explained that when he made a routine inspec-
tion he found children playing in the kitchen. The regula-
tions say the kitchen should be closed off from the children
by a gate. Board of Appeals and also State Regulations re-
quire 2 adults for 10 children. Mr. Heustis said Mrs. York
was the only adult he saw and all the children were with her
in the kitchen as she was feeding a small baby. The State
Regulations require permission for children in Centers under
3 years of age, there is a form that must be filled out and
submitted to the State for approval. This Mrs. York resented
doing.
Mr. Heustis explained we were only the licensing agent
for the State Health Department, therefore, we had to note
these violations and ask for Mrs. York's cooperation in cor-
recting them. He also said he talked to Mr. Plunkett, North-
east Health Office, and they had planned to make an inspection
but this had to be cancelled because of the weather. Another
inspection is planned for the 18th and then we can go on from
there.

The Board agreed that nothing could be done until after
the joint inspection with the State Health Department.
Mr. Heustis explained that sirs. Debs, 1i.Hamblin Street,
had called this office and stated she suspected that some- POISONING
one was trying to poison her. She had been in touch with
the local police and the FBI and had been referred to the
health department.
Samples of food that tars. Debs had were tested by the
State and all were found to be negative. Mrs. Debs has
been informed of this.

The letter from Dr. Geoffrey Edsall, Superintendent of the
State Laboratory, regarding mumps vaccine was read and
placed on file.
The question regarding a mumps vaccine clinic was
presented to the Board. Mr. Heustis explained that the
State would supply vaccine for the 7, 8, and 9th grades
but if we were to do all school children we would have
to buy vaccine. He continued to explain that right now
there was talk that the vaccine would be released in the
Fall for all grades.
The Board suggested that we wait until the Fall be-
fore conducting a mumps vaccine clinic.
The application for a permit to keep a horse by
James B. Williams, Stratham Road was presented to the Board.
Mr. Heustis explained that IIr. Williams already had
a horse. This was reported by Dr. Smith when he went to
check on some land he woned in the area.
The Board asked if the abuttors had been checked and
Mr. Heustis said not yet. The Board agreed to take no
action until all abuttors were checked.
BUDGET The memos explaining that all Out of State Travel
Accounts had been taken out of the individual departments
and placed in one account was presented to the Board. A
department head that wants to go to a conference out of State
must now submit a request to Mr. Gray. The memo regarding
the purchasing of general office supplies by a central pur-
chasing agent was read and placed on file.
DENTAL The memo to the Selectmen regarding the Dental Clinic
CLINIC was approved. The clerk explained that Mr. Gray had called
and requested the facts of the discontinuation of the Dental
Clinic be prepared for Town Meeting information.
1970 Motion was made and duly passed that the secretary cast
