Mr. McQuillan explained to Mr. West he had been

in touch with Dr. Dunham's Office to see if we could
get someone to help out in the Department during
Mr. Finneran's absence.. Also he was going to talk
to Mr. Richard Albanese, Director of Public Health
of Billerica, to see what he could do for us.
Renewal permits for the following were signed

The report of calls made by Mr. Lucas of Whitman
& Howard on sewage problems for the month was checked
by the Board. Also action taken by Mrs. Jones on
miscellaneous complaints was checked and approved
by the Board.

BOARD OF- HEALTH MEETING
May 1, 1967
The regular meeting of the Board of Health -was
held Monday, May 5, 1967 at 7:00 P.M. in the Health
Department Office. Members present were R.L. McQuillan,
Chairman, Dr. William Cosgrove and Richard Albanese,
Acting Health Officer.
The minutes of the April 3, 1967 Meeting were
approved as read.
Dr. Howard Smith, newly appointed Veterinarian RABIES
for the Health Department, came before the Board
to discuss the use of a live vaccine for the Rabies
clinic. The use of this vaccine will enable people
to bring their dogs to Clinic once every two years.
Dr. Smith explained to the Board that this type of
vaccine has been proven very effective and will keep
the dog immunized up to 36 months. Dr. Smith said
it would be amatter of educating the public in this
procedure.

This year every dog will receive the"innoculation as
in the past. Next year a cross check of the dogs will
have to be made by the Clerk and only new dogs and dogs
who did not receive the rabies innoculation in 1967 will be
sent a card. It will also be announced in the Rabies
Clinic Advertisement, also a booklet is to be prepared to
be given to all dog owners at the Clinic and to all dog
owners if their animal is placed under quarantine for biting.
Dr. Smith said he felt this was a good way to educate the
public as to their responsibility as a dog owner.
The Board assured Dr. Smith that they would go along
with his suggestions.
Dr. Smith thanked the Board and retired.
Mr. and Mrs. Johnson, 69 Spring Street, came before 69 SPRING
the Board to discuss the problem of an over -flowing cess- STREET
pool.
Mr. Albanese explained that effluent from the
sanitary system flowed down into the neighbors yard caus-
ing a health problem and there was public sewer available.
Mr. Johnson said that 2 or 3 -years ago he received
an estimate from the Town of $60Q. (six -hundred dollars)
to dig to the street, a distance of about,35 feet, and then
another 200 dollars for a plumber to bring the inside
plumbing to the front of the house to connect to the public
sewer. He stated he could not afford to do this at this
time.
Mr. Albanese explained that now the Town does not do that
digging, a drain layer has to be hired and a list of those
could be obtained from the public works department.
Mr. McQuillan explained to the Johnsons that the Board
had a ruling which stated, if public sewer was available
the home owner must connect to the public sewer. This has
always been the policy of the Board and when anyone had a
problem such as the Johnsons had now there was no other
way to handle the situation.
Mr. Johnson said he.did not feel he could afford to do
this at this time. He stated he was in construction work
and had only gone back to work about 2 weeks ago.
Mr. McQuillan explained that the Board did not like
to cause a hardship for the homeowner but they also had
to go by the rules and the rule did state that a house
must be connected to public sewer when it was available
and therefore the Board had no alternative but to insist
that this be done.
Dr. Cosgrove inquired if the sewer was on Spring
Street when the Johnsont;6 bought the house. Mr. Johnson
said Yes. Dr.. Cosgrove pointed out' that the previous
owners should have had the house connected to the sewer
but that was something the Johnsons should have checked
before buying the house.
Mr. McQuillan pointed out that a complaint had
been received last year and then again this year so
that with those circumstances the situation could
not be let go.
Dr. Cosgrove asked how often they had to have
this system pumped.
Mrs. Johnson said at least once a year and usually
in the Spring.
Mr. Albanese said there was still effluent flowing
from the system, he checked this on his way into the
meeting, it was not as bad as when he first inspected
but it was still running onto the property next door.
Mr. Johnson had limed it down to keep the odor under
control.
Mr. McQuillan said he was sorry but he felt that
the Board could give the Johnsons only a month to see
if they could work something out. He suggested that
they get some idea of the cost of this work to be
dons and then possibly -see the bank where the mortgage
of their house is held,,but the house must be connected
to public sewer.
Mr. Albanese said he would like to suggest that
Mr. Johnson put about 6 inches of gravel over the
effluent that is running right away.
The Board told Mr. and Mrs. Johnson to see what
they could do and let the Board know. The Board thanked
them for coming in.
Mr. and Mrs. Johnson said they would do the best
they could and retired.

Mrs. Jones, Clerk, reported that she had contacted 303
the tenant at 303 Concord Avenue regarding the repair CONCORD
of a sanitary system ordered repaired in March and AVENUE
to date nothing has been done. Mrs. Silva, the tenant,
said she sent 2 estimates>to Mrs. Hyatt but had heard
nothing from her.
The Board discussed this problem and it was voted
that an order would be sent to Mrs. Hyatt demanding
that this system be repaired within 15 days or the
dwelling would be condemned and the tenant forced to
vacate.
The approval of the Department of Agriculture, DR. SMITH
Division of Livestock Disease Control, of Dr. Howard
A. Smith as veterinarian was placed on file.
The certification of Lot 28 Kendall Rd. -in the
subdivision entitled "Colonial Acres" was approved
by the Board.

The letter to Mr. Thomas McLoughlin, State Division WATER & AIR
of Sanitary Engineering regarding the contamination of POLLUTION
brooks in Town was approved by the Board. Mr. McQuillan
explained that he had contacted Mr. McLoughlin to help with
the problem of the brooks that are being contaminated by
raw sewage. Mr. Alan Adams had made some complaints and
a letter had been received from a Mr. Bramley regarding
the brook around the Arlington Land Fill and another brook
in back of Stratham Road.
Mr. Albanese said he had contacted Mr. Plunkett from
Mr. McLoughlin's Office and they were going to do a survey
on Thursday of next week (May 11) of all the brooks in
Lexington.
The letter to Mr. William Melbye, President of Senior
Citizens Club was approved. Mr. McQuillan explained that
with all the added work the Clerk had to do at this:time
the monthly notices for this Club was just too much, and
he felt therewere enough people in the group that could
do this work.
The subdivision entitled "Birch Hill Estates, Lexington, BIRCH
Mass." and dated March -16, 1967 was -approved by the Board HILL
per Whitman & Howard Report. This subdivision will be ESTATES
public sewered and all lots were approved fr drainage
except Lots 29 and 30 which would have to be filled to
street grade.
Mr. Jones reported that a letter had been received
from a Mrs. McCarthy, 454 Marrett Road, -complaining about
the owner at 458 Marrett Road filling in a brook causing
the water to back up and stand in the rear of the property
from Mrs. McCarthy's house down. This was referred to
Public Works Department because it was the understanding
that this complaint had been madelast year and the people
ordered to open this brook and the order was ignored. It
is the understanding that there is a Town easement clause
concerning this brook.
The complaint of sewage in the street -in front of YOUNG ST.
12 Young Street was brought before the Board. Mrs. Jones
reported that this same complaint was made in 1964.
Mr. Albanese said he would run some dye tests to see
just where this sewage is coming from.
Mr. McQuillan asked Mr. Albanese about the fill being ELKS
brought in for fill at the Elks Building on Waltham Street. BUILDING
Mr. Albanese said he had checked this out and it was salt
water peat and it did have a noxious odor. He had placed
a stop -order on the use of this fill until further notice
from this Office.

The Board discussed this type of fill with Mr. Albanese
and it was decided to contact the .contractor, Mr. DeMartio,
and talk to him because by law he should have a permit to
dump from the Board of Health.

A few questionable animal permits were brought
before the Board. These permits were to be renewed:
Renewal for 2 horses, an increase of 1 horse, 11 CHAD -
at 11 Chadbourne Road. A complaint had been receivedBOtRNE RD.
that these people had 4 horses there all winter and also
the boys when they were around the corral were harass-
ing the golfers at Powder Horn Golf Course. Mr.
Albanese was to check this out before the renewal
was sent.
Joseph Kelley, 83 Cary Avenue, requesting and 83 CARY
increase of from 3 to 6 horses. The Clerk reported AVENUE
that Mr. Kelley has 37 acres of land. The Board
approved this permit.
The application for a permit for 1 horse made 34 MIDDLE-
by Mr. Brown of 34 Middleby Road was brought to the BY ROAD
Boards attention. The Clerk reported that -for 3 years
this permit has been renewed and to date Mr. Brown
has never had a horse. The Board agreed that this
year the permit should not be renewed. If the time
ever came when Mr. Brown did get a"horse then the
Board could reconsider this permit.
The Clerk reported to the Board that she had 72 CARY AVE.
at least 3 calls regarding a horse at Mr. Charles SWEENEY, JR.
Sweeney, Jr., 72 Cary Avenue. The application for
a permit to keep a horserat this address had been
denied at the February 6, 1967 meeting because of.
insufficient area. Mr. Albanese was -to check this
out and an order sent to have this horse removed
from the premises.
An application for a permit to keep 2 ducks 62 VALLEY
by Mrs. McLatchy, 62 Valley Road was approved by ROAD
the Board.
The application for a permit to keep 1 pony at 14 WALNUT
14 Walnut Street by David Dionne was presented to STREET
the Board. Mr. Dionne sent a letter explaining that
he does not have the required area but could house
the pony on his property and use the corral facilities
at 11 Chadbourne Road.
The Board discussed this and agreed that the
housing of the animal was what our regulation dealt
with and therefore there could be no exceptions made.
Permit was denied.
Mr. McQuillan reported that he had suggested to
the Selectmen that a committee be formed to study
this Air Pollution problem consisting of the Police,
Firemen, Selectmen, Board of Health and a citizen of
the Town. The Board approved this suggestion.
