BOARD OF HEALTH MEETING ocr
MARCH 6, 1967
The regular meeting of the Board of Health was
held Monday, March 6, 1967 at 7:00 P.M. in the Board of
Health Office. Members present were: Dr. William
Cosgrove, Acting Chairman., Mr. James West and Mrs. Jones,
Clerk, Board of Health.
Minutes of the February 6, 1967 meeting were
approved as read.

The Clerk reported that since their last meeting AIR
three residents had requested to attend the Board POLLUTION
Meeting to discuss the Article on joining the Metropolitan
District on Air Pollution.
Mrs. Greene requested in Article 92 that the
Town of Lexington make application for admission to
the Metropolitan Air Pollution Control District under
the provisions of Section 142B of Chapter 111 of the
General Laws of the Co,anonwealth of Massachusetts.
Dr. Cosgrove explained that at the February Meeting
the Board had discussed the problem of Air Pollution,
and what could be done by the Board to help the situation.
He said from the previous discussions by the Board
with Mr. Finneran, and also from the information material
we had he wondered if we really needed this service.
Mr. West pointed out that leaf burning and refuse
burning were the major problems in Lexington and the
Fire Department was the authority for issuing the per-
mits for these open fires.
Mrs. Greene presented charts of the percentage
of Air Pollution and the causes. She also stated that
Lexington was one of the few Towns bordering Route 128
that did not belong to the District. Mrs. Greene
pointed out that we wo{jld be buying a service and
therefore have a voice in complaining about inversion
from the surrounding Towns. She explained the service
charges were based on 50% population and 50% assessment
of the Town. This would mean about $1000. to the
Town of Lexington.
Dr. Cosgrove and Mr. West both agreed with Mrs.
Greene that last fall the Air Pollution was bad but
as long as the Fire Department issued permits we could
do nothing. The atmospheric conditions of last, Fall
was unusual and was a problem all along the eastern
sea board.
Dr. Cosgrove pointed out to Mrs. Greene that the
Board of Health intended to draw -up and legally adopt
regulations that would cover the problem of -open burning
and other air pollution as soon as possible.
The gentlemen present asked Mrs. Greene if she
had talked to the Board of Selectmen about this article.
She replied, she had not.

Dr. Cosgrove said he could not see where we could
get any amount of service from the District as the rules
and regulations were now. He cited regulation 3, Section
lb on open burning. This regulation states that the depart-
ment would have no control over the reduction of leaves or
domestic burning.
Mrs. Greene saidthat new rules were being drawn up
and that some of these rules were obsolete-.
After further discussion Dr. Cosgrove and Mr. West
thanked Mrs. Greene, Mr. Clarke and Mr. Weiss for coming
in to discuss this matter and assured them that the local
Board of Health would take action on regulations for air
pollution as soon as possible.
The clerk reported that Mr. John Brucchi had contacted 303
the Health Office regarding a malfunctioning sanitary'system CONCORD
at 303 Concord Avenue. Mr. Finneran had talked to Mr. AVENUE
Brucchi over thephone approving the correction he proposed.
Mr. Brucchi later called the Health Office and reported he
had called the owner of the dwelling, a Mrs. Hyatt in
Maryland, because the repairs would run around $500. Mrs.
Hyatt refused to have the eyvtem repaired, Mr.:Brucchi=
reported he had left an open hole outside the foundation
so that the tenants could use the facilities in the house.
Mr. Lucas of Whitman & Howard was called and he inspected
the conditions at 303 Concord Avenue, March lst, and reported
that the sewer pipe had been broken outside the foundation
and sewage was emptying into an open hole. He also stated
he contacted Mr. Brucchi who reported the pipe to the
cesspool was completely plugged and this pipe of part iron
and part clay was laid on a curve to about 30 to 50 feet
in distance to the cesspool. The clay tile pipes were
also laid with open joints with just pieces of tin over
the joints. Mr. Lucas stated this was a"critical situation
and should be corrected immediately.
A -latter to Mr.. -Hyatt stating the situation and the
violation to Health Regulation, Article V, Section 1,
and requesting immediate correction to this sanitary system
was approved by the Board and signed by Dr. Cosgrove,
Acting Chairman.
The letter from Fronk Sandy, 353 Emerson Road, regard- STOP &
ing a complaint of a clerk at Stop & Shop Supermarket SHOP
loading the freezer with packages of vegetables that were
already thawed out was discussed by the Board.
Dr. Cosgrove instructed the clerk to contact the Food
& Drug Division to see what the danger could be in this
situation and to notify the Stop & Shop regarding the hand-
ling of thefrozen foods.
The letter from Mrs. Nancy Boren, Dental Hygienist,
regarding employment in the Dental Clinic was turned over
to Dr. Cosgrove for his files.
By unanimous vote Mr. R.L. McQuillan was re -appointed
