The regular meeting of the Board of Health was held Mon-
day February 8, 1965 at 7:00 P.M. in the Health Department
Office. Members present were: Dr. William Cosgrove, Acting
Chairman, Mr. James M. West, and Mr. James F. Finneran,
Director of Public Health.
The minutes of the December 21, 1964 meeting were approved
as read.
MENTAL HEALTH Mr. West asked about the Mental Health Association Budget
BUDGET request, if anything more had been heard from the Appropriation
Committee or the Board of Selectmen, or if we had to submit an
article for the Town Warrent.

Mr. Finneran explained that after Mr. White, Town Accountant
and Secretary to the Appropriation Committee, had told the
Clerk that the Mental Health Expense request had to be placed
on the Town Warrent as an article he had checked with Mr. Gray,
Executive Secretary, to the Board of Selectmen. Mr. Gray said
he would check with the Selectmen and Mr. White. Since our
last meeting in December Mr. Gray told Mr. Finneran that either
the Board of Selectmen or the Appropriation Committee would
take care of the Article for the Town Warrent, but we have
never been notified in writing from either office of this
action.
Mr. West asked if this matter could be checked into again
just to make sure that htis request was not omitted from the
Town Warrent.
Mr. Finneran said he would check this matter out and make
sure that it was taken care of.
B.L. CUMMINGS The Board asked if there was anything new on the B.L. Cumm-

Mr. Finneran explained that the case against the State Health
Department was still pending in Superior Court and therefore our
case was still pending in Concord Court. The restraining order
was still in effect, also.
Mr. West said that he was very worried about this case with
the restraining orders on us and the Court Cases pending we had
no way of protecting the Townspeople or of insuring them that
they were getting clean milk and he wanted it to go on record
that the Board of Health was very much against Mr. Cummings
delivering milk in Lexington and that the Board feels the re-
straining orders are unreasonable in that with these restrictions
we are unable to protect the Town and carry out the duties of
the Health Department.
Mr. West said he felt we should let the State Health Depart-
ment know how we felt about the restraining orders which have
stripped the Board of their power to enforce the Health Laws. He
also asked Mr. Finneran if there was any way we could obtain
reports of the milk analysis done on Cummings milk recently, either
from the State or from Mr. Cummings' laboratory man.
Mr. Finneran said while we have that restraining order against
us we can do nothing, but he would check to see if the State had
taken any recent tests.
The letter to Bates Farm, Carlisle, Mass., regarding the
high bacterial counts on the milk products analysis of Decem-
ber 4, 1964 was approved by the Board.

BATES FARM
The Board asked if any reply had been received to this
letter. Mr. Finneran said "No" but that Bates Farm had always
had a good operation and this was the first high counts they had.
He was sure that the matter was taken care of as soon as it was
called to their attention because it was unusual for this Dpiry.
The memo to John Carroll, Superintendent of Public Works HARTWELL AVE
regarding the water samples in the Hartwell Avenue Dump Site DUMP SITE
area was noted by the Board. All samples tested satisfactory.
Mr. Finneran explained that periodic samples of the water
surrounding the Dump Site were being taken in case of a complaint
of water pollution was made by someone down stream the water
test records would be on file.
The notice from the State Health Department stating that VACINATION
the Vaccination Assistance Program will be in the northeast ASSISTANCE
area in 1965 was read by the Board. A meeting is being planned PROGRAM
with this committee for the near future to see what they can
offier. We now have a planned program for Polio and Diptheria
Tetanus Immunization and we keep records of all our clinics.
The only thing is that our clinics are keyed for the School
Children and not for the Adults, too.

ESTABROOK The Certificate of Action from the Planning Board on the
GARDENS definitive plan entitled "Estabrook Gardens, Section One,"
Lexington, Mass. and dated September 5, 1965 was placed on
file by the Board.
CONSERVATION The letter from the conservation committee regarding
COMMISSION their option to purchase Swenson Farm was placed on file by
the Board.
DIABETIC
SOCIETY
The letter from the Diabetic Society asking our cooper-
ation in notifying the people of the community of the free
tests available for the detection of Diabetes.
CLINIC Mr. Finneran reported that the annual Polio and Diptheria
DATES Tetanus Clinic dates had been set: the first doee of Polio=
Trivalent Vaccine would be offered March 11 and 13th, the
second dose was scheduled for May 6 and 8th, the Diptheria
Tetanus Clinic would be held April 15th. Notice of these
clinic dates had been sent to the PTA for publication in
their bulletin that they send to all residents of Lexington.
SALARY The notices from the Board of Selectmen regarding the
POLICY Salary policy was read by the Board. A sixth step of 5% of
the fifth step has been added plus a longevity raise of 3% to
be paid in the 9th, 12th, 15th, 18th and 21st year of ser-
vice. Mr. Finneran reported that this would not effect our
budget this year as we were still on step raises.
TB SCREENING Mr. Finneran reported to the Board that a representative
from the Tuberculosis Society had been in to see if we would
participate in a Tuberculosis Screening Program to be conducted
in all the schools, using the Tine Tuberculin Testing proce-
dure. A meeting was to be held Tuesday, February 8th, with
this representative, Miss Morrison of the L.V.N.A. and Mrs.
Alice Mogan of the School Nurses, he would then have more in-
formation on this program after this meeting.
The following Animal Permits were presented to the Board:
ANIMAL The owner of Wilson Farm was requesting permission to
PERMITS keep 2 pigs in addition to 750 poultry. The Board voted to
deny the permit to keep 2 pigs at Wilson Farm in accordance
with the policy established by the Board; that with the
abolishing of the existing piggeries no new swine permits
will be issued. The request for the 750 poultry was approved.
The permit of Anne Butler, 22 Rangeway Road, to keep 3
goats was approved by the Board. The Director of Public Health
reported there were no objections from the abuttors and the
space for housing the goats were adequate.

The permit of Philip Tropeano, 20 Revere Street, to keep
3 horses was approved by the Board. Mr. Finneran reported that
there were no objections from the abuttors and that the area
was sufficient for stable and corral.
The letter to the Board of Selectmen listing the proposed PROPOSED
public sewer extensions in order of priority_based on the existing PUBLIC
private sewage disposal systems was approved by the Board. SEWER
Dr. Cosgrove asked if this list was followed by the Selectmen
when the public sewer work was decided upon.
Mr. Finneran explained that the list was not and could not
be followed to the letter for a number of reasons. In some in-
stances the location or economic factor could be a deciding point,
but when it was at all possible the troubled areas were taken
care of.

The Health officer's Report was checked and the Board requested
letters be sent to Brox's Daries, Concord Dairy and Cumberland Farm
calling to their attention the high bacterial counts on the milk
analysis of January 14, 1965. It was also requested that a letter
be sent to Miss Wright of the School Lunch Program regarding the
swab analysis report of January 22, 1965.
