BOARD OF HEALTH MEETING
DECEMBER 16, 1960
The regular meeting of the Board of Health was held Friday,
December 16, 1960 at 3:00 P.M. in the Selectmen's Room of the
Town Office Building. Members present were Mr. R.L. McQuillan,
Chairman, Dr. William Cosgrove, Mr. Charles H. Cole, and Health
Officer, Mark D. Lurvey.
The minutes of the November meeting were approved. The
minutes of the Special Meeting held November 28, 1960 at the
Battle Green Inn was approved.
94 ESTABROOK Mr. Clark, builder from Arlington, Mass., came before the
ROAD Board to discuss the sewage disposal system to be installed on
a small lot at 94 Estabrook Road. Mr. Lurvey explained to the
Board that this was a very small lot and he had seen a sewer
cover at what he thought was about approximately 140 feet away
and therefore thought this house would be connected to
the Public Sewer.
Mr. Clark said that in checking with the Engineering De-
partment of the Town of Lexington they could find no record
of this sewer and further investigation showed the sewer to
be 250 feet away. This sewer was put in by a private builder
and in order for Mr. Clark to connect this lot to this public
sewer he would have to acquire easements from the abuttors
.involved before he could dig down the street to connect this
lot to the existing sewer line as this street is a private way.
Mr. Lurvey said a perculation test must be made and the
holes dug with a machine. This lot is small and would not
take a leaching field but a septic tank and a 6 x 6 over -flow
cesspool could be installed satisfactorily.
The Board agreed that if the public sewer was too far
away to make a connection into it possible and if Mr Lurvey
and Mr. John Carroll, Superintendent of Public Works, agreed
that a septic tank and a 6 x 6 over -flow cesspool would work
out satisfactorily and if Mr. Clark would run a line to the
front of the house for public sewer installation at a later
date, they would have no objection to Mr. Clark installing
a septic tank and over -flow cesspool. Mr. Clark will get
in touch with Mr. Lurvey on Monday and make arrangements for
Mr. Lurvey to meet with him and discuss this matter further.
POTTER'S The letter to James E. Shaw, attorney for William G.
PIGGERY Potter, of Walnut Farm Trust, stating that the existing piles
of manure at the Walnut earm Trust Piggery seemed to have
been leveled off and covered as required by Mr. Lurvey, Health
Officer, was approved by the Board. Mr. McQuillan also re-
ported that Mr. Philip Cronin attorney for the Minute Man
Highland Associatihn has assured Mr. Harold Stevens that he will
not bring court action against Potter's Piggery until after
the 30th of April 1961 at which time the operation of the
Piggery at 32 Walnut Street, Lexington, Mass., should cease.

The sub -division entitled "Vine Brook Meadows, Section 2, "VINE BROOK
was approved by the Board with the stipulation that all lots MEADOWS,
be graded so that the water from all sections will drain to SECTION 2"
the street or some other satisfactory water course. Mr. Lurvey
reported that this sub -division will be on public sewer. Mr.
Lurvey was instructed by the Board to write to the Planning
Board approving this sub -division withi:the stipulation set forth
in the Whitman & Howard, Inc. report.
The Sub -division entitled "Green Valley, Section 6" was "GREEN VALLEY
approved by the Board as the engineer's report states that all Section 6"
lots involved are on high ground and also Mr. Lurvey reported
that this sub -division will be on public sewer. Mr. Lurvey
was instructed to write to the Planning Board approving this
sub -division.
The order to Mr. Robert Millar, 38 Fletcher Avenue, Lex- MILLAR
ington, stating that because of complaints of over -flowing 38 FLETCHER
sewage on his property he must connect to the public sewer AVENUE
was approved by the Board. Mr. Lurvey reported that Mr. Millar
had been in to see him and Mr. Millar explained that as a
retail store manager this is his busy time but he would like
to talk to Mr. Lurvey and Mr. John Carroll, Superintendent
of Public Works, after Christmas. Mr. Millar feels that at
this time he cannot afford to connect to the public sewer.
Mr. Lurvey explained to Mr. Millar that to have this system
pumped out would be a waste of money. The Board after a dis-
cussion of this situation instructed Mr. Lurvey to write to
Mr. Millar and inform him that Mr. Lurvey and Mr. Carroll will
meet with him and discuss this situation after Christmas, but
that this dwelling must be connected to public sewer as soon
as possible.
The letter to Miss Ethel L. Wright, School Lunch Program, SCHOOL
was approved by the Board. In this letter Mr. Lurvey pointed CAFETERIAS
out that a hood for the stove at Adams School should be pro-
vided as soon as possible. Mr. Lurvey also stated that for a
few minor corrections he found all School Cafeterias in excell-
ent condition.
The case of the Premature Infant of Mr. & Mrs. George E. PREMATURE
Sullivan was discussed by the Board. Mr. Lurvey explained INFANT SULLI-
that the Blue Cross will pay $12.00 per diem for 40 days and VAN
that we will have to pay a balance of $5.00 per day as the
rate at Winchester Hospital is $17.00 per day for a premature
infant. The bill at the Winchester Hospital for 28 days for
this premature infant will be $140.00. The Board voted to pay
this bill.
The letter to George DeVries, Arlington, Mass., stating
that the odors in the brook running in the rear of 28 & 34
Summer Street, Lexington have been traced to the Arlington
Sanitary Land Fill Operation and also that prior to the Town
of Arlington dumping in this area there had not been, to our
knowledge, any complaints of odors coming from the brook,
was approved by the Board.

COMMUNIC- The letter to Mr. Donald T. Clark, Chairman of the School
ABLE DISEA-Committee, stating that the Board of Health appreciates the
ES cooperation of the school authorities to acquaint the parents
of all school children with the rules and regulations for the
isolation and quarantine requirements of Communicable Diseases
was approved by the Board.
The letter to John H. Blaisdell, Chairman of the Appropria-
tion Committee was approved by the Board. This letter was an
explanation of the work done by the Posture Clinic in answer to
Mr. Blaisdellts question at the recent meeting of the Appropria-
tion Committee with the Board. Mr. McQuillan also stated in this
letter that the Board of Health did not feel that this clinic
should be abandoned under any circumstances.
The letter to the Federal Housing Administration, 14 Court
Square, Boston, Mass., stating that the sewage facitlities at
15 Pineknoll Road had been inspected and installed according to
the Lexington Board of Health Rules and Regulations was approved
by the Board.
The letter to John Carroll, Superintendent of Public Works,
listing the streets in the order of their urgency for the public
sewage installation in 1961 was approved by the Board.
The letter from Arthur E. Burrell, Director of Civil Defense
was read by the Board. The Board discussed the need of an emer-
gency room for medical purposes in time of disaster. Mr. Cole
suggested a room in the Maria Hastings School. This room or space
is off the boiler room and enclosed on all sides with foundation
or solid wall. Mr. Lurvey was instructed to check with Mr. Bair,
Superintendent of Schools and see if the school department would
give their approval for the medical -division of Civil Defense to
make this space or room usable for a medical emergency room. If
Mr. Bair gives his approval for this project then Mr. Lurvey
should get in touch with Mr. Burrell and Mr. Spiris and go over
this space or room to see if with some work being done it could
be used for a medical room in time of disaster.

TUBERCULO- The letter from the Commonwealth of Massachusetts, Division
SIS PROGRAMof Tuberculosis was read by the Board. Mr. Lurvey explainedthat
this was a reorganization plan for the Tuberculosis Program.
The letter to Dr. Harry T. Phillips, Newton Board of Health
stating that Mr. Lurvey had read the report on the Control of
Milk Standards in Massachusetts and that Mr. Lurvey considered
the suggestions expressed in the report an excellent means of
bringing about the eventuall satisfactory control of the milk
sapply was approved by the Board.
The Board voted to pay the hospital bill for Premature
Infant Gibbons at the Waltham Hospital for $324.00.
Mr. Lurvey reported that he had stopped the B.L. Cummings
driver for delivering milk in the Town of Lexington without a
permit. Mr. Lurvey is scheduled to.go to court on this case
on Wednesday, December 21, 1960. Mr. Cummings has also appealed
to the State Health Department.
