HomeMy WebLinkAbout1960-11-18449 BOARD OF HEALTH MEETING NOVEMBER 18, 1960 The regular meeting of the Board of Health was held Friday, November 18, 1960, at 3:00 P.M. in the Selectmen's Room of the Town Office Building. Members present were Mr. R.L. McQuillan, Chairman, Dr. William Cosgrove, Mr. Charles Cole and Health Off- icer, Mr. Lurvey. The minutes of the October 21, 1960 meeting were approved and also the minutes of the Special meeting held October 24, 1960 were approved by the Board. The letter to Silva Brothers, North Great Road, Lincoln SILVA Mass. stating that this was the second and final notice regard- BROTHERS ing the removal and transporting of garbage in the Town of Lex- ington without a permit was read and approved by the Board. Mr. Lurvey reported that Silva Brothers had filed application for a garbage permit on November 17, 1960. The Board voted to approve this permit and the license was signed by the Board. The letter to Mrs. Lilly Jackson, 2990 Massachusetts Avenue 2990 Lexington, stating that on November 4, 1960 an investigation was MASS. AVB' made of rubbish being dumped on her property at 2990 Massachusetts Avenue. On November 9, 1960 a re -inspection revealed the con- dition had not been corrected and Mr. Lurvey requested Mrs. Jack- son's cooperation to abate this nuisance was read and approved by the Board. Mr. Lurvey reported that on November 14, 1960 a re -inspection was made of this property at 2990 Massachusetts Avenue and the rubbish was all cleaned up. Two letters from Harold Stevens, Town Council, the first one POTTER'S'. dated November 7, 1960 stating that after our letter of October PIGGERY 25, 1960 to Mr. William G. Potter, stating that all existing man- ure piles must be leveled off to a height of not more than two feet and covered with one foot of earth, he contacted Mr. Shaw, attorney for Mr. Potter, who assured him that the requests of the Board of Health would be complied with and also that the two app- eals which had been filed in the courts by Walnut Farm Trust had been withdrawn was read by the Board. The second letter dated November 8, 1960 from Mr. Stevens stated that he had a copy of a letter from Philip M. Cronin, attorney for Minute Man Highlands Association, to James E. Shaw stating that he had entered a bill of complaint in Middlesex Superior Court against the Potters and the Trust seeking to enjoin the operation of the Piggery. Mr. Stevens stated in this letter that he has talked to Mr. Cronin, who is willing to have his bill in equity merely stand in court without further action and see whether or not Potters use all reasonable effort toward the cessation of the piggery operation on May 1, 1961. The Board placed these letters on file. Mr. Lurvey showed the Board the pictures of the manure piles that he had taken by the Zitso Studio in Arlington. Mr. Lurvey 450 also reported he had stopped by the Potter's Piggery and they had a bid bulldozer evening off the existing manure piles and covering it with dirt. Mr. Lurvey felt they were doing a good job. LOT "B" The letter to Mrs. George Morey, Chairman of the Board BURLINGTON of Selectmen, stating that the owner of Lot "B", Burlington STREET Street had placed several loads of heavy fill on this lot and this should eliminate the condition of sand blowing from this lot was approved by the Board.. MARK MOORE The letter to Mark Moore, Todd Realty „Inc. stating that the engineer bill from Whitman & howard for engineering ser- vices on his property was enclosed was approve. Payment of this bill was received by the Health Department on November 9, 1960 and the check was turned onto the Town Treasurer. WYNWOOD The letter to Wynwood-Associates stating that the eng- ASSOCIATES ineer bill for engineering services on their project in Lex- ington was enclosed was approved by the Board. Payment for this bill was received November 16, 1960 and the check turned into the Town Treasurer. 46 WEBSTER Letter to Lawrence Experimental Station requesting a ROAD test for a sample of water taken from 46 Webster Road was approved by the Board. 46/ 1 LEXINGTON Letter to Mr. Donald Nickerson, Chairman Board•of Appeals, CLEANERS stating that in the: six years Mr. Lurvey has been Executive & DYERS Health Officer he has never received any complaints of odors or unsanitary conditions on the premises of the Lexington Clean- ers and Dyers was approved by the Board. Mr. McQuillan explained Mr. Carroll,.owner of this establishment, called him and explained he needed such a letter..for his hearing with the Board of Appeals. TRAVERS The letter to Mr. Thomas D. Travers, 136 Grant Street, stat - 136 GRANT ing that complaints had been received by the Health Department STREET regarding over -flowing Sewage on his property and as Public Sewer was now available the Board of Health had no alternative but to order him to connect to the Public Sewer within 2 weeks was approved by the Board. SEARS The letter to John J. Sears, 153 Lincoln Street, stating 153 LINCOLN that the Board of Health did not issue licenses for the pre- ' STRTET raring of food in the home for commercial purposes and there- fore this operation would be entirely under the Board of Appeals at the present time, however, if this permit is granted the operation would then come under the Board of Health was approved by the Board. CHILD CARE Two Child Care Center licenses were signed by the Board CENTERS one for Mrs. John Cogan, 29 Patterson Road, whose application was approved by the Board at the October meeting. The other licenser signed was for Mrs. Marjorie C. Williams, 9 Balfour Street. Mr. Lurvey reported he had inspected Mrs. Williams Child Care Center and found it very satisfactory, he also 1 • 1 1 1 451 contacted the abuttors and received no objections. The Boa^d arproved this Child Care Center. Mr. Lurvey reported that Mr. George DeVgies had taken care 11 WINCH - of the pile of brush, which was a rat harborage, in the rear of ESTER DR. 11 Winchester Drive, and also the broken glass from the old house in the Sun Valley Section. Mr. Lurvey reported that he had called Mr. Nickerson of the LOWELL & State Health Department regarding the Lowell and Summer Street SUMMER ST Brook and Mr. Nickerson spoke as though he wanted to let the pro- BROOK blem rest for the winter. Mr. Lurvey said as we continue to receive complaints about the odors from.this.brook, and as no improvement had been made, he felt very much concerned. The source of these odors definitely originate at the Arlington San- itary Land Fill Project on Summer Street. The Board decided to ask Mr. Nickerson to a.luncheon meeting on Tuesday, November 29, 1960 at the battle Green Inn to discuss this problem further. Mr. Lurvey was instructed to contact Mr. Nickerson for this date and then let the Board membera.know the time and date. Mr. Lurvey reported that as Milk Inspector he had revoked B.L. CUMMIN1 the license of B.L. Cummings to deliver milk in Lexington be- GS MILK cause,of the consistently high bacterialogical counts. Mr. Lur- vey showed the Board the recent counts on B.L. Cummings milk, also the reports from the Watertown Health Department and the field counts which are done by a private laboratory for Mr. Cummings. Mr. Lurvey says that when Mr. Cummings has cleaned up his dairy and brought the bacteria counts down then he will have to have a hearing with the State Health Department and Mr. Lurvey before his license will be re -instated. As it now stands if Mr. Cumm- ings is delivering milk in'L'exington he is doing so without a license and can be stopped either by Mr. Lurvey or the local police. The application to keep a'horse by Lawrence Bode, 555 ANIMAL Marrett Road, was approved by the board.. Mr. Lurvey reported APPLICATION that all the abuttors had been contacted and he•had received no objections. Mr. Lurvey reported that upon inspection of the Carriage CARRIAGE House Restaurant he had found a number of violations to the HOUSE Lexington Health Department Rules and Regulations. The score •RESTAURANT for this inspection had dropped to 81-B from a 91-A in June. Mr. Lurvey showed the Board the letter which will be sent to the Carriage House Restaurant listing the violations and also stating that a re -inspection will be made within one week and if no.improvement has been made in this establishment then court action will be taken. Mr. Lurvey also reported to Mr. Donald Irwin, Building In- spector, about the use of the upstairs room at the Carriage House because it has only one entrance it is a fire hazard. Mr. Irwin told Mr. Lurvey he had already written a letter telling the own- ers of.the Carriage House Restaurant that they could not use this upstairs room as it now stands because it is a fire hazard. 452 PUBLIC - Mr Lurvey and thee-Board•studied the listofpetitions for SEWER public sewer now on file with the Public Works Department. The Board suggested Mr. Lurvey write a letter to the Public Works Department and list the areas which, in his mind, are in the greatest need of public sewer. Mr. Lurvey said he would like to see sewage in the Longfellow and Hawthorne Road area and also the Grove Street area beyond Route 128 at the end of Eldred Street. The budgets for 1961 were discussed by the Board of Health and the following budgets will be presented to the appropriation committee when the Board meets with them on Monday, December 5, 1960 at 8:30 P.M.
