July 28, 1960
regular meeting of the Board of health was held Thursday
July 28, 1960 at 7:30 P.M. in the Health Department
Members present were Dr. William Cosgrove, Mr. Charles
Health Officer, Mark D. Lurvey.
Mr. & Mrs. Carl Burri, 14 Holland Street came before the
Board to discuss the Health Department regulations for cone
.ducting a Child Care C"nter at 14 Holland Street, Lexington.
Mr. Lurvey reported he had inspected the premises of Mr. &
Mrs. Burrits and he has asked that the following things be
done before a Child Care Center can be conducted there:
Better lighting
Better heating
New Floor Covering
Rooms must be finished
Outside Play Area made safe.
Mr. Burri assured the Board all these things would be taken
care of. The main problem being that Mrs. Burri, who will con-
duct the Child Care Center has had no formal training in teaching
pre-school children. Mr. Burri, who is a teacher in the Lexington
Public Schools, plans to set up the program for the Child Care
Center. Our Health Department Regulations state that the person
in charge of a Child Care Center shall have had training or
experience in the care and education of children of pre-school
age. Mr. Lurvey suggested Mrs. Burri might take a course in
pre-school education or an assistant might be hired who would
have this training. Dr. Cosgrove suggested that Mr. & Mrs.
Burri work in close contact with Mr. Lurvey. The Board assured
Mr. & Mrs. Burri that the Health Department would cooperate in
any way they could but that until the specified requirements
are met we can not issue a license to conduct a Child 4are Cen-
ter at 14 Holland Street.
Minutes of the June 17, 1960 meeting were approved as read
and also the minutes of the Special Meeting held June 29, 1960
were approved as read.
Mr. Lurvey reported that on June 1, 1960 a letter was sent
to Mr. Thomas A. Bartley calling to his attention that the sewage
disposal system at 27 Hill Street was creating obnoxious odors
and requesting that Mr. Bartley contact the Public Works Depart-
ment regarding connecting this dwelling to Public Sewer.
The Public Works Department sent an estimate to Mr. Bartley,
to connect this dwelling to the Public Sewer on June 9, 1960.
This estimate was for $150.00
On July 26, 1960 this nuisance of over -flowing sewage had
not been corrected and the Board voted to send an order to Mr.
Thomas A. Bartley, 27 Hill Street stating that this nuisance must
be corrected within two weeks. The Board also gave Mr. Lurvey
permission to take further action if this order is not complied
with.

The letter to Mr. Mike Zirpolo, Battle Green Inn Restaurant, BATTLE,
was read and approved by the Board. Mr. Lurvey reported that the GREEN IN
grade of 77 and the score of "C" was very low and he would like RESTAURANT
the Board's permission to take further action against the Battle
Green Inn Restaurant and also the Lexington Inn Restaurant unless
these establishments show rapid improvement in the sanitary con-
dition and also they must maintain this 'cleanliness longer than
they have in the past. The Board granted Mr. Lurvey permission
to proceed as he saw fit in order to bring and keep these est-
ablishments up to the health Department standard.
The letter to the Maternal & Child Health Service stating PREMATURE I
the additional information on the three premature infants born
to Stanley R. & Mary Petrick was approved by the Board. Mr.
Lurvey explained this premature infant case was investigated
by Mr. Collins, Welfare Department, and found to be not a Lex-
ington Settlement. This additional information was sent in
order to complete the original record which we made during the
investigation.
The three letters from Whitman & Howard, Inc. engineers
were approved.
The first letter was in regard to Country Club Manor, Sec- COUNTRY -9
tion I, Lexington, Mass. The Board of Health approved this CLUB MANOH
sub -division with the understanding that all stipulations set SECTION'I
forth in the Whitman & Howard letter be complied with. The
Board instructed Mr. Lurvey to see that a copy of this report
was sent to the Planning Board along with the letter of approval
for this sub -division.
-The second letter concerned the "Lowell Estates sub -division LOWELL
plan stating that Whitman & Howard, Inc. had again reviewed the ESTATES
plans entitled "Lowell Estates" and that the low area along "B"
and "C" Streets still remained unchanged. The one exception is
Lot 103 upon which some grading had been done. Mr..Lurvey re-
ported he had sent a copy of this report to the Building Department
and Mr. George DeVries.
The third report was on a Lot at Oakmont Circle and Merriam OAKMONT
Street in regards to a septic system. This lot was approved for CR. & MER -
building. RIAM STREE!
The two letters to Mrs. Ruth Morey, Chairman Board of Sel- SEWAGE &
ectmen were approved by the Board. Mrs. Morey had requested DRAINAGE
that the Health Department list in order of importance the streets
that were having trouble with the sewage and drainage systems.
The second letter was written in reply to a request by Mrs.
Morey for a list .of individual homes that were having serious
sewage trouble.
The letter from Donald K. Irwin, Building Inspector, stating CENTRAL I
his findings at the inspection of the Central Block was read and BLOCK
placed on file. The Board asked Mr. Lurvey to ask Mr. John Bryne
Plumbing inspector, and Captain Feddette of the Fire Department to
submit to this department a report on their findings at the Central
Block. The Board also suggested that Mr. Robert Jeremiah, Wire
Inspector be contacted and asked to make an inspection of this

building and submit a report to the Health Department.
The letter to Lawrence J. McCarthy, 7 Wyman Road, stating
that a complaint had been received regarding open sewage at the
above address was approved. Mr. Lurvey reported this condi-
tion
ondition has been corrected.
The letter to Mr. Leeland McConchie, 74 Hill Street, regard-
ing flies and manure around the coraal where his horse was kept
was approved. Mr. Lurvey reported that Mrs. McConchie called
and said they had cleaned the corral and the horse was going to
be put on a tract of land they own in Burlington for the re-
mainder of the summer.

The letter from Frederick A. Dunham, District Health Officer,
stating that the District Health Office will be glad to assist in
promoting an organization of the Boards of Health in this District
was read and placed on file.
The letter to Mrs. Caleb Warner, 546 Concord Avenue, stating
that if she wishes any further information on her previous letter
to the Health Department (which stated that parents should be
notified when communicable diseases are reported in the sbhools)
she should contact the School Health Service.
The letter to Patrick F. McHugh, 42 Rindge Avenue, regarding
a complaint of trash stored in a trailer in front of 42 Rindge Ave-
nue was approved by the Board. Mr. Lurvey reported that Mr. McHugh
is renovating his home and he puts the old plaster and boards in
this trailer to take to the dump. The Board suggested Mr. McHugh
keep a cover over this trailer and it would be all right.
The letter to Mrs. Phyllis Coe, 80 Hill Street, regarding
over -flowing sewage was read and approved by the Board. Mr.
Lurvey reported that as of today, Huly 28, 1960, nothing had been
done regarding this problem. The Board voted that Mr. Lurvey should
send an order if this condition is not corrected,
The letters to Ralph J. White, 81 Woburn Street, and Mr.
Leonard Collins, 1315 Bridge Street, Dracut, calling to their
attention the fact that all trucks that collect rubbish in
Lexington must be licensed by the Board of Health was approved.'.
The licenses for these trucks were approved pending the inspection,
of the trucks.
The letter to Emidio Paone, 15 Emerald Street, stating that
a complaint had been received regarding the burning of rubbish
on Sundays was approved. Mr. Lurvey reported he had made an
inspection and cou18 find no evidence of excessive burning of
trash at this address.
The letter to the Board of Appeals stating that the Board
of Health had agreed to issue a permit to the Jewish Community
Center to conduct a Child Care Center, to be conducted on the
first floor only, pending the decision of the Board of Appeals

was approved.
The letter from the Board of Appeals stating that a permit
had been granted to the Jewish Community Center to conduct a
Child Care Center providing all sessions are conducted on the
first floor was approved by the Board.
The Board voted to send the Jewish Community Center a Child
Care Center license.
The letter to Mr. Harry H. Sussman, 218 Follen Road, stating
that a complaint had been received or rats in the area and upon 218 POTJ,T N`
inspection it was found that the stonewall in the rear of Mr. Suss- ROAD
man's property was infested with rats and an exterminator must be
hired to take care of the matter was approved.
The letter to Gertrude E. Cochran, 8 Stratham Road, regard- 8 STRATHAM
ing a complaint of over -flowing sewage was approved. Mr. Lurvey ROAD
reported that a new cesspool had been put in and the system was
all right now.
The letter from Mr. Harold Stevens, Town Council, stating WELLINGTON
that the Board of Health appreciates the fine job done by Mr. LANE DUMP
Carrig in abating the nuisance of the dump on his property on
Wellington Lane & Route 2 was approved. The Board noted the
paragraph in this letter which stated that although the police
department will endeavor to protect the Carrig property the
Town officials could not guarantee Mr. Carrig against illegal
dumping.
The letter from Mrs. Ruth Morey, Chairman of Board of Select- LOT B
men, stating that complaints had been received by the Board of BURLINGTO]
Selectmen of sand blowing from Lot B, Burlington Street, was read. STREET
Mr. Lurvey reported he had been out to view this Lot and Mr.
Koski, owner of the land, is in the process of filling this land
in, but is using a very .fine sand fill. The Board suggested that
Mr. Lurvey contact Mr. Stevens and see if this constitutes a
Health problem and if it did Mr. Lurvey should contact Mr. Koski
and suggest he use a heavier material over this fine sand to
•keep it .from blowing around the neighborhood. The Board also
gave Mr. Lurvey permission to issue an order to have this
nuisance abated if necessary.
The budget standing and the receipts were reviewed by the
Board.
