BOARD OF HEALTH MEETING
June 20, 1958
The June meeting of the Board of Health was held on Friday,
June 20, 1958 at 3 P.M. with Chairman McQuillan, Dr. Cosgrove,
and Mr. Lurvey present.
A letter was read from Mr. Maloney, Chairman of the Lexington
Board of Selectmen, in regard to a complaint that doctors are not
readily available in emergency. Upon advice of Dr. Wells, a former
president of the Middlesex County District Medical Association who
just happened in at the time of the meeting, a copy of this letter
from the Selectmen is to be sent to the present president of the
M.C.M.A., Dr. James Buckirk, Mt. Auburn Hospital, Cambridge, asking
for advice. There is a special investigating committee in.the
medical association to look into such complaints.
Another letter from the Selectmen asked for a re -consideration
of Lot on Crosby Road previously rejected by the Health Depart-
ment for private sewage disposal system because of high ground
water, impervious soil, etc. Mr. Lurvey checked again, and the
situation is the same. A letter notifying the Selectmen that this
lot cannot be approved has been sent to Mr. Maloney.
Mr. Lurvey recommended that a Child Care Center application
for a permit be approved for Mrs. Herbert Jacobs, 4 Diehl Road.
The Board voted approval provided recommendations by Mr. Lurvey
are carried out,and Board of Appeals permission is also granted.
Mr. Lurvey reported that Martin's Drug Store upon a recent
inspection was found in a very unsatisfactory condition, and a
letter was sent notifying the owner. The store has since been
closed.
The problem of an overflowing cesspool at 32 Clelland Road
(owner, Robert Roderick, Medalia, Ohio) is now corrected. Mr.
Roderick, upon notification of the nuisance, authorized the tenant
to have a new cesspool built, and the work is now completed.
Mr. McQuillan reported Mr. Carrig, Lawrence Lane, had asked
Aim about some lots in the area which had been rejected. The
Board agreed that the owner of this property should engage the
services of a registered engineer, and then if a solution is
obtained and is presented to the Board of Health for approval,
the Board would then have Whitman & Howard investigate this
solution. The Board would like a letter to be sent to Mr. Carrig
containing this decision.
At this June meeting a new Chairman of the Board df Health
is usually appointed. Because of the absence of Mr. Cole, the
Board would like to wait until the next meeting in hopes of a
full Board.
An application for a license to transport garbage was
approved for Capello Brothers, Inc., 36 Border Road, West Newton.
The latest bill from Whitman & Howard, Engineers, to May 23,
1958, $100.00, was approved by the Board. The budget standing
was discussed, and the Board felt the department is staying well
within the appropriation at this time.

The Health Officer's Report for the period was discussed.
This included septic tank, cesspool and lot inspections; food
establishments inspected; nuisance complaints; water samples
analyzed; meetings attended. With the growth of the town the
number of inspections and investigations has increased tremen-
dously.
Mr. John Callahan, 235 Lincoln Street, met with the Board
at 3.55 P.M. in connection with the overflowing cesspool on his
lot. Mr. Lurvey had given him the usual time to correct the
nuisance, but nothing much had been done. The Board discussed
the problem of 000peration in ridding the community of this
health menace, and Mr. Callahan agreed that he would have it p
pumped out and some fill put in, and see if this would correct
the nuisance. Mr. McQuillan exrlained the procedure in a case
of this sort, and stated that court action must take place if
the nuisance is not attended to within the reasonable time given
to correct. Mr. Callahan agreed to get it fixed within seven
days.
Mr. Seabury, general manager for the Lexington Inn, met with
the Board at 4.15 P.M. to discuss the matter of the dish rinse
water temperature for sanitizing eating utensils not staying
1800F or better as required. Mr. Seabury reported a new aquastat
has been ordered which might help, and also suggested that maybe
bhe gauges are not working properly, and should be replaced. The
floor covering has been very unsatisfactory, and Mr. Lurvey agreed
to meet Mr. Seabury at the Inn next Wednesday morning when the man
from the manufacturer is there to check. Mr. Seabury stated he
would put in a tile floor if the present flooring cannot be made
to satisfy this department.
Mr. McQuillan asked if a meeting ever was held by the Health
Officer with Mr. Potter, Mr. Woodies and Mr. Herterick on the plot
plan for tiienching manure at the piggery. Mr. Lurvey said it had
not been held as Mr. Potter had been trying to arrange for the
manure to be carried away from the piggery weekly, and wanted a
little more time to make these arrangements. This would do away
with any troiohing at the farm, and perhaps solve some of the
difficulties. Mr. Potter on June 19 informed the Health Depart-
ment that he had made arrangements to have the manure hauled to
Burlington weekly. The Board asked Mr. Lurvey to arrange a meeting
to comply with the agreement made at the special meeting (May 1)
that before the permit to keep pigs was issued this year a meeting
would be held with Mr. Potter and members of the investigating
committee of Minute Man Highlands Association. The men again asked
for an informal meeting in September to discuss after the summer
season how things are going.

Mr. Lurvey reported to the Board that he notified the Planning
Board that the Board of Health is not in doubt as to the suitability
for building purposes of lots in the Pleasant Gardens Subdivision pleas
owned by Mr. Walter Black as all lots are to be sewered. Gardens

Friday, July 18, 1958.
