The meeting was called to order at 7:00 PM. Sharon MacKenzie R.N., served as Chair
Person.
Director Cody reviewed the Community Health Report;
Mental Health First Aid (MHFA) and Youth Mental Health First Aid (YMHFA) classes
continue to be offered to members of the community, Lexington Public Schools teachers
and staff and faith-based organizations in Lexington. Trainings have been scheduled free-
of-charge upon request. Upcoming training dates include; May 24th.
CRNA Showcase- On Thursday, May 17 the Public Health Nurse and Health Director
attended the CRNA Showcase at Grandview Farm, Burlington to share information on
the CRNA Mental Health First Aid grant. After Showcase a CRNA general meeting will
take place with a panel of speakers discussing mental health initiatives.
Environmental Health report was reviewed and the following cases were discussed;
Beijing Chinese Dining; after some discussion, Burt Perlmutter, M.D., proposed a motion
that stated, "Beijing Chinese Dining is required to have the food consultant conduct four
unannounced food inspections hefore Septemher 1, 2018 and report hack to the Board of
Health. In addition, Beijing is required to attend all Board of Health meetings through
Septemher 2018." Sharon MacKenzie R.N., CCM, seconded the motion. All were in
favor. (See April 24, 2018 meeting Minutes for more detail).
Abbott's Custard- Food Code Variance Request, After some discussion Burt Perlmutter,
M.D., proposed a motion that stated, "The Lexington Board of Health is in agreement to
allow the Abbott's Custard to operate without a Certified Food Protection Manager on
site at all times as noted in 155-96.I.A. However, a person trained in food safety must he
designated as the Person In Charge in the absence of a Certified Food Protection
Manager. This variance will expire should an Agent of the Board of Health ohserve
through the food inspection process that a PIC is not identified on site during the routine
food inspection." John J. Flynn, seconded the motion. All were in favor.
Brow Lady Microblading Studio- New Body Art Permit; Sokkha Va, owner, met with the
BOH to request a permit to operate a Body Art Establishment, and a permit as a Body Art
Practitioner. After much discussion, Burt Perlmutter, M.D., proposed a motion that
stated, "The Lexington Board of Health is in agreement that a Body Art Practitioner and
Body Art Establishment permit he issued to Brow Lady Microhlading Studio. " Sharon
MacKenzie R.N., CCM, seconded the motion. All were in favor.
Bina Farm Dust Complaint, after some discussion John J. Flynn proposed a motion that
stated, "After reviewing the EH&E airhorne dust monitoring report dated May 21, 2018,
the Lexington BOH is in agreement with the finding that the air quality is typical of levels
seen in ambient outdoor environments. The Lexington Board of Health declares that this
case is closed and no further investigation due to complaints about dust should he
conducted by Lexington Office of Public Health staff or any other town official. " Burt
Perlmutter, M.D., seconded the motion. All were in favor.
13 Apple Tree Lane; An Order To Correct was issued on May 1, 2018 to building owners
in the plaza located at 333-403 Woburn Street. Owners responded positively and have
corrected violations.
Septic System Proposal- 52 Percy Road; A determination document was sent to the
homeowner. The homeowner was satisfied with the BOH determination (See April 24,
2018 meeting Minutes for more detail).
Bathing Place Permitting_pro rg am; The seasonal Pool facilities has requested relief in the
form of a variance from 105 CMR 435.23 (1) lifeguards. After some discussion, Sharon
MacKenzie R.N., CCM, proposed a motion that stated, "The Lexington Board of Health
grants the variance request from the requirement of lifeguards for the safe operation of
pools as listed under 105 CMR 435.23 (1). In addition, all requirements of 105 CMR
435.23 (2) shall be met including all signage which includes: "Warning No Lifeguard on
Duty" in easy to read, legible letters which are at least four inches high "Children under
age 16 should not use swimming pool without an adult in attendance" and another sign
that states, "Adults should not swim alone." This variance applies only to the following
seasonal pool facilities, which have made the request in writing. They are listed as
follows: Adams, Aloft Hotel, Avalon at Lexington Hills, Avalon at Lexington Ridge,
Drummer Boy Condominiums, Element Hotel, Emerson Gardens Condominiums, Moon
Hill, Pleasant Brook, Quality Inn, Peacock Farm. This Variance will expire at the end of
the Seasonal Pool season or upon notification of an unsafe operating condition at a
specific facility." Burt Perlmutter, M.D., seconded the motion. All were in favor.
Cleaning Products at Fiske Elementary School; The Office of Public Health received a
phone call from a contractor about concerns over the use of various cleaning products at
the Fiske Elementary School. The Health Director requested that he attend the May 22,
2018 BOH meeting to review the concerns and receive guidance from the Board.
The Emergency Preparedness report was reviewed and the following topics were
discussed;
On Wednesday, May 23rd from 3:30pm to 4:15 pm Massachusetts Department of Public
Health Commissioner Monica Bharel will conduct a conference call with local boards of
health. In addition to topics of emergency preparedness, the Commissioner will discuss
regulation updates, mosquitos and ticks, e-cigarettes, substance abuse and will have time
for a question and answer period.
Burt Perlmutter, M.D., motioned that the meeting be adjourned and Sharon MacKenzie
R.N., CCM, seconded. All were in favor. The meeting adjourned at 8:22 PM.
It was noted that the next meeting will take place on Wednesday, June 27, 2018.
