Emergency Preparedness Report
The meeting was called to order at 7:00 PM. Wendy Heiger-Bernays, PhD, served as
Chair Person.
Director Cody reviewed the Community Health Report;
Mental Health First Aid (MHFA) and Youth Mental Health First Aid (YMHFA) classes
continue to be offered to members of the community, Lexington Public Schools teachers
and staff and faith-based organizations in Lexington. Training have been scheduled free-
of-charge upon request. Upcoming training dates include; May 3rd, May 24th.
Environmental Health report was reviewed and the following cases were discussed;
Beijing Chinese Dining; after some discussion, Sharon MacKenzie R.N., CCM, proposed
a motion that stated, "Based on the evidence provided in the Order to Correct Letter
dated Fehruary 28, 2018, it is well documented that additional training is required for
the management and food service staff at Beijing Fine Dining. The training is to take
place while the establishment is closed for three days. While the establishment is closed,
managers and food service staff are to he trained by an approved Food Safety
Consultant. Topics for the training are based on the three Repeat Critical Violations. The
topics are as follows: Person In Charge requirements for I day, Food Protection from
Goss Contamination on day 2 and Keeping Food out of the Danger Zone on day 3. Each
day of closure and training is not required to he on consecutive days, however all the
trainings and closures must take place before Tuesday May 1, 2018. By Friday March
30, 2018, provide the name of the Food Consultant that will conduct the training and the
dates that the establishment will he closed. In addition, Beijing is required to have the
food consultant conduct one unannounced food inspection and report hack to the Board
of Health at the May meeting. It is the expectation of the Lexington Board of Health that
Beijing will comply with the Food Code requirements. Your 2018 Food Permit to operate
will not he issued until the three days of closure with trainings outlined above has been
completed and the Food Consultant has reported an acceptable level of compliance at
the May Board of Health Meeting. " Wendy Heiger-Bernays, PhD, seconded the motion.
All were in favor (See April 24, 2018 meeting Minutes for more detail).
Beaute's & Ink- New Body Art Permit; Thao Lay, owner, met with the BOH to request a
permit to operate a Body Art Establishment, and a permit as a Body Art Practitioner.
After much discussion, David Geller, M.D, proposed a motion that stated, "The
Lexington Board of Health is in agreement that a Body Art Practitioner and Body Art
Establishment permit he issued to Beaute's & Ink, contingent upon the owner providing
documentation of an appropriate medical waste disposal plan. " Sharon MacKenzie R.N.,
CCM, seconded the motion. All were in favor.
Abbott's Custard- New Food Establishment; Abbott's Custard is now occupying the
space formerly held by Candy Castle. Currently, they are operating under a temporary
food permit. Michael Ortyl, owner, met with the BOH to request a permit to Operate a
Food Establishment. After some discussion, Sharon MacKenzie R.N., CCM, proposed a
motion that stated, "The Lexington Board of Health grants an Annual Permit to Operate
a Food Establishment to Abbott's Custard. " Burt Perlmutter, M.D., seconded the motion.
All were in favor.
Ride Studio — Variance Request; Ride Studio Cafe is requesting a variance to allow a
noncommercial freezer to hold ice cream. 105 CMR 590 section 4-205 states in part that
food service establishments are required to have food equipment that is certified by the
American National Standards Institute, (ANSI). After much discussion, David Geller,
M.D, proposed a motion that stated, "The Lexington Board of Health is in agreement to
allow Ride Studio Cafe to utilize a noncommercial freezer to store ice cream. " Sharon
MacKenzie R.N., CCM, seconded the motion. All were in favor.
Septic System Proposal- 52 Percy Road; Cilas Brisbin, property owner, met with the
BOH to request a variance to allow for an alternative septic system in place of connecting
to Town sewer lines, and a variance to pump the proposed septic system every 10 years.
After some discussion, Wendy Heiger-Bernays, PhD, proposed a motion that stated, "The
Lexington Board of Health authorizes the Office of Public Health staff to review and
conditionally approve a satisfactory septic system. " Burt Perlmutter, M.D., seconded the
motion. All were in favor.
287 Waltham Street; Case closed. (See December 20, 2017 meeting minutes for more
details).
Bina farm dust complaint update; Last summer a dust complaint was filed with the Office
of Public Health from the abutter at 65 Allen Street. Recently a similar complaint about
dust was filed by the abutter at 5 Allen Street. After much discussion, Burt Perlmutter,
M.D., proposed a motion that stated, "The Lexington Board of Health authorizes the
Health Director to hire a consultant to study the alleged dust issue at Bina Farm. "
Wendy Heiger-Bernays, PhD, seconded the motion. All were in favor.
The Emergency Preparedness report was reviewed and the following topics were
discussed;
The Office of Public Health, in collaboration with the Lexington Fire/EMS, Lexington
Police, Lexington DPW, and Region 4A MRC opened a temporary overnight shelter at
Lexington High School (LHS) beginning at 7PM on Friday March 9th. Since no residents
decided to stay overnight the shelter was closed at l OPM. The Health Director and other
managers met the following morning and decided that a shelter would not be necessary
going forward for the remainder of the weekend.
On Wednesday, April 1 lth, the Public Health Nurse participated in an EDS workshop
with member of the Bedford, Winchester, and Woburn Health Dept's. This workshop
was led by Tyler Bonaccorsi, Region 4a Planner. Town's EDS plans were reviewed and
Tyler discussed using a more streamlined, shorter version of the EDS plan which may be
more functional in the event of a "real-life" emergency.
Sharon MacKenzie R.N., CCM, motioned that the meeting be adjourned and Wendy
Heiger-Bernays, PhD, seconded. All were in favor. The meeting adjourned at 8:25 PM.
It was noted that the next meeting will take place on Tuesday, May 22, 2018.
