SELECTMEN'S MEETING
April 1, 1947.
A regular meeting of the Board of Selectmen was held
on Tudsday evening, April 1, 1947. The Board met o& Tues. --
day because thf the fact that the Adjourned Town Meeting
was held on Monday. Chairman Paxton, Messrs. Locke, Gay
and Emery were present. The Clerk was also present.,
At 7:30 p.m. Mr. Daniel A. Lynch, Town Counsel, and
Mr. Joseph DeFoe, Sup't. of Public Works, met with the
Board.
The Chairman explained that Mr. Lynch and Mr. DeFoe
had been invited to meet with the Board this evening to
discuss Board of Survey agreements and bonds. He stated
that tt is the opinion of the Board that the Board should
be certain that streets, petitioned for in connection with
Board of Survey layouts, are going to be constructdd. He
said that he would like the Town Counsel to tell the Board
just what could be done.
Mr. Lynch stated that the Board could do almost anything.
He suggested printing rules and regulations so that prospective
developers might have them to study. Mr. Lynch said tiiat the
requirements shouldbe uniform and the same for each developer.
He said that no matter how strict the regulations are, once
they are adopted by the Board, no variations Should be made.
The Chairman said that it appears now that there are
to classes of developers -- our local citizens and those
coming from out of town trying to make money in a hurry.
The Chairman asked if an agreement could prevent the
developer from building houses and Mr. Lynch replied in the
negative.
The Chairman asked if the developer could build houses
before the ttreets are completed and Mr. Lynch replied in
the affirmative.
Mr. Emery asked if the Town would be adequately pro-
tented by requiring a bond of 100% and Mr. Lynct replied in
the affirmative.
The Board of Selectmen, acting as a Board of Survey,
decided that all future Board of Survey agreements are to
follow exactly the form used in 1946 for the R. Lockwood
Tower, et als development in Follen Hill. In the event a
developer, or his contractor, is permitted to install the
water mains, an additional item must then be included in the
agreement.
The Chairman asked Mr. DeFoe if he knew what the figure
for the Selfridge bond should be and Mr. DeFoe replied that

it would be approximately 46,000.
The Chairman stated that the bond and agreement should
be completed for signatures of the Board tdt later than Mon-
day, April 7, 1947 and guested that the time limit be
designated as July 1, 1948. The other members of the Board
agreed.
The Chairman read a letter from Mr. Lindstrom, the
Building Inspector, informing the Board that he has made Loam
several visits to the property of Mrl Robert Innis on Stripping
Ellison Road regarding stripping of loam which is being
removed to the Westview Cenetery.
The Chairman asked Mr. Lynch if the Town could stop
Mr. Innis from stripping loam and he replied in the affirma-
tive.
The Chairman requested the Sup't. of Public Works to
instruct the Town Engineer to put in a couple of lathes and
stake out the center lines. If they very 25 feet from the
center line, it would indicate that Mr. Innis is definitely
stripping loam.
Mr. DeFoe asked how the stripping. could be stopped and
Mr. Lynch advised him to contact his office as soon as he
finds that Mr. Innis is stripping the loam.
Upon motion of Mr. Locke, seconded by Mr. Gay, it was
voted to authorize the Town Counsel to take whatever action
is necessary to stop the stripping if it is determined that
Mr. Innis is violating the Zoning Laws.
Mr. Lynch retired at 8:25 p.m.
Mr. DeFoe said that a request had been made to con-
tinue street lighting on April 4 from 1:00 a.m. to 5:00 a.m.
The Chairman stated that there will be all night Street
services in some of the churches and he thought it would Lighting
be a service to the oomttunit7 if th.elights remain on all
night.
Ripon motion of Mr. Gay, seconded by Mr. Locke, it
was voted to authorize the Supt. of Public Works to make
the necessary arrangements for the street lights to remain
on from 1:00 a.m. until 5:00 a.m. on April 4, 1947, the
night befgre Good Friday.
Mr. DeFoe reported to the Board on the various claims Claims
submitted for damages alleged to have been caused by blasting. For

Upon motion of Mr. Gay, seconded by LIr. Emery, it was
voted.:to settle all the claims, with the exception of Mr.
sauick's, at the figures submitted by the claimants, providing
releases are obtained properly signed.
Mr. DeFoe informed the Board that he has received bids
as follows for replacing nine flush valves in the Cary
Memorial Building:

Mr. Locke moved that bid received from Lester L. Andrews,
in the amount of $269.00 be approved. Mr. Gay seconded the
motion, and it was so voted.
Mr. DeFoe discussed at length various makes of tractor
loader. He informed the Board that the unit. 3:n which he is
most interested is a Hough Payloader which sells for $5,700
delivered with a five-foot bucket.
The Chairman inquired as to the horsepower and Mr.
DeFoe said that it is rated as 55 h.p. and will lift 5,000
lbs.
The Chairman asked the size of the rear tires and Iir.
DeFoe replied that they are duals 12 x 24.
The other bids received are as follows: Perkins -Eaton,
$3490; Scoopmobile $3100. The Hough Payloader is sold by
Clarke -Wiley Company.
Pay- Upon motion of Mr. Locke,,seconded by Mr. Gay, it was
loader voted to authorize the Sup't. of Public Works to purchase
a Hough Payloaddr for $5,735 which includes a six-foot
bucket. It was also voted to authorize Mr. DeFoe to pueohase
a five-foot bucket at a cost of $100 and a boom at a cost of
$75.00.
Mr. DeFoe informed the Board that he has received a
Equipmtt request from the Town of Bedford for permission to rent
Rental Lexington's power broom. The Chairman said that he thought
the Town should cooperate and rent the unit.
The Board authorized Mr. DeFoe to rent the power broom
to the Town of Bedford at the rate of *7.00 an hour with
Lexington 's operator.
Letter was received from Emidio Paone, 15 Emerald
Street requesting three loads of cinders from the public
schools to fill in EmeraXI Street.

The Chairman said that it has always been the policy Ashes
of the Board to use all town fill and ashes on town dumps.
Mr. Amidines request was denied.
The Chairman read a letter from Mr. Harold J. Toole,
Director of Water Division of the M.D.C. advising that the
Commission has toted to install the meter in the new force
main being constructed in Lexington, at the expense of the
Commission.
The Chairman read a letter from Mr. a-nd Mrs. Kennedy,
55 Hancock Street advising that they have received a formal
notice of the taking of part of their land for the relocat- Adams
ing of the highway known as Adams Street. The Kennedys Street
would like the Board to assure them that a retaining wall
will be provided free of charge and that the shade trees
will no't be moved.
The Chairman said that, as he understands the situation,
it is from East Street over that the change will be made. He
asked the Supt. of Public Works to check to determine whether
or not there are any changes in the property line.
Letter was received from Mr.G. P. Wadsworth, Secretary
of the School Committee,gequesting high-powered lights Street
outside of the high school on Massachusetts Avenue. Lights
The Clerk was instructed to request Mr. DeFoe to check
the lighting, with Mr. Hitchcock of the Boston Edison Co.,
beginning at Woburn Street and going down as far as the
driveway into the Munroe Eemetery opposite iiowland Avenue
and to submit recommendations to the Board.
Mr. DeFoe retired at 9:35 p.m.
Request was received from Richard H. Childs, 87 Simonds
Road, tor permission to operate'a temporary stand to sell
Hot dogs and Coca -cola on April 19, 1947 at the corner of Stand
Merriaam Street and Massachusetts Avenue. Mr. Childs intends Apr.
to have a truck with counters extending into il[erriam Street. 19
The Board was not in favor of the location requested
and instructed the Clerk to request the Chief of Police to
submit recommendations of other locations with relation to
traffic.
Letter was received from Donald E. McGowan, 143 Bell
Rock ,Street, Everett offering 000 for Lots 230-234
Alpine Street, lots 206-211 Hayward Avenue and lots 227-228
Cotionial Avenue. The Chairman explained that in the past Mr. Potter
and '.r,Spencer investigated all tax title property and the Board
is now in the pOslt1dn of having to designate this to someone

else. It was decided to have the Chairman check with
Mr. Potter to find out whether or not he would be will-
ing to continue to serve in this capacity.
The Chairmanread a letter from the N. E. Tel. & Tel.
Co. relative to the placing of fire alarm cable in Bedford
Street. It is the opinion of the company that a pull of 900
of neoprene jacketed cable can be done safely and without
risk of dem age,providing proper installation methods are
employed.
It was decided to have the Chairman write the..elephone
Company to find out whether or not they will assume a portion
of the cost of placing the cable.
The Chairman read a letter from the Chief of Police
stating that he would like the Selectmen to request the
Civil Civil Service to hold an examination for the positions of
Service Sergeant.
Exam. Mr. Locke moved that the Division of Civil Service
be requested to make the necessary arrangements. Mr. Gay
seconded the motion, and it was so voted.
Application wasreceived from the Lexington Club, Inc.
for permission to conduct a dance in Cary Memor&al Hall on
May 3, 1947 from 8:00 p.m. to 11:00 p.m.
Use of Mr. Locke moved that the use of the hall be granted
Hall subject to a charge' of $25.00. Mr. Emery Seconded the
motion, and it was so voted.
Upon motion of Mr. Emery, seconded by Mr. Locke, it

Upon motion of Mr., Gay, seconded by Mr. Locke, it

Public Official Bond #5802 in the sum of $5,000
issued by the American Employer's Insurance Company for
a period of one year on behalf of Mary R. McDonough as
Assistant Town Treasurer was received.
Public Official Bond #F-04372 In the sum of $48,600
fonds issued by the American Employer Insurance Company for a
period of one year on behalf of James J. Carroll, Town
Treasurer was reced.ved..

Public Official Bond #F-50708 in the sum of $1,000
issued by the American Employers' Insurance Company for a
period of one year on behalf of James. J. Carroll, Tone
Clerk, was received.
Mr. Emery moved that the three bonds be approved and
submitted to the Town Accountant. Mr. Locke seconded the
motion, and it was so voted.
Upon motion of Mr. Gay, seconded by Mr. Locke, it was Town
voted to establish the hours of 9:00 a.m. to noon as the Offices
time the town Office Building which is occupied by the
offices of the Board of Selectmen, Board of Public Works,
Town Clerk, Town Treasurer and Tax Collector shall be open
on Saturdays.
Upon motion of Mr. Locke, seconded by Mr. Gay, it was Special
voted to re -appoint the Hollowing individuals as Special Police
dice` Officers in the sown of Lexington for a term ex-
piring March 31, 1948.
