SELECTMEN'S MEETING

September 9, 1946
A regular meeting of the Board of Selectmen was
held in the Selectmen's Room, Town office Building,
on Monday evening, September 9, 1946 at 7:30 p.m.
Chairman Potter, Messrs. Rowse, Sarano and Paxton
were present. The Clerk was also present.
State takes The Chairman informed the Board that the Super-
Over intendent of Public Works had advised him that the
Marrett State has taken over Marrett Street and there is
Ntreet nothing further for the Town to do relative to its
abandonment.
Notice was received from the Commonwealth of
Article Massachusetts together with a copy of Chapter 539 of
Warrant the Acts of 1946. This act provides for an increase
Chapter not exceeding 20 per cent of the pension or retirement
559 re allowance of any former employee of the Town. To.
Increase become effective, the act must be accepted by Town
Pensions Meeting.
It was decided to include an Article in the Warrant
for the Annual Town Meeting in March, at which time the
Town Meeting Members will be given an opportunity to
vote on the matter.
Battle Letter was received from Richard Lane, Comander,
Flag U. S. N. , First Naval District, relative to the
USS LEX. battle flag flown by the USS LEXINGTON during World
Req. To War II, Commander Lane stated that the flag is being
Hold till held pending receipt of instructions from the
April 19 Selectmen. In addition, there is a set of photographs
taken aboard the carrier and a complete history of the
vessel. The First Naval District suggested a formal
presentation, possibly in connection with the observance
of Navy Day, October 27, 1946.
Mr. Rowse suggested that presentation of the battle
flag be made in connection with the 1911-of April celebra-
tion.
The Chairman agreed to make some effort whereby the
acceptance of the flag and photographs could be deferred
until April 19 , 1947.

A letter was received from Deputy Chief Roy A. Cook Fire
relative to the Fire Department aiding the Bedford Air- Dept.
port. Deputy Chief Cook stated that in his opinion To Aid
whatever assistance the Lexington Fire Department is Bedford
called upon to render will not jeopardize the protection Airport
of the Town in any way.
The Clerk was instructed to advise the Massachusetts
Aeronautics commission that the Town of Lexington will
give the Bedford Airport such assistance as may be
necessary with respect to fires which can not be effect-
ively handled or controlled by their own personnel.
Notice was received from the Board of Appeals Piehette
relative to a hearing on the matter of varying the Board of
application of the Zoning Law by permitting on the Appeals
premises owned by John L. Pichette, Bertha V. Pich- Meeting
ette and Lillian D. Parks and located at 847 - 855
Massachusetts Avenue , the erection and ma4nbenance
of a retail gasoline and oil service station. The
hearingwill be held on September 12, 1946 at 8:00 p.m.
The Board gave further consideration to an offer
submitted by Marjorie P. Seavey en behalf of Frank E. *590 for
Bougie. Mr. Bougie desires to purchase Lots 7, 8, 108 Lots on
and 109 Eastern. Avenue and Lots 56 to 58 inc. Eastern
Fairland Street for the sum of *150 . Mr. Bougie is Avenue and
the former owner of these lots. Fairland
The Chairman informed the Board that the lots Street
and a building were assessed for $590. Bougie
Upon motion of Mr. Rowse, seconded by Mr. Lots
Paxton, it was voted to advise Miss Seavey that the
Board of Selectmen will entertain an offer of
$590 for this land.
A letter was received from Alfred R. Batstone , Advertise
41 Bartlett Avenue, Lexington, offering the sum of Lots 86-89
$156 (one hundred fifty-six) for Lots 86 to 89 inc .
on Bartlett Avenue.
Upon motion of Mr. Sarano, seconded by Mr. Rowse,
it was voted that a proposal to sell the lots be
advertised in the Lexington Minute-Man, and that further
consideration be given the offer at the next meeting
of the Board.
The V. F. SST's application for permission to con-
duct an amateur show in Cary Hall on the evening of V.F.W.
September 18, 1946 was held over from last week. Amateur

The Clercs informed the Board that the organizatioh
has had three free uses of Cary Hall , five uses of
Estabrook Hall and two uses of the conference room.
Mr. Rowse moved that the use of the hall be
granted, free of charge. Mr. Paxton seconded the motion,
and it was so voted.
Boasters Application was received from the Lexington
Estabrook Athletic Boosters Club for permission to conduct a
Hall directors' meeting in a conference room on the evening
of September 11, 1946, from 7:30 p.m. to 11:00 p.m.
.. Rowse moved that the use of the hall be
granted, free of charge . Mr. Sarano seconded the motion,
and it was so Voted.
Mara Upon motion of Mr. Sarano, seconded by Mr. Rowse,
Special it was voted to sign a Special Police Commission and
Police appoint Mr. William Mara a Special Police Officer in
Commission the Town of Lexington for a term expiring March 31 , 1947.
Mr. Mara works at the Middlesex County Sanatorium.
Sign Upon motion of Mr. Rowse, seconded by Mr. Paxton,
Water Orders it was voted to sign Larchmont Lane, Lincoln Street and
Barrymeade Drive water orders in the following form

WHEREAS, the Town of Lexington at a town meeting duly called
and held on March 25, 1946, duly adopted under Article 10 of the
Warrant the following vote:
"VOTED: That the Selectmen be authorized to install water mains
not less than 6" not more than 16" in diameter in such accepted or un-
accepted streets as may be applied for during the year 1946, subject
to the assessment of betterments, and to take by eminent domain any
necessary easements therefor. " For the purpose of said installations
the sum of $10,000 .00 was transferred from the Water Department Available
Surplus Fund to the Water Construction - Sundry Streets Account.
VOTED: By the Selectmen acting as a Board of Water and Sewer
Commissioners under the authority of the foregoing vote and of every
other power them thereto enabling, that a water main be constructed in
Larchmont Lane from the present end easterly and distant approximately
from the present end pas'�erly and distant approximately 130 feet,
substantially in accordance with a plan entitled, "Plan of Proposed
Water Main in Larchmont Lane, Lexington, Mass. , Scale 1 in = 40 ft. ,
Sept. 3 , 1946, John T. Cosgrove , Town Engineer. "
Betterments will be assessed for this improvement in
accordance with the provisions of Chapter 80 of the General Laws.

The area which it is expected will receive benefit or
advantage other than the general advantage to the community
from such improvement is described as follows:
That portion of those properties on each side of
Larchmont Lane beginning at the present end and extending
easterly a distance of approximately 130 feet.
The said area comprises the several lots shown upon
the plan of John T. Cosgrove, Town Engineer, hereinbefore
referred to which are designated in the schedule hereto
annexed and made a part hereof.
We estimate the betterments that will be assessed
upon each parcel of land to be as shown in the schedule
hereto annexed and made a part hereof.
Witness our hands at Lexington aforesaid this ninth day
of September, 1946.

ORDER OF TAKING
By the Town of Lexington of Easement for the
Construction of a Water Main.
BARRYMEADE DRIVE
(From Lincoln Street northwesterly and distant
approximately 730 feet)
WHEREAS, at a meeting duly called and held on March 25, 1946,
the Town Meeting of Lexington pursuant to an article in the warrant
of the meeting for which due notice was given, duly adopted by
unanimous vote the following vote and made an appropriation
therefor:
"Voted That the Selectmen be authorized to install water
mains not less than 6" nor more than 16" in diameter in such
accepted or unaccepted streets as may be applied for during the
year 1946, subject to the assessment of betterments, and to take
by eminent domain any necessary easements therefor. "
AND WHEREAS, the right of way and easement hereinafter
described and taken are necessary for the establishment and
maintenance of the said water main
NOW, THEREFORE, the Board of Selectmen of the Town of Lexington,
acting as a Board of Water and Sewer Commissioners, for and in
behalf of the said town, by virtue of the authority conferred
upon them by the foregoing vote and of every other power them
thereto enabling, hereby adopt this order of taking by eminent
1 domain, for the said public improvement for the purpose of
constructing and maintaining a water main in Barrymeade Drive
from Lincoln Street northwesterly and distant approximately 730 feet
as aforesaid, the following easement, namely
The right to enter upon the land shown as Barrymeade Drive
on a plan entitled, "Plan of Proposed Water Main in Barrymeade
Drive, Lexington, Mass. Scale 1 in. = 40 Ft. , Sept. 3 , 1946,
John T. Cosgrove, Town Engineer. " and owned by George W. &
Helen B. Sarano, and construct therein a line of water main with
all necessary connections, shut-offs, and appurtenances substantially
as shown on a plan of John T. Cosgrove , Town Engineer, dated Sept.
3 , 1946, to be recorded herewith. The easement covered by this
taking includei the right on the part of the Selectmen of the
said town or other duly authorized agents of the town to enter upon,
dig up, open and use the land embraced within the said way as may
be reasonably necessary for the purpose of initially constructing
and thereafter maintaining, operating, inspecting, repairing and
replacing from time to time the said water main, ( the said town

being always bound to see that the ground after the
completion of the work in each case is c&eared of all
surplus material and surface left in as smooth and good
condition as at the time of entry) . 111
Betterments will be assessed for this improvement in
accordance with the provisions of Chapter 80 of the General
Laws. The area which it is expected will receive advantages
other than the general advantage to the community from such
improvement comprises the several lots shown upon the plan of
John T. Cosgrove, Town Engineer, above referred to , which are
designated in the schedule hereto annexed and made a part
hereof.
We estimate the betterments that would be assessed upon each
said parcel of land to be as shown in the said schedule.
We determine that no damages have been sustained and none
are awarded.
To have and to hold the said easement to the Town of
Lexington, its successors and assigns, to its and their own
use and behoof forever agreeable to the provisions of the
said Chapter 79 of the General Laws and all pertinent acts in
amendment thereof or supplemental thereto.
IN WITNESS WHEREOF the undersigned being a majority of the
Board of Selectmen of Lexington aforesaid have hereunto sub-

The Chairman informed the Board that Robert H. Town does
Holt had written him and said that he could raise Not want
sufficient funds to buy the Munroe Property between Munroe
the Munroe Station and Massachusdtts Avenue if the Property
Town is willing to accept it as a gift . This parcel
contains approximately 25,400 square feet. The
members of the Board present were not in favor of
accepti-ng this parcel of land as it was their opinion
that the Town now has sufficient park area to care for.
Mr. Rowse moved that Mr. Holt be advised that the
Selectmen are not in favor of accepting this piece of
property . Mr. Paxton seconded the motion, and it was
so voted.
The Chairman presented a plan showing Lot 77 Not to Sell
Marrett Road. He explained that there is a brook Lot 77
running through this parcel of land. He said that Marrett Rd.
the area in the rear depends on this property
for drainage and also for entrance and egress.
The Clerk was instructed to take the card on this
property out of the files and make a notation on it
that it is not to be sold.
