HomeMy WebLinkAbout1945-06-25 204 00 SELECTMEN'S MEETING June 25, 1945 A regular meeting of the Board of Selectmen was held in the Selectmen's Room, Town Office Building, on Monday evening, June 25, 1945, at 7;30 p.m. Chairman Locke, Messrs. Potter, Sarano and Rowse were present. The Clerk was also present. At 7 :30 p.m. Mr. William C. Paxton, Superintendent of Public Works, appeared before the Board. Claims He stated that a Mr. G.W. Rogers, 81 Hancock Street, Hancock had called him relative to damage to the callings of his Sewer home which he claims was caused by blasting on the Hancock Project Sewer Project in 1941. 1941 Mr. Stanley Higgins inspected the house On April 4, 1941, and reported that the ceiling in the sun porch was cracked and the finished coat of plaster has separated from the first coat at two places. He further reported that there were two fresh cracks opened up in the living room. Mr. Rogers told Mr. Paxton that the damage amounted to approximately $40.00 or $50.00, but as yet he has not presented a claim in writing. The Board instructed Mr. Paxton to obtain a letter from Mr. Rogers relative to his claim for damages. Mr. Paxton retired at 8:43 p.m. At 8 :45 p.m. hearing was declared open upon the application of John Sellars for permission to increase the capacity of underground tanks for the storage of gasoline from 2500 to , Sellars 8000 gallons on the premises located at the corner of Waltham Gasoline Street and Concord Avenue. Mr. Sellars said that the gasoline Hearing companies will resume operations as soon as the war is over, Concord and they will make deliveries using tank trucks . They do not Avenue plan to make deliveries to stations more than once a month. & The Chairman asked if Mr. Sellars were requesting an Waltham increase upon the advise of the gasoline company, and Mr. Street Sellars replied in the affirmative. Mr. Sellars said that he had already signed a contract with the Esso Company who intend to spend a substantial amount of money on the service station at this location. Mr. Sellars retired at 8:50 p.m. Mr. Potter moved tht the application be approved; subject to the approval of the Board of Fire Engineers. Mr. Sarano seconded the motion, and it was so voted. 205 The Chairman informed the •oard that Fulton Brown Fulton had,.appeared before the Board of Appeals and was granted Brown a permit giving him permission to assemble horseshoes Board of in the building at 9 Muzzey Street, Lexington, which Appeals had been used as a blacksmith shop. -'Permit The Chairman aaid that 7 Muzzey Street was used by Walter Black, Contractor, as a paint shop. Mr. Brown later came before the Board of Appeals and asked permission to connect the two buildings so that he could make better use of the building next to the Lexington Trust Company. The Chairman stated that under the limitations of the Zoning Laws the Board of Appeals had no choice in granting him a permit to make any structural changes in the buildings , and the permit, therefore , was denied. Mr. Cann reported to the Board of Appeals that Mr. Brown had cut a door in each of the buildings. The Chairman said teat Mr. Cann insists the change made by Mr. Brown constitutes a violation of the Zoning Law. He has taken the matter up with Mr. Wrightinaton who is going to write to Mr. Brown advising }him that he will have to restore the two buildings to the condition which they were ]Before the permit was granted. The Chairman read a letter from Munroe H. Hamilton offering $300.00'for Lots 33 and 34, Robbins Road, Munroe Lexington, free of all charges. Hamilton Mr. Sarano moved that a proposal to sell the lots Tax Title be advertised in the Lexington Minute Man, and that Lots further consideration be given the offer at the next meeting of the Board. Mr. Rowse seconded the motion, and it was so voted. The Board gave further consideration to Mr. Walter Sell Lots McGrath' s offer of $150. 00 for Lots 197 and 198, Tarbell 197 & 198 Avenue, Lexington. A proposal to sell these lots was Tarbell advertised in the June 21, 1945 issue of the Lexington Avenue Minute-Man. No persons contacted the Selectmen' s Office as a result of the advertisement. Mr. Rowse moved that the offer be accepted, and that Lots 197 and 198, Tarbell Avenue, be sold and conveyed to Mr. McGrath. Mr. Potter seconded the motion, and it was so voted. The Chairman read a letter from Lincoln C . Grush Propose offering $250.00 for Lot 2A, Tower Road, Lexington. Sell Lot Mr. Rowse moved that a proposal to sell the lot 2A Tower be advertised in the Lexington Minute-Man, and that Road further consideration be given the offer at the next meeting of the Board. Mr. Sarano seconded the motion, 11 and it was so voted. 206 Ce The Chairman reed a letter from Arthur E. Wheeler 1Propose offering $50.00 each for Lots 2, 7, and 10, Block 17, Sell Lots Reed Street, Lexington. 2, 7 and Mr. Sarano moved that a proposal to sell the lots 10, Block be advertised in the Lexington Minute-Man, and that 17, Reed further consideration ? e given the offer at the next Street meeting of the Board. Mr. Rowse seconded the motion, and it was so voted. Reinstatement Form #57 was received from the Division of Civil Service apr:roving the Reinstatement Reinst'mt of Ralph E. Chadwick as part-time Sealer of Weights Part-Time and Measures, effective July 1, 1945. The Board gave Sealer of further consideration to this matter, inasmuch as Mr. Weights & Chadwick felt that he should have been reinstated as Measures of June 15, 1945. The Clerk informed the Board that Miss Pelley of the Division of Civil Service stated on June 20, 1945 that the Livision does not designate the time of rein- statement, but such time is worked out to the satis - faction of the appointing authority and the employee, the apointinr authority being the Board of Selectmen. A letter was received from Mrs . Albert G. Froth- D. A. R. Ingham requesting the use of Estabrook Hall from 2:00 Free Uses p.m. to 5:30 p.m. on Thursday, September 27, 1945, of Halls for the celebration of the Fiftieth Anniversary of the Lexington Chapter of the D.A.R. They would also like to have the use of Cary Hall on the evening of the same date . Mr. Rowse moved that both uses be granted, free of charge. Mr. Potter seconded the motion, and it was so voted. Final A letter was received from Mr. . John J. Garrity, List of Supt. of Parks & Playgrounds, submitting a final list Playground of playground instructors and their salaries for this Instructors season. Mr. Rowse moved that the list and the salaries be approved. Mr. Sarano seconded the motion, and it was so voted. A letter was received from Roland E. Garmon, 787 Town Massachusetts Avenue, applying for the position of Town Service Service Officer. Mr. Garmon stated that a bill covering Officer this position is now before the Legislature. The Board decided to take no action on the matter until such time as the law had been passed. I 207 II The Chair:Ilan reminded the Board that no action had been taken on Mr. Paxton' s resignation as Super- tendent of Public Works. Accept Mr. Potter said that the effective date in the Supt. of resignation was July 12, 1945, but that Mr. Paxton Public was entitled to two weeks ' vacation. Mr. Rowse suggested Works a four week vacation period, inasmuch as Mr. Paxton did Resign'n not take any vacation in 1944. Upon motion of Mr. Saran , seconr?ed by Mr. Rowse, it was voted to accept Mr. Paxton' s resignation as Superintendent of Public Works in the Town of Lexington as of August 9, 1945, which includes four weeks ' vacation with pay. The Clerk was instructed to notify Mr. Paxton that the last four weeks are to be considered his vacation time with pay. The possibility of Mr. John J. Garrity acting as Super- intendent of Public Works after August 9, 1945 was considered, and it was decided hot to take any action until after that date . The Chairman read a letter from Joseph B. Hallisey, 32 Albert Avenue, Belmont, applying for the position of Appl. for Superintendent of Public Works in the Town of Lexington. Supt of The Clerk was instructed to acknowledge the letter, Public and no action was taken on the matter . Works At 8 :30 P.M. Dr. Pyle, Messrs. McQuillan and Russell of the Board of Health appeared before the Board. Chairman Locke said thit ultimately the Town would have a well organized and active Board of Health. He said that he assumed that until personnel were available for clerical work etc. that the tendency will be for the new Board of Health to carry on more or less as the Board of Selectmen have. He said that the Board of Selectmen would assist the new Bord of Health in any way posssible . Mr. Potter said that he felt that the licensing of slaughterhouses should come under the jurisdiction of the Board of Selectmen; the Selectmen to determine the location of the slaughterhouse . The slaughter license would be Board issued by the Board of Health. Mr. Rowse said that the Board of Selectmen have no of idea of restricting the activities of the Board of Health, Health but he felt that they should be restricted somewhat until the end of the war because of the overstrain on the clerical help. Mr. Rowse also that an active Board of Health was a very good thing, but it was_ important that not too much work be created at this particular time due to the lack of help. 11Mr. Potter said that money could be included in the budget for the coming year to provide for a girl to take over the work in connection with the Board of Health, and the Board could then function as an active Board of Health should. 208 oooc Dr. Pyle said that as he sees it , it is something that will have to move slowly. He said that he could merely act as a Medical Consultant, and that revamping and making changes of the Board of Health rules and regulations, etc. will have to wait until an appropri- ation is made . Mr. Potter said that when the appropriation is made there will be an opportunity for the Board of Health to become more active. After further considering Board of Health matters , it was decided that the following matters,would remain under the jurisdiction of the Board of Selectmen: Licensing of Slaughterhouses and Garbage Contract.
