HomeMy WebLinkAbout1944-04-17 462 '1/47 SELECTMEN 'S MEETING Sy April 17, 1944 A regular meeting of the Board of Selectmen was held in the Selectmen's Room, Town Office Building,. on Monday evening, April 17, 1944, at 7:30 P.M. Chairman Locke, Messrs. Sarano and Rowse were present . The Clerk was also present . At 7:30 P.M. Mr. James W. Denney appeared before the Board. Mr. Denney, 11 Fairview Avenue, Lexington, said Tax that he was told that the Town owns four lots formerly Title owned by his brother, now deceased. He said that two Offer lots were on Wood Street and two on Colonial Heights, and he would like to pay the back taxes. The Clerk understood that these lots were formerly in the name of Henry Garten and, according to Mr. Carroll, the Town only owns one lot (lot 251) on Wood Street which was formerly owned by Henry Garten. Mr. Denny informed the Board that the lots in Held which he is interested are #249 and #250 on Wood Street, Over and #278 and #279 on Colonial Heights. He said that the former owner would be William H. S. Denney. The Chairman informed Mr. Denney that more in- ifeemattron would have to be obtained before any decision could be made pertaining to these lots. Mr. Denney retired at 7:45 P.M The Clerk was instructed to find out what, the taxes on these lots are, to date, including the amount owed at the time of foreclosure. Mr. Paxton appeared before the Board at 7:45 P.M. Mr. Paxton said that he did not have say items to present to the Board this evening. The Chairman read a letter from Mr. Harold Conant of 47 Lincoln Street , suggesting that the Town procure Pine some five-year old pine trees, which are being offered Trees free of charge by the State, and have them planted be- Lincoln tween the dump and Lincoln Street. Street Mr. Paxton said that he received a letter from the State relative to the pine trees, but Mr. Garrity did not believe there was much merit in obtaining any seedlings. It was decided to refer Mr. Conant's letter to Mr. Garrity. Mr. Sarano said that he would also talk with Mr. Garrity on the matter. e 463 Mr. Rowse said that complaints had been received relative to rats at the North Lexington dump. Mr. Paxton said that he 'knew about rats in this locality, and had talked with Mr. Lamont who is going Rata to try to obtain rat poison from the County to remedy at the situation. Mr. Paxton said it would be a help if Dump the dump were eliminated; however, he has not enough fill and it will take a couple of thousand yards. He thought perhaps within two years the dump would be eliminated. Mr. Rowse asked if another dump would have to be found for the residents of North Lexington,if the dump at the Public Works Building were filled in. Mr. Paxton replied that the Lincoln Street dump was closer to North Lexington than East Lexington, and residents in East Lexington have to use it. Mr. Rowse said that he had received a letter from Mr. Preston complaining about the sign at Rowland Avenue. Mr. Pifewtan. said that it was not legible, and he stated Street that the sign at Pelham Road can not be seen at night. Signa, Mr. Paxton thought that street signs were perhaps the leaat_±mportant item during this period of labor shortage. He said that he would check it, however, and see if it would be possible to have the street signs painted. Mr. Rowse asked Mr. Paxton if he would reply to Mr. Preston's letter, and he agreed to do so. Yr. Ifiex Paxton retired at 8:00 P.M. Application was received from the Lexington Veterans of Foreign Wars requesting the use of Cary Memorial Hall on the evening of May 24, 1944, from 8 P.M. to 12 midnight, Use of for a dance. Hall Mr. Rowse mooed that the use of the hall be granted, subject to a charge of $40.00, plus the deposit fee of $80.00. Mr. Sarano seconded the motion, and it was so voted. The Chairman read a letter from Mr. Wrightington regarding the claim of Patrick S. Brannan. Mr. Wrightington said that the report of the Plumbing Inspector to the Selectmen is not a public document and Mr. Brannan has no legal right to insist on seeing it. Brannan Mr. Brannan is considering a possible claim against the Claim Town for damage to his property as a result of a hot water Hot Water boiler explosion at #44 Fletcher Avenue. Explosion Mr. Wrightington stated that there was nothing in the report that would justify such a claim and that he would advise the Board of Selectmen to decline showing Mr. Brannan the Plumbing Inspector's report on the ground that it is a private report for the Selectmen's information. 1 464 Mr. Rowse moved that a letter be written to Mr. Brannan advising him that the report of the Plumbing Inspector to the Selectmen is not a public document. Mr. Sarano seconded the motion, and it was so voted. Legal The Chairmanrread a letter from Mr. Wrightington relative to correspondence from James J. Walsh, Chairman Op. of the Cemetery Commissioners, regarding the "Sale of safe Lots Fund". Lots Mr. Wrightington stated that according to Section 15 Fund" as it appears in its present form and Statute 1934, Chapter 85, a Town Appropriation is required before the proceeds of the "Sale of Lots", which under both Section 25, G. L. Chapter 114 and Section 15, Statute 1934, Chapter 85 have to be paid into the Town Treasury, can be withdrawn from the Treasury. Mr. Wrightington further stated that he could see no reason to change his opinion of February 17, 1944. Plmbg. The Chairman read a letter from Mr. Wrightington Insp. regarding the claim of Mr. Lindstrom, Plumbing Znspeetor, Bonus that he is entitled to /receive the bonus, which was voted at the Annual Town Meeting for all full-time employees. Mr. Wrightington said that the words "full-time" initbe 3. SnwnWifeththhghld beigi' enitheir ordinary meaning and that Legal Mr. Lindstrom's contentions regarding the Retirement Aot Opin- and the Civil Service Act have nothing to do with it. ion Mr. Wrightington stated that, in his opinion, Mr. Lindstrom is a part-time employee and not entitled to the bonus . Mr. Wrightington has talked with Mr. Lindstrom and believes that he is now convinced he is not entitled to receive the bonus. Letter was received from Ralph E. Cochrane advising that he is still interested in Lots 30 and 31 , Farmcrest Avenue, and he is willing to pay the price quoted by the Tax Board; i.e. , $300.00 for the two lots. title The Chairman said that Mr. Carroll had informed the Offer Clerk today that Lot 30 oannott be sold as he has not completed the foreclosure, due to the lack of clerical help. The Clerk was instructed to tell Mrs. Cochrane verbally that there would be a delay until the foreclosure had been completed. The lots may not be advertised until Mr. Carroll has completed the necessary details. The' Board felt that it would be all right for the Cochranes to use this land for a garden. The Clerk informed the Board that there were several Tax pieces of property that have been sold, as far back as Title November 1943,, and stall not recorded at the Registry, Offer due to the fact that necessary information has not been received from the Town Clerk. 465 Some of this property has been paid for and the purchasers are continuously calling the office inquiring as to when' Held the deeds will be ready. Over It was decided to have Mr . Carroll meet with the Board next Monday. The question came up as to whether or not after a piece of property has been advertised a higher price had Tax been received by the Board from an individual other than Title the original person interested. The Clerk informed the Board that Mrs. Yntas had made an offer for some land on Moreland Avenue, and a higher price had been offered from Henry DeVincent. Two lettershave been written to Mr. DeVincent relative to this property, but no reply has been received. Mr. Rowse moved that Mr. DeVincent be notified that unless a reply was received by May 1, 1944, the Board will consider that he is no longer interested in the purchase of Lots 340, 131-155, and Lot 20, on Moreland Avenue. Mr. Sarano seconded the motion, and it was so voted. The Board gave further consideration to Mr. Frank Cole's offer of 4150.00 for Lot 41, Kendall Road, Section 3, Tax Farmhurst. Title A proposal to sell this lot was advertised in the Sale April 13, 1944, issue of the Lexington Minute-Man. No persons cohtacted the Selectmen's Office as a result of the advertisement. Mr. Sarano moved that the offer be accepted, and that Lot 41, Kendall Road, be sold and conveyed to Mr. Frank Cole. Mr. Rowse seconded the motion, and it was so voted. The Board gave further consideration to Mr. J. Anthony Rochette's offer of 4250.00 for Lots 4 and 5, (Fair Oaks) Tax Marrett Road. Title A proposal to sell this lot was advertised in the Sale April 13, 1944 issue of the Lexington Minute-Man. No persons contacted the Selectmen's Office as a result of the advertisement . Mr. Sarano moved that the offer be accepted, and that Lots 4 and 5, Marrett Road, be sold and conveyed to Mr. J. Anthony Rochette. Mr. Rowse seconded the motion, and it was so voted. Mr. Sarano also moved to approve payment of the 050.00 as follows : 450.00 down payment now due; 450.00 quarterly thereafter until the total amount has been received. Mr. Rowse seconded the motion, and it was so voted. 1 1 466 41,4 Surety Bond #F-69897 issued by the American Employers' Tax Insurance Company in the penal sum of $50,100.00, on behalf Coil 's. of William S. Scamman as Collector of Taxes, was received. Bond Mr. Scamman's bond has been approved by Henry F. Long. Mr. Rowse moved that the bond be approved. Mr. Sarano seconded the motion, and it was so voted. The Chairman read a letter from the Citizens' Public PatriottsCelebrations Association of Boston relative to a resolution Day that has been introduced into Congress by Congresswoman Rogers Comm. asking that national recognition be given to Patriots' Day by "Authorizing and requesting the President of the United States to proclaim April 19 of each year Patriots ' Day for the commemoration of the events that took place on April 19, 1775." The Association suggested that the Board of Selectmen communicate with the Judiciary Committee in an endeavor to have this resolution taken from the files for perfecting action. Mr. Rowse moved that the Chairman be authorized to write a letter to the Judiciary Committee, Washington, D. C. as suggested. Mr. Sarano seconded the motion, and it was so voted. The Chairman read a letter from Albert G. Fbothingham to which was attached a program for the celebration of Patriot' April 19, 1944, together with a copy of the Governor's Day Proclamation. The Patriots ' Day Committee mese of the opinion that the Proclamation was so worded that it should not be read publically in Lexington. Mr. Rowse moved that it be left to the judgment of the Chairman as to what he would read at the noon exercises on April 19, 1944. Mr. Sarano seconded the motion, and it was sb voted. Application was received from Dr. Jacob Kaminsky Appl'n for the admission of Alice Sheffers, 14 Lisbeth Street, Midsx. to the Middlesex County Sanatorium. San. Mr. Rowse moved that the application be approved. Sheffers Mr. Sarano seconded the motion, and it was so voted. Held The appointments of a Board of Public Welfare and Over the Old Age Assistance Bureau were held over for one week. Upon motion of Mr. Rowse seconded y Mr. Saraxxo-, it Bd. of was voted to reappoint the following members• of the Board Fire of Fire Engineers for a term of one year, beginning May 1, 1944. Eng. George W. Emery, Alazl G. Adams, Robert J. Fawcett, Thomas J. Donnelly and William H. Driscoll. 467 . Mr. Rowse moved that Thomas G. Lynah be appointed Assoc. an Associate Member of the Board of Appeals for a term Member ending March 31, 1945, to fill the vacancy caused by the Board of 111 expiration of the term of Harold F. Lombard. Mr. Sarano Appeals seconded the motion, and it was so voted. Upon motion of Mr. Sarano, seconded by Mr. Rowse, it was voted to grant the following licenses : Alice M.
