Patrick. In that letter Mr. Patrick stated that he believes the Inn at Hastings Park(the "Inn") has violated its Special Permit(dated July 26, 2012) and its Memorandum of Understanding with the Town (dated May 9, 2012)by allowing wait staff to provide food and beverage service on the Inn porch. On June 21, 2017 you met with Board of Selectman Chairman Suzanne Barry and Town Manager Carl Valente to discuss this matter and explained that you would review this matter and respond to Mr. Patrick's complaint. On July 12, 2017 you provided a written response to Mr. Patrick's complaint in which you stated, in part: "...The Inn at Hastings Park was bought out for the weekend for a wedding celebration. Under the terms of our licensing, the Inn guests... may be served food and beverages throughout the property as they were on that weekend. The Inn does host events like these for both social and corporate clients who are guests at the Inn." The Board of Selectmen has reviewed your response and Mr. Patrick's original letter and, based on the recommendation of Ms. Barry and Mr. Valente, find the following: 1. Use of the Inn for functions is a permitted purpose under the Special Permit. 2. Consumption of food on the premises includes the porch. The Special Permit does not prohibit the serving of food outdoors. The serving of food outdoors, however, cannot include the serving of alcoholic beverages. 3. The Inn is permitted to serve alcohol only in the restaurant/dining room, the 22 guest rooms and the three sitting rooms in the Main Inn. 4. Alcohol service is not allowed on the Main Inn covered porch or patio. Alcohol service is defined as the placing of an order for an alcoholic beverage. 5. Alcohol consumption on the Main Inn covered porch and patio is allowed only if the alcohol service to the Inn Guest took place in the Main Inn sitting rooms and the Inn Guest transports such alcohol beverages to the Main Inn covered porch and adjacent patio. 1625 MASSACHUSETTS AVENUE•LEXINGTON,MASSACHUSETTS 02420 email selectmen@lexingtonma.gov The Board of Selectmen, therefore, has determined that the serving of liquor on the Inn porch or patio is not in compliance with the December 1, 2014 conditions of the Inn's Liquor License. Although the Board declines to take further enforcement action regarding this noncompliance at this time, we caution that future violations of the liquor license would be cause for the Board of Selectmen to hold a hearing on the alleged violations and determine appropriate penalties or enforcement measures. Patrick Building Commissioner's Office """'1 62017 2030 Massachusetts Avenue Lexington, MA 02421 June 5, 2017 Board of Selectmen Town Office Building 1625 Massachusetts Ave Lexington, MA 02420 Notification of Various Violations by Inn at Hastings Park Dear Board of Selectmen, In December and January I wrote to inform you of violations over the course of 2016 by the Inn at Hastings Park, related to their liquor license, the Special Permit under which the Inn operates and the Memorandum of Understand (MOU) the proprietor signed with the Town. Unfortunately I now find myself in the position of contacting you again to seek redress for further violations of these same conditions of operation, as well as new ones which have come to light. 1. Introductory Comments I will preface my points below with several comments: I.a. I take no joy in bringing these violations to light. I would much rather believe, no doubt as you would, that any business person in town would operate in accordance with the various regulations and agreements which govern their operations, especially the liquor license. I.b. I am informing you as is my right as an abutter to seek redress and responsive action from you as the governing regulatory and compliance body for the Town of Lexington. I.C. During the rezoning process the Board of Selectmen repeatedly assured abutters and the neighborhood that the MOU and the annual alcohol license renewal process provided an effective enforcement mechanism to ensure compliance with the conditions of the rezoning; and that the Board would hear and be responsive to complaints regarding violations, W. The Selectmen have made clear they require evidence of violations in order to initiate corrective action. I.e. I am therefore providing you with more documentation of violations which I witnessed on May 20, 2017. These are very similar to those in 2016 which I highlighted to you in correspondence in December 2016 and January 2017. 1 feel it is very important that you address this situation so that the Inn proprietor understands that such violations will not be tolerated this year and going forward. If. Service of Food on the Porch of the Inn Il.a. At mid-day on May 20th, while doing some yard work on my property, I observed food and beverage service by wait staff on the Inn porch. Knowing that the Se-le--ct-m-(-;n-require-e-�-la-en-c-e--oI violations, I discreetly took several photos and a short (16 second) video of service occurring on the porch of the Inn, while staying well away from guests and staff, (Please see Attachment 1 for photos and video stills from iPhone.) ll.b. Please note that three tables are fully set for service by wait staff with tablecloths, linen cutlery, glassware, high-backed indoor chairs, etc and that the images show a member of the wait staff serving guests. Il.c. I provide this evidence for the following reasons: Il.c.a. Food and beverage service on the porch is not permitted at all according to the conditions of the liquor license that you set, (The alcohol license allows overnight Inn guests only to carry out themselves an alcoholic beverage with a light snack such as a sandwich or cookie, and only until 9pm.) Il.c.b. With the Inn serving guests on the porch, the Inn is also violating the Memorandum of Understanding signed by the Selectman, as well as the DSDUP/Special Permit accorded AB Holdings, which limits the restaurant to 54 seats, Il.d. It is important to note that the current enlarged and covered front porch was not on the PSDUP/DSDUP plans submitted to Town Meeting nor the Special Permit hearing of the Board of Appeals. Il.d.a. On September 12, 2013 this significant change, along with numerous other substantive modifications, was approved by the Zoning Board of Appeals as a "minor revision" without abutter notification and without our knowledge. lLd,b. This would appear to violate the decision making requirements of the Massachusetts Zoning Act, Chapter 40, with regard to amendments (and the nature of the relief granted) and public hearing requirements. Furthermore, it appears that one of the members of the Zoning Board of Appeals who voted on the "minor revisions" was not present at the original hearing. Il.d.c. We only learned of the above in consulting the Registry of Deeds, when my wife and I sought to understand how the porch could have been enlarged to accommodate seating without encroaching into the front set back, Ill. Impermissible Use- Functions and Events Ill.a. That same evening of the 20th, I happened to see from my front windows that Inn staff were setting up several tables on the narrow expanse of lawn in front of the former Dana Home along Massachusetts Avenue. Later that evening, just before 9pm, a large wedding party gathered there, spreading on to the public sidewalk. Loud music was played-, the party- goers were given sparklers and people yelled and cheered during which time I believe the bride and groom danced in front of the Inn. There were a few loud announcements that the party would be moving inside, but the party continued for some time in front of the Inn. Ill.b. Functions and events are not among the Allowed Uses of the Definitive Site Development and Use Plan (DSDUP) which is part of the zoning. To gather evidence to submit to you, I crossed the street, walked past the Inn, along the public sidewalk, and took several images and a very short video clip with my iPhone. (See attached photos of Attachment 2.) Ill.c. I have recently learned from the Inn's website that a bedroom in the former Mulliken House has been converted into a meeting room called the "Salon," which can hold up to 15 individuals, at which food and beverages may be provided. In addition, the "Living Room" in the former Dana Home is also now being offered for rent to groups of up to 25 people. According to the Private Events 2017 page of the Inn's website, customers who rent out the "Living Room" for dinner on Friday and Saturday evenings must also reserve a minimum of 5 rooms at the Inn, so clearly not all customers at these events are required to be overnight Inn guests. (See Attachment 3 for pricing and Attachment 4 for photos of "Living Room" from Inn website.) Ill.d. Beyond the fact that these dedicated function rooms are not allowed per the DSDUP and that the liquor license accorded to the Inn does not extend to such function rooms, Ms. Kennealy herself stated before Town Meeting that: "The PSDUP limits the number of seats that we can have to 54, That is in the PSDUR that is the maximum number of seats that I can have, so any alcohol license that I apply for will be limited to 54 seats." (See LexMedia recording of May 9, 2012, at 2:03:44, of Ms. Kennealy's response to a question during Town Meeting consideration of Article 34.) III.e. As you may recall, during this Town Meeting, Ms. Manz, Chair of the Planning Board in the Board's report to town Town Meeting Members stated that, "With regard to function rooms, while function rooms are a permitted use in the zoning definition of "Inn", the interior plan for the buildings on this site, which are made a binding part of the PSDUP, do not include dedicated function rooms". (See LexMedia recording, at minute 49, of Town Meeting of May 9, 201Z) lll-f. The existence of such function rooms would also presumably have implications for the Certificate of Occupancy accorded the Inn and Board of Health regulations. Ill.g. It is certainly unlikely that the rezoning of the Inn would have successfully passed Town Meeting if functions had been permitted, as many members and residents already felt the intensity of the commercial use was not appropriate given the footprint of the rezoned property, the close proximity of private homes, and parking requirements. Ill.h. If one adds the 25 seats in the "Living Room", the 15 seats in the "Salon", the 54 seats in the restaurant and the 22 rooms of the Inn, parking is woefully deficient. It is inevitable that when functions occur, as one apparently did today, that customers who cannot find parking at the Inn will park on residential side streets, as several cars did during an event today. During a period of several minutes my wife and I witnessed at least 3 groups of partygoers park their cars near our driveway on Parker Street and cross the street to enter the Inn, carrying balloons for an event. Ill.i. Furthermore, functions displace other patrons into other areas of the Inn not authorized for food and beverage service. (Please see Attachment 5) IV. Alcohol Consumption Outside Permitted Areas IV.a. During the evening function in front of the Inn, some guests on the front lawn were drinking alcohol (see second photo in Attachment 2 with white arrows pointing to wine glasses). This is of course not a permitted area for consumption. IV.b. At the December 2016 liquor license hearing for the Inn at Hastings Park, I was advised by the BOS and the Town Manager that, were I to observe further violations of the liquor license, I should call the Lexington Police Department. While I considered doing this, I ultimately decided against it as it seemed terribly unfair to the young couple celebrating their wedding day to spoil their event by having it broken up by the police. It seemed less intrusive to gather photographic evidence from the adjacent public walkway. I hope that you will take very seriously the violations I have outlined above and in your capacity as the Board of Selectmen ensure that our regulations are fully complied with for the benefit of the entire community, Sincerely, John M. Ballots may be cast by one of the following ways: 1. By the CEO, in-person, on October 25, 21017 at MAPC Fall Council Meeting. I By Absentee Ballot, delivered by mail or in-person to MAPC by 5:00 PM the day before the election, October 24, 2017. I By a designee, in-person, on October 25, 2017 at MAPC Fall Council Meeting.
