The Department of Public Works would like to request a Noise Bylaw Special Permit in order to perform cleanup of the center area sidewalks and sidewalks along Bedford Street. This work cannot be done during the normal work hours due to heavy pedestrian and vehicular traffic. The requested time for the Special Permit is Mondays and Fridays beginning at 5:00am from October loth through November 26th for the sidewalks on both sides of Massachusetts Avenue, from Meriam Street to Woburn Street. We are also requesting a Special Permit for Patriot's Day prep activities Monday through Friday beginning at 5:00am from April 9th-April 20th on Bedford Street from the bikeway to Mass Ave and on Mass Ave from Meriam Street to Woburn Street. This level of noise pollution jeopardizes the health of our citizens and disrupts the sleep patterns of those near the center oftown, most importantly our school age children. The Bylaws require a special permit for use of such noise producing equipment outside the restricted hours. 0o special permit has been granted. |tis unclear why the DPW has proceeded without such a permit. It is our hope that the Board of Selectman will require the DPW to abide by the restricted hours of the Bylaws and protect the health and environment of the citizens of Lexington. For the past several weeks, every Monday and Friday, gas-powered leaf blowers have been going off at 5:00 AM, waking up the family. These appear to be sanctioned by the Town Manager's office who gave permission to DPW to start this early. It is my understanding that the town bylaws prohibit this sort of noise pollution before 7:00 AM, and that to our knowledge no exception has been publicly made for DPW to violate this prohibition. Can your office kindly look into the matter and either stop the leaf blowing at 5AM, or formally open this question up to a public debate? This will be the first of three meetings on setting the rate. On November 21st, the Selectmen are scheduled to conduct a tax classification hearing in anticipation of setting a tax rate at its meeting of December 5, 2016.At the meeting of December 5th, the Board must take four votes: Establish a residential factor(see Exhibit A); Determine whether to adopt the Open Space Discount; Determine whether to adopt the Residential Exemption and, if so, the percentage(up to 35 percent); Determine whether to adopt the Small Commercial Exemption At this meeting, the Board of Assessors will present the information in the Tax Classification packet which is attached. Lent, Director of Assessing Classification Presentation November 7, 2016 MEMO To: Lexington Board of Selectmen From: Lexington Board of Assessors Subject: FY2017 Tax Classification Process Date: November 7, 2016 This memo is intended to provide the Board of Selectmen with the necessary information to conduct a Public Hearing and Information Session on the tax classification options available under Massachusetts General Laws. The classification amendment requires the Board of Selectmen to consider four selections with respect to the setting the FY2017 tax rate. The decision of the Board for each alternative must be submitted to the DOR on form LA5. The four (4) selections are: 1. Selection of a residential factor 2. Selection of a discount for Open Space 3. Residential exemption 4. Small commercial property exemption 1. Selection of a residential factor. (Class 1: Residential; Class 2: Open Space; Class 3: Commercial; Class 4: Industrial, etc.) The Board of Selectmen may choose to adopt a residential factor, which will increase the tax rate applied to the commercial, industrial, and personal property (C-I-P) classes, up to a maximum factor (multiplier) of 1.750. Adopting such a factor will shift a larger portion of the overall Lexington tax levy to the commercial, industrial, personal property classes (CIP), thereby reducing the portion of the tax levy borne by the owners of residential property. Attached Exhibits A & Exhibit B demonstrate the effect that several possible "factor" choices will have by identifying the tax levy percentage borne by each classification of properties, and the resulting tax rates. Approximately 100 of the 351 communities in Massachusetts adopt this component of classification. 2. Selection of a discount for Open Space. Massachusetts General Law Chapter 59 Sec. 2A defines Class 2 Open Space as: "..land which is not otherwise classified and which is not taxable under provisions of chapters 61, 61 A or 61 B, or taxable under a permanent conservation restriction, and which land is not held for the production of income but is maintained in an open or natural condition and which contributes significantly to the benefit and enjoyment of the public." The Board of Selectmen may choose to adopt an exemption, discounting the assessed value of Open Space to a maximum of 25% for any property that is classified as Open Space. The Board of Assessors has not identified any property in Lexington that meets the definition of Open Space according to the statute. To our knowledge, Bedford is the only community in the Commonwealth of Massachusetts to adopt this exemption. Lexington Board of Selectmen Preliminary Tax Classification Hearing November 7, 2016 3. Residential exemption. The Board of Selectmen may choose to adopt a maximum residential exemption of up to 35% (in prior years, this maximum was 20%). If adopted, the tax relief would apply only to owner-occupied properties. The residential properties assessed below the "break-even valuation" point will realize a reduction in taxes while the residential properties assessed above the "break-even valuation" point must pay additional taxes to compensate. Non owner-occupied properties (including apartment buildings and vacant land) would have a substantial increase in taxes. Please refer to Exhibit H in this classification packet for details of the impact of the residential exemption if it were adopted. Fourteen communities in Commonwealth of MA, typically those with a substantial base of rental units, are currently offering this exemption including Barnstable, Boston, Brookline, Cambridge, Chelsea, Everett, Malden, Nantucket, Provincetown, Somerset, Somerville, Tisbury, Waltham and Watertown. In FY2017, Lexington's Single Family Dwellings have an average assessed value of approximately $932,000 (see Exhibit C); however, the average assessed value among all residential parcels - a component in calculating the distributional impact of the residential exemption - is approximately $867,000 (see Exhibit H). All residential parcels include single family dwelling, two & three family buildings, vacant land, condominiums, and apartment buildings. 4. Small commercial exemption The Board of Selectmen may choose to adopt a small commercial exemption of up to 10% of the property valuation to be granted to commercial (not industrial) property that meets the requirements of the law. To qualify, eligible businesses must have occupied the property as of January 1, must have had no more than ten (10) employees during the previous calendar year, and the property must have a assessed valuation of less than $1,000,000. While the eligible business does not have to own the property, all occupants of the commercial portion of the property must qualify. Again, the compensation for this exemption tax relief is borne within the other properties in the CIP class. Mr. Pato and Ms. Barry were re-elected at the annual election. The Board reorganized in May electing Ms. Barry chair and subsequently electing Ms. Ciccolo vice-chair. The Board of Selectmen is committed to balancing the interests of all of Lexington and continuing to ensure the Town remains a strong, diverse and healthy community. Fiscal Matters Lexington continued to maintain its positive financial standing. Property tax revenues rose due to new growth in primarily in the residential sector. Home prices have continued to rise rapidly during the year, and the housing market has been robust. Residential property values, however, grew faster than com- mercial values shifting some property tax burden from commercial to residential payers for a second year in a row. As a result, the Selectmen maintained the split tax-rate factor at its maximum to soften the impact on residential tax-payers. We have maintained our Aaa rating from our bond agencies, and our cost of debt is very low. The Se- lectmen kept their goal to have no operating overrides. The Selectmen have continued their policy to set aside a portion of revenues in a fund that would be used to reduce the impact of excluded debt and to support capital projects. Continued growth in the school-age population and the projections for more growth over the next several years may create budget challenges in future years. As a result, the Selectmen have recommended deferring several projects and have taken a more cautious approach to budget requests. Community Engagement Among the Selectmen's key goals is to work to sustain the social fabric that unites the town into a com- munity. Several issues this year have created the need to improve community engagement so that an informed public can engage in a productive civic debate. The Board has hosted public information and listening sessions on a variety of topics that have created strong and varied positions among residents. These have included traffic management for Massachusetts Avenue between Pleasant Street and Marrett Road; aesthetic and traffic management proposals for the center; concerns over proposals for gun ownership and gun violence. The Board strives to engage all Lexingtonians and provide the forums to allow public opinion to be voiced, heard, and explored. Lexington continues to become more ethnically diverse. This year the 2020 Vision Committee began outreach to similar communities in California and New Jersey that have had comparable changes in demographic makeup. Best practices for community engagement have been collected and will be re- ported on at the end of 2016. Land Acquisition and Use The new Community Center located at 39 Marrett Road began operation in the summer of 2015 and expanded service with evening and Saturday hours in the fall. The Grand Opening for the facility was on October 17, 2015 and featured the reading of the poem "The Building of Democracy - Room for Us All" by Lexington's resident poet Regie O'Hare Gibson. Renovations to Cary Memorial Building were completed and a Grand re-Opening held on October 24. DRAFT for review The facility has served expanded cultural programming since its reopening and provides greatly improved accessibility and sound quality for public meetings. Town Meeting authorized funding for the acquisition of the property at 20 Pelham Road, the site of the former Armenian Sisters' School and adjacent to the Community Center. At the close of fiscal year 2016 the Town continues to work toward reaching a conclusion to negotiations on the property. Capital Planning The Board continues to address the issues of maintaining and improving our capital infrastructure, including, but not limited to, our roads, water and sewer systems, parks and fields and buildings. The Board affirmed that its highest municipal priority is to pursue refreshed public safety facilities. In support of schools, the Town is following the revised Lexington Public Schools Master Plan in response to burgeoning school enrollments. In March Town Meeting appropriated just over $62 million to fund designs outlined in the School Building Consensus Plan to address overcrowding in the middle schools. In May the Town ap- proved a debt-exclusion referendum to support the projects at the Middle Schools and for the addition of modular classrooms at three elementary schools. Capital Planning in the face of municipal infrastructure needs and burgeoning school enrollment will be an ongoing challenge for the next several years. Sustainability In 2013 Town Meeting adopted a resolution to: (a) include climate change in all its decisions and planning processes; (b) take action to prepare for the impacts of a changing climate; (c) reduce greenhouse gas emissions; and (d) develop and implement a comprehensive climate action plan, all with the goal of making Lexington a truly sustainable community. The Town has moved forward with an aggressive deployment of solar panels on municipal and school buildings which was completed in the winter of 2014. Net savings from these installations during fiscal year 2015 were over$165 thousand about 11% more than expected. In addition the Town has proceeded with a ground-mounted solar installation and solar canopies project on a portion of the Hartwell Avenue Composting Facility. Completion of construction of this facility is expected in early 2017. Economic Development For many years now, the Board's policy has been to find ways to ease the burden on the residential taxpayer by developing our commercial sectors while balancing this development against any adverse impacts on surrounding neighborhoods. For the first time in 40 years a new building is being developed on Hartwell Avenue. Groundbreaking for the 91 thousand square foot addition to Lexington's life sciences hub occurred in October. "The Rev" a shuttle service from the Alewife T station to Hartwell Avenue businesses has continued to provide effective transportation for workers on Hartwell Avenue. Ridership on the shuttle has grown and pickup and drop-off of general commuters has been added in the center for what had been the empty return run of the shuttle. Transportation - to be completed Throughout the Town we have pursued several projects to improve multi-modal transportation and traffic safety. The rink consisted of a 65' x 100' open ice rink(this is a bit smaller than 1/2 the size of a regulation hockey rink)with 18" "��/i0 / /mil mN'An ivaoiaoYtfiWi// 5U boards to establish the perimeter of the rink. The winter last season was unusually warm with significant temperature variance, making both establishing the initial ice surface challenging, and making it difficult to maintain the rink. Despite the uncooperative weather, the rink was open from January 14th until March 1 st, a 6-week season. The rink provided a safe, fun, family friendly outdoor activity for many Lexington residents, but it also provided a scenic and wonderful experience for those simply driving into Lexington Center and enjoying the site of so many kids skating. We'd like to continue the Fletcher rink this season, keeping the Fletcher Park location and incorporating feedback from the users of the rink to provide Lexington Residents an even better outdoor skating experience this winter. I°dew ""'llll""Illhe III f irmlk Woirked Location The rink was located at Fletcher Park on Massachusetts Avenue near Lexington Center. This multi-use field hosts a variety of summer activities including the Farmer's Market and a barbeque festival, but sits largely unused through the winter. The field is of sufficient size to construct a rink that provides ice skating options for recreational skating. The field's proximity to Lexington Center provides additional customers to the Center as well as convenient access to Lexington residents. See the below map. I! li I l I• 4�''t �l Construction The Skate Lexington volunteer organization was responsible for providing the rink boards, brackets, liner and other materials. The brackets and boards were assembled in December in preparation for freezing weather. The Lexington Fire Department provided a hose along with access to a fire hydrant located on the edge of the field. The water department has approved our use of sufficient water from this hydrant to fill the rink at no cost to the community. Operation /Staffing The rink was unstaffed and unsupervised. Residents are required to bring their own ice skating equipment and show reasonable prudence in the supervision of children. Signage included hours of operation as well as "Skate at your Own Risk". Furthermore, rigid wooden snow fencing was setup to ensure that the rink was properly enclosed for safety purposes. Information and updates about rink status were made available at the website http:// www.skatelexington.com. Maintenance Essential rink maintenance consisted largely of clearing the ice surface of debris (fallen leaves, etc), clearing of snow from the ice surface, and occasional remisting and resurfacing. In this initial test year, we relied on volunteer efforts for rink maintenance. Wilat Woirked At the conclusion of the season, we surveyed Lexington residents to better understand what worked and didn't work about the rink in its first year. When asked what residents like the best about the rink, the most common responses were: - It's location near Lexington Center made access easy, provided a scenic entry to town, and spurred unplanned use and trips to Lexington Center and local businesses. - That it provided a free outdoor activity for families and kids. - That it fostered a sense of community both because the community driven nature of the rink, but also among the skaters on the rink. - Sample of positive responses: "We loved it!! When my kids and I went there, it was so wonderful to have a gathering place in the neighborhood where we could play outdoors in the winter and socialize with others. Even when we weren't using it, it gave me a lift every time I drove by it,just watching the rosy-cheeked children out skating. The most common responses were: - A larger rink to make it easier to mix new skaters with experienced skaters. - Improved quality of the ice surface - Easier/ better place to change into skates and access the ice surface - Longer hours - Better publicity of when rink is open and closed - Sample of responses: "Maybe night lights. We could only use the rink on the weekend as by the time we got home from work and had dinner it would be getting dark." "The ice was pretty rough, though it didn't seem to bother my kids. The most inconvenient part for me was the area around the rink was really muddy and difficult to traverse to get onto the rink. There was nowhere to sit to get skates on without having to walk through mud on skates. It might be helpful to have a bunch of rubber mats?" "Larger ring, longer hours, especially in the morning. Add fun music." The feedback about how we can improve is really exciting because it is centered on more and better access to skating and the quality of the rink itself. The feedback reinforces the appetite for a great experience while giving us areas to improve this year. For the second season of the Fletcher Rink, we propose to build the rink in Fletcher Park(the same location). We will install the brackets and boards purchased last year and plan to install a new liner, which will be provided by Skate Lexington. We request DPW assistance with this task, when and as they are available during regular business hours. Water access and hose will be provided by the Lexington Fire Department. We will continue operation of the rink as unsupervised and skate at your own risk. Snow removal will be handled by the Skate Lexington organization on a volunteer basis. We will continue a `no hockey' policy in order to provide a safe recreational skating experience and reduce the risk of flying pucks damaging cars. ll:)iro�posed ffllhain es feir 2016...2017 f easoin 1) Increase the size of the rink from 100x65 to 100x85. This will address one area of feedback, creating an additional 2000 sq ft. of skating surface. We've sized the site to insure that it will safely accommodate a rink of this size. We have funds available to purchase the additional boards and brackets to increase the size of the rink. 2) Improve access to the rink from the Municipal Parking Lot behind the rink. We already provide picnic tables for seating and changing into skates. This year, we'll look to provide rubber mats for walking from the picnic tables to the ice surface. We're also planning to provide a small ramp and reduced height section of boards at the entry to make access easier(and less damaging to the liner). We expect the total material cost to be less than $100. 3)Weekly Resurfacing Last year, rink maintenance was provided for on a volunteer basis only. We resurfaced the rink twice last season. After resurfacing, the skating surface was smooth and a great surface for skates. This season, we'd like to resurface the ice more frequently. This year we propose to work with the Lexington DPW to resurface the rink on an approximately weekly basis. Their time will be contingent upon their availability and would occur during O/T hours (early morning or late evening). The Skate Lexington organization would be responsible for paying for their tie. Expected time commitment to resurface the rink is 4 hours per resurfacing for 2 people with a cost of$30 per hour. With a weekly resurfacing and a season between 6 and 10 weeks, we anticipate a total cost of between $2,000 and $3,000. 4) Longer Hours We'd like to provide the option to skate later in the day, even when the sun has set. We're investigating solar powered lights that would provide enough lighting to allow skating past sunset. With the addition of sufficient lighting, we propose to extend evening skating hours until 8pm to allow families more access to the rink during the week. 5) Improved Signage The Skate Lexington organization will fund improved signage indicating whether the rink is open or closed. In addition, we'll better publicize the rink schedule which will be maintained and available on http L skatelexington.com. 6) More Formalized Snow Clearing Last season, we used a volunteer approach to clearing the ice surface. We all spent some fun evenings shoveling the surface and meeting a bunch of neighbors in the community who graciously brought shovels and cheerful dispositions. We expect snow removal to be a significant portion of the total rink maintenance again this winter, and so will be working to more formally organize the volunteer snow removal effort. Ideally, the boards and brackets would be installed prior to extremely cold temperatures.
