(Inserted by the Board of Selectmen) ARTICLE 2 LAND PURCHASE —171-173 BEDFORD STREET To see if the Town will vote to authorize the Selectmen to purchase or otherwise acquire, or take by eminent domain for municipal or school purposes, any fee, easement, or other interest in all or any part of land known as 171-173 Bedford Street and shown as Lot 76 on Assessors' Property Map 64, owned by the Liberty Mutual Insurance Company and to lease a portion of said land to Liberty Mutual Insurance Company or an affiliated entity thereof, subject to terms acceptable to the Selectmen; and for design, engineering and architectural services for plans and specifications and related costs; and to appropriate a sum of money therefor and determine whether the money shall be provided by the tax levy, by transfer from available funds, or by borrowing, or by any combination of these methods; or act in any other manner in relation thereto. (Inserted by the Board of Selectmen) FUNDS REQUESTED: unknown at press time DESCRIPTION: This article requests funding to purchase the property at 171-173 Bedford Street for municipal or school purposes and for engineering services related to the potential uses of the property by the Town. The article also provides for Liberty Mutual to lease a portion of the building back from the Town if it needs to do so on a short-term basis while its new space is being completed. ARTICLE 3 SUPPLEMENTAL APPROPRIATION FOR MIDDLE SCHOOLS — ADDITIONS AND REMODELING To see if the Town will vote to appropriate a sum of money, in addition to the amount voted under Article 2 of the Special Town Meeting 2016-3, for constructing, originally equipping and furnishing additions to the Clarke and Diamond Middle Schools and for remodeling, reconstructing and making extraordinary repairs to the existing Middle Schools, including original equipment and furnishings, and for the payment of all other costs incidental and related thereto; determine whether the money shall be provided by the tax levy, by transfer from available funds, by borrowing, as approved by the voters by referendum on May 3, 2016 pursuant to MGL Chapter 59, Section 21 C; or by any combination of these methods; determine if the Town will authorize the Selectmen to apply for accept, expend and borrow in anticipation of state aid; or act in any other manner in relation thereto. This Article is requested as a precaution in case bids exceed the amounts appropriated under Article 2 of Special Town Meeting 2016-3. ARTICLE 4 SUPPLEMENTAL APPROPRIATION FOR SCHOOL FACILITIES CAPITAL PROJECTS To see if the Town will vote to appropriate a sum of money, in addition to the amount voted under Article 2 of Special Town Meeting -1 on November 2, 2015 for: the Fiske, Hastings and Harrington Elementary Schools and the Clarke and Diamond Middle Schools; for design, engineering and architectural services for these projects; and for the related remodeling, reconstruction or making extraordinary repairs to these or other school facilities; for the construction of the buildings, including original equipment and landscaping, paving and other site improvements incidental or directly related to such remodeling, reconstruction or repair; determine whether the money shall be provided by the tax levy, by transfer from available funds, by borrowing, as approved by the voters by referendum on May 3, 2016 pursuant to MGL Chapter 59, Section 21 C; or by any combination of these methods; determine if the Town will authorize the Selectmen to apply for, accept, expend and borrow in anticipation of state aid for such capital improvements; or act in any other manner in relation thereto. ARTICLE 5 APPROPRIATE FUNDS FOR POLICE STATION FEASIBILITY STUDY To see if the Town will vote to appropriate a sum of money for studying the feasibility of siting, constructing and equipping a new police station; determine whether the money shall be provided by the tax levy, by transfer from available funds, or by borrowing or by any combination of these methods; or act in any other manner in relation thereto. ARTICLE 6 AMEND FY2017 OPERATING, ENTERPRISE FUND AND COMMUNITY PRESERVATION BUDGETS To see if the Town will vote to make supplementary appropriations, to be used in conjunction with money appropriated under Articles 4, 5 and 8 of the warrant for the 2016 Annual Town Meeting, to be used during the current fiscal year, or make any other adjustments to the current fiscal year budgets and appropriations that may be necessary; to determine whether the money shall be provided by the tax levy, by transfer from available funds, from Community Preservation funds or by any combination of these methods; or act in any other manner in relation thereto. Money in those funds may be invested and the interest may then become a part of the particular fund. These funds may later be appropriated for the specific designated purpose, by a two -third vote of an Annual or Special Town Meeting, for any lawful purpose. And you are directed to serve this warrant not less than fourteen days at least before the time of said meeting, as provided in the Bylaws of the Town. HISITAPR002S(917)X AGREEMENT NO. 96893 AGREEMENT, made this day of by and between the Commonwealth of Massachusetts, through its Department of Transportation, hereinafter called the "DEPARTMENT", and the Town of Lexington of the Commonwealth, hereinafter called the "TOWN", pursuant to the provisions of Title 23, Sections 109(d) and 116 of the United States Code and in accordance with the official standards of the DEPARTMENT which have been adopted in conformity with the provisions and recommendations of the Manual on Uniform Traffic Control Devices for Streets and Highways published by the Department of Transportation, Federal Highway Administration, hereinafter called "STANDARDS." WHEREAS, the DEPARTMENT proposed to reconstruct as a Federal Aid Project, portions of Massachusem Avenue, Pleasant Street, Marrett Road, and Maple Street, being ways under control of the TOWN in the County of Middlesex, with work to be financed in part by the Federal Government, and WHEREAS, the United States Government through its Deparbnent of Transportation, Federal Highway Administration, requires that the Project Area upon completion will be operated and maintained in a manner most adequate for anticipated traffic volumes and for the safety and convenience of pedestrians and vehicular traffic and shall be adequate to ensure the most efficient utilization of highways, bridges, or other facilities; and WHEREAS, the TOWN approves the proposed plans for improvements and upon completion of the project, Massachusetts Avenue, Pleasant Street, and Maple Street within the Town of Lexington will be the responsibility of the TOWN. NOW THEREFORE, in consideration thereof, the DEPARTMENT and the TOWN hereby agree each with the other as follows: GENERAL PROVISIONS— TRAFFIC DEVICES All information, traffic control signals, regulatory or warning signs, allpavement or other markings, or other traffic devices shall be designed, located and operated and maintained in accordance with the standards for such devices. The Police Department of the TOWN is the enforcement agency for traffic regulations established in accordance with this Agreement and the traffic devices installed in connection therewith. Signed dated and attested copies of Ameniftnents to the TOWN traffic Rules and Regulations necessary for the enforcement of any specific provisions will be forwarded forthwith by the TOWN to the DEPARTMENT. Traffic Control Signals, the operation of which is pertinent to the Federal Aid Project area covered by the Agreement, are located to control traffic as shown on the plans for this Federal Aid Project. D. The TO W7V shall have ownership, control, maintenance and operational responsibility for the traffic control signals located at. Massachusetts Avenue& Pleasant Street Massachusetts Avenue & Maple Street Massachusetts Avenue& East Lexington Fire Station MISCELLANEOUS Traffic controls or regulations instituted whether by the DEPARTMENT or the TOWN on ways or parts thereof within the Federal Aid Project are to remain in force and effect until proposed future changes have been approved in writing by the DEPARTMENT. The DEPARTMENT will not approve any future proposed traffic control changes within the Federal Aid Project which will in the opinion of the DEPARTMENT, lessen to any degree the efficient utilization of the highway for traffic purposes. MAINTENANCE The TOWN, in accordance with the provisions of Sections 109(d) and 116 of Title 23 United States Code, will properly maintain the way and all traffic signs and pavement markings under the control of the TOWN within the project area. Continued and willful failure on the part of the TOWS' to fulfill its responsibility in the proper maintenance and operation and the enforcement of the traffic regulations of the completed project, may disqualify the TO KAftom participation in future Federal Aid Projects in which the TOWN has maintenance responsibility, as provided in Title 23 USC. Such failure shall result in the withholding or withdrawal of the unexpended balance of any funds assigned to the TOWN, under the provision of Chapter 90, Section 34, of the Massachusetts General Laws.
