Parker Room, Town Office Building 1625 Massachusetts Ave Chair Philip Hamilton opened the meeting at 6:32pm in the Parker Room of the Town Office Building Commissioners Present: Phil Hamilton, Alex Dohan, Dick Wolk, Duke Bitsko Others present: Casey Hagerty, Conservation Department Assistant 6:32pm Approval for Expenditures from Lexington Nature Trust up to $400 Motion to approve Expenditures from Lexington Nature Trust made By Mr. Wolk and seconded by Ms. Dohan. Vote: 4-0 in favor. Issue Order of Conditions: DEP 201-1087, BL 1044 Old Res Dam Motion to issue Order of Conditions made by Ms. Dohan and seconded by Mr. Wolk. Vote: 4-0 in favor. Issue Order of Conditions: DEP 201-1088, BL 1045, 246 Worthen Road East Motion to issue Order of Conditions made by Ms. Dohan and seconded by Mr. Wolk. Vote: 4-0 in favor. Vote: 4-0 in favor. 6:35pm Review Draft Buffer Zone Performance Standard Section 5(5) Amendment Proposal This will be discussed at the next meeting. Approve minutes from 1/22/2018, 2/5/2018 meeting This will be reviewed at the next meeting. Schedule Site Visits for the 3/5/2018 Meeting Site visits were scheduled for Saturday 3/3/18 at 9am. Planning Board project comments Nothing to report. 6:42pm Motion to enter and exit executive session to consider the purchase, exchange, taking, lease, or value of real property if such discussion may have a detrimental effect on the negotiating position of the governmental body made by Mr. Wolk and seconded by Ms. Dohan. Vote: 4-0 in favor. 6:43pm Request to amend Order of Conditions: 24 Hancock Street, DEP 201-1020, BL 977 Ms. Hagerty explained that there are some issues with the drainage system for this project. The applicant wants to know whether the commission will hear the changes as an amendment or as a new filing. The commission stated they are open to hearing this as a new amendment. 6:57pm Continued Hearings DEP 201-1089, BL 1043 NOI, 45, 65, and 75 Hayden Ave Owner/applicant: King Street properties Project: New office building, garage, and associated site work Mr. Duke Bitsko stated that he did watch the LexMedia video for this hearing from 2/5/2018. Doug Hartnett- High Point Engineering, Rob Alborw- King Street Properties, John Rockwood- Wetlands Scientist Documents: Site Plan 2/16/2018, Consulting review services memo 2/19/2018, 2/20/2018, Pre and post development runoff analysis 2/20/2018, Test pit data 2/20/2018 Mr. Hartnett explained that since the last meeting they have adjusted the plans to reflect the peer reviewer's comments. They have also done a test pit and submitted that data to the commission. Mr. Hartnett explained that the concerns of the commission have also been incorporated into the new plans which include moving drainage structures out of the 25 ft. buffer, one year volumes were provided, trail head parking material was changed, and information on footbridge piers. Mr. Curt Busto, CEI Engineering and Town Peer Review Engineer, explained that his concerns regarding the project were addressed by High Point Engineering. He did explain to the commission that at each outfall, the one year volumes are not evenly dispersed, but on the overall site they are. The commission stated it is acceptable. Questions and comments from the Commission: The commission discussed the shadow study. They stated that they would like three years of monitoring in the area of the shadow to ensure that there is no change to the wetlands. If change is discovered, the applicant will have to present a restoration plan. Motion to close the hearing made by Ms. Dohan and seconded by Mr. Wolk. Vote: 4-0 in favor. 7:27pm New Hearings DET 18-3 RDA, 12 Cooke Road Owner/applicant: Mr. and Mrs. Thomas Libretto Project: New pool installation Erich Nitzsche-project engineer, Thomas and Lisa Libretto- homeowners Documents: Site plan 1/25/2018, RDA package 1/26/2018, Stormwater report 1/25/2018 Mr. Nitsche explained that the applicant is proposing to build an in ground pool in the rear of their property. The pool will be outside of the 100 ft. buffer. The only work within the buffer will be the removal of two trees. There is an infiltration system that will be installed to mitigate for the pool and its deck. Questions and comments from the Commission: The commission asked for clarification regarding the infiltration system. The commission question the ground water level and location of the pool. Mr. Nitzsche stated that a portion of the pool will be within the groundwater but there will be no noticeable difference to neighbors or environment. The commission stated that they would like to see some native trees planted within the 100 ft. buffer because of the removal of two native trees. The applicant agreed. Questions and comments from the audience: Kenneth Haydo. 14 Cooke Road, stated that he is concerned about flooding in the area. He is also concerned about how water will be contained during construction as well as what will happen to the water when they need to drain the pool. Mr. Nitzsche explained to the neighbor that the pool will have effect on the groundwater and will not cause an increase in flooding. During construction, they will use proper dewatering techniques if needed. Thomas Libretto explained that will a gunite pool, there is no need to drain it. However, if they do need to drain it for some reason, they will call a pool company to pump it into a truck. The commission stated that they want to hear from a pool company regarding techniques for draining the pool. Motion to continue the hearing to 3/5/2018 at the applicant's request made by Mr. Wolk and seconded by Ms. Dohan. Vote: 4-0 in favor. 8:07pm DET 18-4 RDA, 116 Burlington Street Owner/applicant: Seaver Construction Project: Raze and Rebuild SFD Mary Trudeau- wetlands scientist Documents: RDA package 1/28/2018, Proposed site plan 1/28/2018 Ms. Trudeau explained that her client is proposing to demolish and rebuild a single family home outside of 100 ft. buffer. She has delineated the wetlands on site and a limit of work outside of the 100 ft. buffer has been established. Questions and comments from the commission: The commission asked if the erosion control can be moved further from the buffer in certain areas. Ms. Trudeau stated that it can and she will make the change. The commission stated that there were variations in plans between what was submitted to them and the building department but those changes have been resolved. The commission stated that they are concerned the driveway will not be able to meet the zoning code of a max of 12% grade. They are concerned that the house will have to be pushed closer to the wetlands in order to make the grade. Ms. Trudeau stated that her client is aware that they will have to go back to the commission with any proposed changes. Ms. Hagerty stated she will check with the Town Engineer and Building Commissioner to ensure the driveway slope was reviewed and approved. Motion to issue a Negative Determination with conditions made by Mr. Wolk and seconded by Ms. Dohan. Vote: 5-0 in favor. 8:26pm DEP 201-XXXX, BL XXXX NOI, 7 Ledgelawn Ave Owner/applicant: Jian Shao Project: Raze and rebuild SFD Mary Trudeau- wetlands scientist, Scott Henderson-project engineer Documents: NOI package, Stormwater report 1/8/2018, Plan of Land 1/8/2018 Ms. Trudeau explained that her client is proposing to raze and rebuild a single family home. On the site there is both wetlands and riverfront area. She explained that because of zoning restrictions, they were somewhat limited as to where they could place the house as well as the size of the house. The proposed house is right up to the 50 ft. buffer. A stormwater management plan is proposed. Mr. Henderson added that they will do additional test pits during construction. Mr. Hamilton entered the engineering report into the record. Questions and comments from the Commission: The commission stated that the applicant will have to submit an alternatives analysis because the project is within the riverfront buffer. The commission stated that they are uncomfortable with the location of the house relative to the 50 ft. buffer. The commission stated that they measure their setbacks from the overhangs, not the foundation. The commission stated that a test pit will need to be done in the proposed infiltration area before construction. If something changes, they will have to come back to the commission with the changes. Motion to continue the hearing to 3/5/2018 at the applicant's request made by Mr. Wolk and seconded Mrs. Dohan. Vote: 4-0 in favor. Continued Hearings DEP 201-1090, BL 1047 NOI, 22 Longfellow Owner: Ozan Dokmecioglu Applicant: John Degnan Project: Home addition Documents: Proposed site plan 2/6/2018 Mr. Hamilton explained that this project was just waiting for an updated plan with some minor changes which the commission received. Motion to close the hearing made by Ms. Dohan and seconded by Mr. Wolk. Vote: 4-0 in favor. Motion to issue the Order of Conditions made by Mr. Wolk and seconded by Mr. Bitsko. Vote: 4-0 in favor. DEP 201-1084, BL 1041 NOI, 23 Coolidge Road Owner/Applicant: Timothy and Lauren Weeks Project: Home addition and associated site work Motion to continue the hearing to 3/5/2018 at the applicant's request made by Mr. Wolk and seconded by Mr. Bitsko. Vote: 4-0 in favor. DEP 201-1089, BL 1046 NOI, 20 Cooke Road Owner/applicant: 20 Cooke Road LLC Project: Raze and rebuild SFD Chi Man- Harvey Engineering Documents: Plan to accompany filing 2/12/2018 Mr. Man explained that his wetland scientist has submitted a restoration plan.
