Request to approve conservation area poison ivy management – Turning Mill Pond
Ms. Erica Herrera, Assistant Conservation Director, presented and stated that Turning Mill Pond
will be the initial site for poison ivy management due to its small size. The company that will be
hired for this project is Cooper’s Poison Ivy Service. Ms. Herrera stated that the proposal
includes treatment two to five feet from the trail depending on the cover and that there are seven
trees onsite with extensive poison ivy coverage. The management plan consists of an initial foliar
treatment using Aquaneat. More dense patches would be sprayed, and retreatments/spot
treatments will be done over one year.
Ms. Ladd asked for further information about Aquaneat. Ms. Herrera stated that the formulation
is comparable to Roundup but it degrades rapidly and is recommended as less harmful for
aquatic invertebrates and sensitive areas. Signs have already been posted onsite and the site has
been flagged as well.
Mr. Whelan asked if the treatment will only include treatment of poison ivy as there are
extensive amounts of knotweed along the trail as well. Ms. Herrera stated that this will only be
for poison ivy management now and in the future may check for usage for management of
invasive species.
Ms. Dohan asked to confirm the treatment will only be along the existing trail. Ms. Herrera said
the treatment will only occur along the existing trail onsite.

vote to approve the poison ivy management plan for Turning Mill Pond.

Request to approve sampling of bees at Parker Meadow for PhD thesis work – Elyse Talley,
Rutgers
Ms. Erica Herrera, Assistant Conservation Director, presented and stated that Rutgers University
PhD Student Elyse Talley is studying the population connectivity and movement of carpenter
bees between urban and rural areas. Ms. Talley is requesting permission to collect samples of
fifteen to twenty bees each at Parker Meadow and Whipple Hill for analysis. Samples would be
collected by hand along the trails.
Mr. Hnatko asked how the bees will be collected. The bees will be collected by a small net and
transferred into microcentrifuge tubes.

vote to approve the sampling of bees at Parker Meadow and Whipple Hill.

Review licensing for goat grazing at Chiesa Farm
Ms. Hale Schatz, 8 Goodwin Road, presented and Ms. Laurene and Mr. Eric Beaudettte, 10
Grove Street, were also present. Ms. Schatz stated that the signs have been updated onsite and
mowing has been more consistent onsite. Ms. Schatz stated that the herbicide applications have
hindered the goats grazing onsite.
Ms. Ladd asked if there are other locations in Lexington that would be benefit from goat grazing.
Ms. Schatz stated that prior to the Covid pandemic, there were more sites the goats would graze
and new locations would require further public education of the goat grazing and would be
welcomed by the applicants.
Ms. Schatz stated that the Health Department has stated the Conservation Commission permit is
required prior to the release of their health permit. Ms. Herrera stated that she would verify the
reasoning with the Health Department. Ms. Ladd stated that the permit as proposed has only
been issued as valid for six months and asked if staff are able to change this to a full year. The
permit expiration will be changed to allow for the permit to remain valid for one full year.
On a motion by Mr. Whelan and seconded by Ms. Dohan, the Commission voted 4-0 by roll call
vote to issue the license for goat grazing on Chiesa Farm through June 30, 2026.

Mr. Rong Chen, 16 Foster Road, presented and stated that due to safety concerns he is requesting
to remove five oak trees in the front of his property. Ms. Ladd stated that a deck was built onsite
in the rear without permitting which must be addressed through enforcement. Ms. Ladd asked
what materials were used for the deck. The deck is made from composite wood.
Ms. Dohan stated that the deck is not raised and is no larger than the patio that was previously
there. Mr. Whelan was present at the site visit and agrees with Ms. Dohan’s observations. Ms.
Ladd stated that mitigation should be provided, such as plantings.
Mr. David Sperduto, Wetlands Identification, presented on behalf of multiple abutters on Foster
Road. Mr. Sperduto stated that the trunks of four trees cut previously onsite have been placed
and left within the wetlands behind the dwelling. He has requested that the Commission ask the
applicant to remove the tree trunks that were placed within the wetlands.
Mr. Bert Reuss, 12 Foster Road, expressed concern for the pile of trunks in the backyard and
echoed Mr. Sperduto’s comment that the trunks should be removed from the wetlands. Mr. Chen
stated that he was previously told by the former Conservation Coordinator to leave the trunks in
the wetlands as it is good for the environment. Ms. Ladd stated that only trees growing within the
wetlands should be left there and trees outside of the wetlands should not be transferred to the
wetlands.
The Commission requests a second arborist report as the trees proposed to be removed appear
healthy.
On a motion by Ms. Dohan and seconded by Mr. Whelan the Commission voted 4-0 by roll call
vote to continue the hearing to 8/12/2025, at the applicant’s request.

Mr. Richard Kirby, LEC Environmental, presented and stated that a vegetation management plan
is proposed to manage the invasive species onsite and overall management of the vegetation
onsite. Mr. Kirby stated that the proposed accessory dwelling unit already approved by the
Commission is currently under construction. The approximated flood zone has been included on
the plans based on the 2025 flood zone maps. Mr. Kirby stated that native plants will be selected
based on their location on site for best survivability and that invasive plants will be removed by
hand.
Mr. Whelan asked who will be doing the invasive species removal onsite. Mr. Kirby stated that
the property owner, Charles Hornig, will conduct the invasive species management onsite. Mr.
Hornig stated that he will be hand removing the invasive species onsite incrementally.
Ms. Lisa Newton, 15 Ledgelawn Ave, asked if there will be a timeline for completion on this
project. Mr. Kirby stated that there is no end date for this project and the project will be
monitored for three years. Mr. Hornig stated that this will be an ongoing effort indefinitely and
beyond the three years required.

Mr. Marc Alencar, MP Design Consultants, presented and stated that the project had previously
been approved in 2024 by the Commission through a Notice of Intent application. The proposed
changes include a floor level maintained between the existing dwelling and the addition, and the
previously approved deck will no longer be present. Mr. Alencar stated that the stormwater
calculations remain the same. Ms. Ladd asked what the length of the overhang of the addition is.
The overhang length is sixty-six feet and seven inches.
The Town Engineering Department did not provide engineering comments prior to the hearing
which are required prior to closing the hearing.

Mr. Richard Kirby, LEC Environmental, presented and stated that the requested changes include
expansion of the driveway to fit two cars and a permeable paver patio in the rear of the dwelling.
The planting plant and restoration footprint have been expanded from the previously approved
plans. Mr. Kirby stated that the owner will decide which native plants they will install along the
restoration area and recommends larger plantings to help prevent walking within the restoration
area.
Ms. Ladd asked to clarify if there is peat underneath the permeable patio. Mr. Kai Yin Yip,
project engineer, stated that the unsuitable materials will be removed and replaced with Title 5
Sand. Mr. Kirby stated that the peat can be conditioned to be removed and the applicant can
provide before and after photos of the location. Ms. Ladd expressed concern that the peat
removal would impact the restoration area due to the proximity of the restoration area to the peat
removal site. Mr. Kirby stated that the removal of the peat should not impact the restoration area
because the plantings have not been installed yet.
Mr. Kirby stated that there has been discussion regarding the electrical line trench being
excavated further to connect the conduit to an existing utility pole across the street. A separate
Notice of Intent filing would be required for the electrical connection.

Mr. David Sperduto, Wetlands Identification, presented and stated that the watershed plans have
been revised to address concerns expressed in the previous hearings. The proposed plans have
revised the stormwater runoff to now divert to two locations, towards Concord Ave and to the
back corner of the property.
Ms. Ladd stated that the Wetland Lines and Buffer Zone lines do not match on the latest
submitted plans and revised plans must be submitted prior to the issuance of the Order of

The site visits will be scheduled for Tuesday 8/5/2025 starting at 5:30pm.
Reports: Bike Advisory, Community Gardens, Community Preservation Committee,
Enforcement Updates, Greenway Corridor Committee, Land Acquisition, Land Management,
Land Steward Directors, Tree Committee
Ms. Herrera reported that there have been wetland violations occurring at 7 South Rindge
Avenue in which the owner has reported trees and vegetation from the abutting conservation area
have encroached on the property. The owner has undergone extensive landscaping onsite which
is within the 100-foot wetlands buffer zone and 200-foot Riverfront area. A cease and desist
letter will be sent to the applicant. The Commission agrees an enforcement order would be
required for this violation.
On a motion by Ms. Dohan and seconded by Mr. Whelan, the Commission voted 4-0 by roll call
vote to issue the enforcement order.
