HomeMy WebLinkAbout280 Deed, Benjamin and John Muzzy to the Town of Lexington, February 1, 1722To all People to home these presents shall come Greeting, know yee that we Benjamin Muzzy [Muzzey] hus= bandman, & John Muzzy Inholder, both of Lexington in ye county of Middlesex in ye Province of ye Massachusetts Bay in New England, for & in consideration of five & twenty pounds Currant money of New England to us in hand well & truly paid by ye Inhabitants of sd: Town, the receipt whereof we do by these presents acknowledge to our full satisfaction & of & from every part & parcel thereof do fully and absolutely and for ever aquitt ye said Inhabitants, & their successors, Have Given, Granted & Confirmed, & do by these presents Give Grant, bargain, sell, Aliene, enfoeff, Convey & Confirm to the said Inhabitants of Lexington & their succession one acre of Land lying near ye Schoolhouse in sd: Town, as an addition to ye Common land ye town purchased of sd: Benjn Muzzy, bounded easterly by a highway from Mr Hancocks to ye meeting house six rod & one quarter, southerly on ye common land twenty eight rod, & Southwest on Concord road eight & a hlf, & northwesterly on sd: Benjn, & John Muzzy, a strait line, & heap of stones at each corner, To Have & to Hold sd: Lands with all ye profitts, priveledges & Conveniences to ye same belonging unto the sd: Inhabitants & their successors, & to their only use benefit & behoof for Ever. and we the sd: Benjn & John Muzzy do hereby Convenant & engage that at ye executing of these presents, we are the sole & proper owners of ye above bargained premesis, & that ye same are free & clear acquitted & discharged of & from all other & former gifts, grant bargains sales, leases, mortgages Thirds, Intails & Incumberances whatsoever. & yt [that] it shall & may be lawfull for the Inhabitiants of sd: Town, & their Succesors at all time for ever hereafter to Have hold, use Improve occupy possess & enjoy ye same peaceably & quietly, wthout ye Lawfull Lett, Suitt, Denial or Contradiction of ye sd: Benjn: & John Muzzy our heirs, exec: or Admines: or any other person or persons by from or under us or our procurement. And the sale hereof as above sd: we will for ever warrant & Defend from all manner of persons making any Lawfull claim thereunto & will make perform & execute all such other and further act & acts for ye confirmation hereof to sd: Inhabitants & their succesors as in Law or Equity can be devised, advised or required. In witness whereof we ye sd: Benjn: & John Muzzy have hereunto put our hands & seals this first day of February Anno Dom: one thousand seven hundred & twenty one, two in the eight year of his majs Reign Benja Muzzy John Muzzy signed, sealed & & delivd in presence of John Major Benja Whittmore Middlesex February 1st 172 1/2 Benjamin Muzzy and John Muzzy the the granters named on the other side of this paper personally appearing acknowledged the Instrument written on the other side of this paper to be their volantary act and deed Before me ffrancis Bowman Justice of peace.
