To see if the Town will vote to accept Chapter 191 of the Acts of 1907, authorizing the establishment of Boards of Survey in Towns, or act in any manner relating thereto." The meeting of April 29 was adjourned to May 12. 1911, on which date the following vote was passed : — "Voted, that the Town hereby accepts Chapter 191 of the Acts of the General Court of the year 1907." See Town Records, Vol. 13, page 348 for above vote. Section 1 of Chap. 191 reads as follows : — "The Selectmen of any Town which accepts the provisions of this Act shall constitute a Board of Survey for that Town." Charles W. Swan Clerk. 2 March 22, 1912. At a meeting held this evening, Messrs. Peirce, Childs and Bliss were present. Berwick St. petition. A petition with plan was received from Arthur A. Marshall and others, asking that Berwick St be accepted as a public way. Street index 1-160 The petition was laid on the table for future consideration. April 15, 1912 At a meeting held this evening, Messrs. Peirce, Childs and Bliss were present. Berwick St Slocum Rd notice of Hearing It was decided that the Board would give a Public Hearing on Friday May 3rd on the petition of Arthur A. Marshall and other for the laying out and constructing of Berwick Street. Street index 1 - 160 1 - 162 Also on the petition of William Hunt and others for the laying out of Slocum Road. A true record Attest Charles W. Swan Clerk. 3 May 3. 1912. At a meeting held this evening Messrs. Peirce and Bliss were present. Berwick St Slocum Rd Hearing delayed. In relation to the hearing on the acceptance of Slocum Rd and Berwick St., called for this evening, it was found that the newspaper had failed to insert the notice of hearing as ordered and as required by law, consequently no hearing was held. It was decided to call another hearing on May 24, and that notice should be inserted in the Minute Man of May 11 and 18. Street index 1 - 162 A true record, Attest Charles W. Peirce, Childs and Bliss present Slocum Rd Plans approved Street index 1 - 162 The Board gave public hearing on the petition of William Hunt and others for the approval of the lay-out and grade of Slocum Road, so called, from Massachusetts Ave. to Highland Ave, as shown on plan submitted and now on file. The plans were approved. Berwick Rd adjourned Street index 1 - 160 A hearing was also given on the petition of Arthur A. Marshall and others for the approval of the layout and grade of Berwick Road from Hayes Avenue to Merriam Street. The plans were returned to Mr. Marshall in order that certain changes might be made in the grade, and the hearing was adjourned for one week. A true record, Attest: Charles W. Slocum Rd approved. Street index 1 - 162 Plans showing the lay-out and grade of Slocum Road leading from Massachusetts ave to Highland Ave. were approved by the Board, and the same deposited with the Town Clerk. A true record Attest Charles W. Swan Clerk 6 October 11. 1912 Messrs. Pierce, Childs and Bliss present Fletcher Ave. Petition for approval of grade. Edwin M. Hall presented a petition with plans asking for approval of the grade of a private way called Fletcher Avenue leading off Woburn street near its junction with Mass. Ave. The proposed grade is shown on the plans, The Board decided to hold a public hearing on the petition on Friday evening Nov. 1, 1912 at eight P. M. when duly petitioned for. A true record Attest Charles W. Swan Clerk. 7 Nov. 15. 1912, Vine St petition for location of bounds. Michael J. McDonnell and others presented a petition asking that the bounds and lines of Vine street be set and established. The petitioners also requested that something be done to improve the condition of the street. Street index 1-166 The Board decided to view the premises and decide later what should be done. A true record Attest: Charles W. Swan Clerk. 8 Meeting Nov. 29. 1912 Vine Street Frank P. Cutter presented a plan showing the present lay out of Vine street. Plans presented The plan was discussed by the Board and Mr. Cutter was directed to prepare a plan showing a forty foot lay out. It was decided to give a public hearing on the petition to locate and establish the bounds of this street which was received on Nov, 15. Date of hearing Friday Dec 20, at 8 P. M was set for the date of hearing, public notice to be given by publication of the time and place in the Lexington Minute Man on Dec 6 and 13. Street index 1 - 166 A true record Attest Charles W. Swan Clerk. 9 Meeting Dec. 13. 1912 Vine Street Plans. Frank P. Cutter presented plans of Vine street showing a forty foot layout as directed at last meeting. Vine St Public Hearing Public Hearing on Vine Street. Meeting called to order at 8 P. M. All Members Present. The Chairman stated that this greeting was a Public Hearing called under Chap. 191 of the Acts of 1907 in answer to the petition of Michael J. McDonnell and others to have the bounds and lines of Vine street established. Michael J. McDonnell stated that it was the desire of the petitioners to have the street lines established and also that some work be done to improve the condition of the road bed. Plans were submitted by the Board showing a 40 foot layout and were examined by those present and explained by the Chairman. Street index 1 - 166 No person spoke in opposition, and the Hearing was declared closed. A true record. Attest Charles W. Swan Clerk. 11 Meeting Jany. 10. 1913. Vine St Plan discussed The plan of Vine street was placed before the Board showing the definite layout. It was voted to give a public hearing Feb. 21st in accordance with Act of 1907, Chapter 191, Sec. 3, and plan was placed on file with Town Clerk. A true record Attest George H. Childs Clerk pro-tem. 12 Meeting February 21, 1913 Vine St. Second Public Hearing Second Public Hearing on Vine Street. Meeting called to order by Chairman Peirce at 8.05 P.M., ten citizens being present. See page 14 for record of approval of plan Patrick Mulvey asked if the citizens were notified of the hearing and was informed by the Chairman that the first hearing was held Dec. 20, and that notice of hearing was advertized in accordance with Chapter 191, Acts of 1907. Mr Charles Spaulding spoke in favor of the survey and explained that he thought if the improvement was carried out it would be a benefit not only to Vine Street, but to the whole Town, and would tend to increase the income to be derived from taxes on property that will be developed in the future. Eugene D. Buckley spoke in favor of the survey saying he signed the petition, and hoped the improvement would be made. Mr. McDonald said he thought the change would be a good thing for the town, and while it might hurt him personally he favored having the improvement made. 13 Mr. Buckley called attention of the Board to a dead oak tree on the property of Mrs. Bridget Leary, and suggested that it be removed on account of the danger of limbs falling on persons using the highway. Childs Clerk pro. tem, 14 Meeting February 28. 1913 Vine St. Plan approved A plan showing the lay out of Vine Street was approved by the Board and signed by them and then delivered to the Town Clerk in accordance with Chap. 191 of the Acts of 1907. Oakland St Extension considered Plans showing an extension of Oakland Street were examined by the Board at the request of Joseph N. Leonard, who requested information as to how he should proceed to have said street accepted as far as Marriott street [so called]. The Board directed that the following letter be sent Mr. Leonard : — "The Board of Survey at a meeting held Aug. 29 considered your application for the extension and acceptance of Oakland street to so called Marriott street, and an unnamed street. The Board does not think it advisable to accept a portion of this street, but if a plan and profile of proposed street from its present terminus to Merriam St. is presented, the Board will take the matter under consideration. The Board desires to call your attention to Chapt. 191 of the Acts of 1907 which was accepted by the Town at a meeting held May 12, 1911" Street index 1 - 10 A true record, Attest Charles W. Swan Clerk. 16 Meeting Sep. 19. 1913. Oakland St extension to Merriam St. Petition presented. A written petition was received from Joseph N. Leonard asking that the Board approve the plan and profile of Oakland street as presented in accordance with Chapter 191, Acts of 1907. Public hearing ordered It was decided to give a public hearing on the above petition in Cary Hall on Friday Oct, 11 at eight P.M. Oakland St premises viewed The chairman reported that two members of the Board in company with Engineer Cutter had viewed Oakland Street from its present terminus to Merriam Street. A true record, Attest. Charles W. Swan Clerk. 18 Meeting October 10, 1913. Oakland St. Public hearing This meeting was called for the purpose of giving a public hearing on the petition of Joseph N. Leonard for the acceptance and approval of a plan filed with the petition showing lay-out and grade of Oakland Street from its present terminus to Merriam Street Messrs. Whitney and Blake, abutters on the proposed extension stated that they had no objection to the plan presented. The hearing was declared closed and the question considered. Plans approved, & filed with Town Clerk. It was voted to approve the plan and profile and the same was signed by the Board and deposited with the Town Clerk. Bliss presented a petition asking that the layout and grade of a proposed street as shown on plan filed with the petition be approved in accordance with Chapter 191 of the Acts of 1907. Hearing Ordered The Board decided to publish notices in the Minute Man for a public hearing to be held on Tuesday, Jany. 20. 1914 at 8 P. M., in Cary Hall. Street index 1 - 168 The street shown on the plans leads from a point of Middle Street near the house of F. H. Moulton to a point near the junction of Massachusetts Avenue and Pleasant Street. Lincoln St. Widening Considered at Hardings Marston Harding of Lincoln Street came before the Board, and the matter of widening Lincoln street along Hardings premises was considered, Mr. Harding agreeing to give the town a strip of land and set back the wall without expense to the town. The Board agreed to look over the ground with Mr. Harding at an early date. Street index 1 - 150 A true record, Attest: Charles W. Swan Clerk. 21 Meeting January 16, 1914. All Members present. Lincoln St Premises viewed at corner of Middle St The Chairman reported that he and Mr. Peirce had viewed the premises along the Harding property where Mr. Harding desires to widen Lincoln Street. Mr. Harding agreed to deed another piece of land at the junction of Lincoln and Middle Streets to the town, and set back the walls at that point, all without expense to the town. Street index 1- 150 A true record Attest Charles W. Swan Clerk. 22 January 20, 1914. Public hearing upon the petition of Edward P. Bliss for approval of plan showing location and grade of a proposed street leading from Middle Street to near the junction of Pleasant Street and Massachusetts Avenue. Public Hearing Messrs. Childs and Peirce present. The meeting was called to order at 8.15 P.M. and the petition and notice of hearing was read. Matter taken under consideration Edward P. Bliss stated that it was proposed to build this road to grade with portions of it made of gravel, and other parts of macadam, at no expenses to the town ; that reasonable restrictions would be placed upon the cost of houses to be erected upon the premises, and that the lots would be of good size. Street Index 1 - 168 William F. Green called attention to the approach to the road at the corner of Massachusetts Ave and Pleasant Street, and suggested that the triangular park at this corner be removed so as to avoid a crooked entrance to the new street. 23 Henry W. B. Cotton asked if Mr. Bliss had considered a forty foot street, Mr. Cotton stated that he desired to build a continuation of this proposed street, but did not care to build it more than forty feet wide. Mr. Bliss and Francis H. Holmes urged a sixty foot street. The hearing was declared closed, and the matter taken under consideration. A true record, Attest : Charles W. Swan Clerk. Notice is hereby given that the Board of Survey of the town of Lexington will hold a public hearing in Cary Hall on Tuesday evening, January 20, 1914, at 8.00 p. m , on the petition of Edward P. Bliss for the approval of plans showing the lay-out and grade of the proposed street leading from a point on Middle street to a point near the junction of Massachusetts avenue and Pleasant street. Plans Approved and filed with Town Clerk The Board approved and signed a plan showing the location and grade of a street running from Middle Street to a point near the junction of Massachusetts Avenue and Pleasant Street, and the same was filed with the Town Clerk in accordance with Chap. 191, of the Acts of 1907. Lincoln Street Plan approved Marston Harding sent a deed with plan conveying a strip of land along his premises on Lincoln Street to the town for the purpose of street widening. Deed and land accepted from Harding The deed was approved, and the following vote was passed : — Voted that the Board of Survey in the name of the Inhabitants of Lexington hereby accepts for said Inhabitants the tract of land on the northerly side of Lincoln Street deeded to the town by Marston Harding by deed dated Jany 15, 1914. Street Index 1 - 150 The deed and plan were ordered sent to the Registry of Deeds to be recorded, and a copy of the plan ordered made for the town files. Burke came before the Board and presented a plan showing the lay out of a tract of land on the northerly side of Woburn St. which he is laying out for building purposes. He requested that he be given the grade of Woburn Street at the entrance of a new street called Webb Street, and he was informed that Frank P. Cutter would meet his surveyor on the ground and give him the grade. A true record Attest Charles W. Swan Clerk. 27 Meeting May 1, 1914 Webb St. Plan and Petition presented Messrs. Childs and Lawrence present. James F. Burke present a plan showing lay out and grade of a street to be called Webb St. together with a petition asking for the approval of the plan. Public Hearing Ordered. The Board voted to hold a public hearing Tuesday evening, May 19 at 8 P.M. in Cary Hall. See page 28 A true record: Attest. Charles W. Swan Clerk. 28 Meeting, May 20, 1914 Webb St Public Hearing Messrs. Taylor and Lawrence present. This meeting was called of the purpose of giving a public hearing on the petition of James E. Burke for the approval of a plan showing the lay-out and grade of a street located on Burkes property and leading off of Woburn St and running northerly about 1500 feet to land of Raymond, said street being 50 ft wide and called Webb Street. See page 27 Mr. Burke was the only person present and stated that he desired to proceed according to law. The hearing was declared closed and the petition taken under consideration. Webb St. Plans approved with exception of amended plan of radius to be presented The question of approval of plan showing layout and grade of Webb Street was discussed, and it was voted to notify the petitioner, James E. Burke, to present an amended plan showing rounded corners drawn on on a radius of 25ft at junction of Webb Street with Woburn Street. Street Index 1 - 171. A true record, Attest: Charles W. Swan Clerk. 30 Meeting, May 29, 1914. Messrs. Taylor and Lawrence Present. Plan - Webb St approved. It was voted to approve the plan submitted by James E. Burke showing radius corners at junction of Webb Street and Woburn Street and the plan and profile were signed and deposited with the Town Clerk. Street index p. 170 Vol 1. A true record, Attest: Charles W. Swan Clerk. 31 Meeting, June 26, 1914. Messrs. Childs and Lawrence Present. Land at intersection of new street, Mass Ave & Pleasant St Deeded to Town Frank D. Peirce presented a plan showing a parcel of land located at the corner of Mass. Ave. & Pleasant St. at entrance to new street which he is building, which he deeded to the town in consequence of the agreement of the Selectmen made at their last meeting that they would build a portion of the sidewalk and do some macadamizing at that point. Index 94 Mr. Peirce also submitted the deed by him, dated June 26, 1914. Revised plan approve and filed Mr. Peirce then submitted a revised plan showing the lay out and profile of a street to take the place of the one submitted and approved by the Board on Jany. 13, 1914. The Board approved this amended plan and placed the same in the care of the Town Clerk. A true record, Attest: Charles W. Swan Clerk. 32 Meeting, July 3, 1914. All Members Present. Wilbur Property. At the request of the Board Frank P. Cutter came to the meeting and the layout of the streets on the Wilbur property at the end of Fern St was discussed Mr. Cutter criticized the layout as shown on the plans, and the Board authorized him to make a sketch showing what changes should be made in the plans that have been presented by Wilbur. New Street from Boulevard to Pleasant St. Mr. Cutter was told to make a plan showing what could be done in the way of layout out a new street from a point on the new avenue now being built by Frank D. Peirce where the said new avenue makes a sharp turn and runs through land of Geo. F. Harrington and extending from this point to a point on Pleasant St. somewhere opposite the house of S. Myron Lawrence and following in a general way the layout as shown on a plan dated, Sept. 18, 1900, the same being the scheme of Edward P. Bliss, When Mr. Cutter completes these plans the Board will go over the premises with him and possibly call a meeting of land owners in that section. A true record, Attest: Clerk. 33 Meeting, July 31, 1914. All Members present. Liberty Heights. The Board received a petition signed by E. B. Smith, Pres. and C. E. MacPhee, Secy and fifteen members of the United Improvement Association of East Lexington asking the Board to approve the lay out and grade of Oak St, Carvill Ave — Baker Ave — Taft Ave. and Charles St, all of Liberty Heights — and Wilson Avenue to Leighton Ave., Leighton Ave and Cliff Ave in Mass. Ave Terrace property, as show on plans submitted with petition Indexed The Board decided to give a public hearing on the petition in Cary Hall on Aug 28 at eight P. M. Hill St. Frank P. Cutter was authorized to prepare a plan showing a lay out for Hill Street, the lines of which are not definitely fixed at present, it being one of the oldest streets in town. A true record, Attest. Charles W. Swan Clerk 34 Meeting Aug. 7. 1914. All Members Present. Summer St. Extension Members of the Arlington Board of Public Works were present and the matter of the extension of Summer street over the line into Lexington to a junction with Lowell Street near the small house of Frank H. Reed was discussed. Mr. Adams stated that the State Highway Commission had promised to help in the matter of expense if Arlington would go ahead and pay land damages and do rough grading, and that he felt that the Metropolitan Park Commission would very likely continue the eastern end to connect with the Mystic Valley Boulevard. The Board decided to have a survey made of the Lexington portion and hold public hearings under the Board of Survey Act after the plans had been prepared. Hill Street Engineer Cutter was authorized to stake out Hill Street from Bedford Street to a point near the house of Haynes in accordance with a plan presented this evening, and after the stakes have been set the Board will give hearings as provided by Statutes. 35 This scheme is principally for the purpose of establishing bounds and takes only a trifle land here and there. Franklin Rd. A petition was received from Hallie C. Blake etals., asking the Board to approve the plan showing lay-out and grade of Franklin Road (now called Olive Rd) from Somerset Road to Somerset Road — York St. Also a petition from Edward T. Harrington Co., etal., asking for the approval of a plan showing lay-out and grade of a portion of York Street running easterly from Merriam Street. It was decided to give a public hearing on Aug 28th on both petitions. A true record, Attest Charles W. Swan Clerk 36 Meeting - August 28, 1914. All Members Present. Public Hearings. Public hearings on the approval of plans and grades of the following streets were held as follows : — Franklin Road, leading from Somerset Rd. to Somerset Road. Jeanette N. Elliott urged that the plan as presented be approved. — No person appeared to object. Liberty Heights. Wilbur Streets — Oak Street ; Carvill Avenue ; Baker Avenue ; Taft Avenue and Charles Street — in Liberty Heights Terrace. Ethelbert B. Smith, Clarence E. MacPhee and B. S. Doane stated that several houses had been built in this section and that the abutters had already done considerable work to bring these streets to grade, and urged that the plans be approved. The attention of the petitioners was called to the steep grades shown on some of the streets. Mass. Ave. Terrace. Wilson Avenue ; Lexington Avenue and Cliff Avenue off Massachusetts Avenue Terrace, so called : Hugh S. Ferguson, John J. Donovan and 37 Catherine Waters urged that the plans be approved. The Board called attention to the steep grade of Leighton Avenue and suggested that the petitioners consider the question of running a street from Bow Street to Cliff Avenue winding up the rise of ground instead of running at a right angle as shown on plan. The Chairman stated that all the petitions would be taken under consideration and the matter decided at a later meeting. Vine Brook Road, petition for A petition having been received from Augustus E. Scott asking for the approval of a plan showing lay out and grade of Vine Brook Road, it was decided to hold a public hearing on September 11. A true record, Attest: Charles W. Swan Clerk. Scott for the approval of plan showing lay-out of Vine Brook Road, 40 ft. wide, from Waltham St. to proposed extension of Highland Ave. Frank H. Holmes appeared in opposition to a 40 ft. street, claiming that 50 ft. was the proper width. Walter H. Rowse suggested some changes in the layout unless the Board felt that in the future an extension of Winthrop Road would be made to connect with Waltham Street near Forest St. or a little southwesterly thereof. Mr. Scott was of the opinion that a 40 ft. street with 5 ft. sidewalks and a 5 ft. grass border on each side was wide enough for any street not a main thoroughfare. It was suggested that the corners of the street at its junction with Waltham St. be rounded and Mr. Scott agreed to do so on one side and on the other so far as his land would permit. Mr. Scott also agreed to lower the culvert to conform to the survey made for the purpose of lowering Vine Brook. Frank D. Brown appeared in favor of the plan. 40 The Board having heard all parties, declared the hearing closed and took the case under consideration. Hill St. The Board being of the opinion that the bounds of Hill Street were indefinite, caused a survey of the street to be made to fix, as nearly as possible, the location of the old lines and to determine what changes should be made to make the street uniform in width. Property owners interested in the approval of the plan showing lay out and grade of Franklin Road were present and after a general talk it was voted to approve the plan and the grade as shown in red on said plan. The abutters agreed to build to grade and Mr. Gleason agreed to allow the town to connect two catch basins with a rain to be run through his property to carry away surface water. The plan was signed and delivered to the Town Clerk. York St. It was voted to approve the revised plan showing layout and grade of York St. from Merriam St. to the westerly end of lot #80, the abutters agreeing to build it forty feet wide under the direction of Engineer Cutter. The plan was signed and delivered to the Town Clerk. Vine Brook Rd. A. E. Scott came before the Board and matters relating to the approval of plan of Vine Brook Rd. were discussed. Mr. Childs stated that Dr. Valentine and Mrs. Whitcher had each 42 agreed to give a strip of land three feet in width from their property and if Mr. Scott would give the two foot strip along the Whitcher and Valentine property it would make the street 45 ft. wide. Mr. Scott was urged to give five feet on the southerly side to make the width 50 ft. in all. Mr. Scott thought a 40 ft. street was all that was needed in that locality, and stated that the taking of 5 ft on the southerly side would ruin certain lots by making them too short from front to rear. It was suggested that Mr. Scott try and interest F. Foster Sherburne to petition for the approval of plans showing extension of Highland Ave. to connect with Vine Brook Rd. to make a continuous highway from Waltham St. to Winthrop Rd. A public hearing was declared open on the proposition to re-establish the lines of Hill St. from Bedford St. to near the property of the Golf Club. I having come to the attention of the Board that the property known as the Gen. Meade place on Hancock St. near the junction of Burlington Street has been sold to Gorfinkle & Barkin for the purpose of development, it was decided to inform the purchasers that the town has accepted Chap. 191 of the Acts of 1907, as well as the Tenement House Act, and it was also decided to send them a copy of our Building Laws. The Board having previously considered the straightening and relocation of the bounds of Revere St., Mr. Taylor reported that Edward Wood would give what land it might be necessary to take from his property, and that Ernest W. Green of Fern St, Representative of the East Lexington Improvement Association came before the Board and urged that something be done towards improving the plans showing the layout and grade of certain Streets in East Lexington. Oak St. Baker Ave. Taft Ave. The Board took the matter up in executive session and voted to approve the plans showing the lay out and grade of Oak Street extension, Baker Avenue from Oak St to Taft Avenue and Taft Avenue from Baker Avenue to Charles St. A true record, Attest : Charles W. Taylor and S. Myron Lawrence. New St on Wilbur land. Referring to the new street extension from Bow Street to a private street called Cliff Avenue, and running over land owned by the Town of Arlington, it was voted to instruct Frank P. Cutter to consult with Robert P. Clapp relative to a description of the bounds of the land, which the Town of Arlington has agreed to release to the Town of Lexington for street purposes. Ferguson came before the Board to find out what he should do in order to have Forest Street extended and made a public street up to the entrance of his land. Scott for approval of plans showing lay-out and grade of Vine Brook Road, Mr. Taylor reported that he and Mr. Lawrence had had a consultation with Mr. Scott and that Mr. Scott had stated that he would give a strip two (2) feet in width along the whole northeasterly side of the road. Scott for the approval of the plan showing the lay-out and grade of Vine Brook Road, which runs from Waltham St. to an extension of Highland Avenue, so called. After making a correction in the plan by re-locating the easterly line of said street so as to make the total width 42 feet during the entire length of the street, the Board approved the plan and handed the same to the Town Clerk. Ferguson, et al. asking the Board to approve the plan showing the lay-out and grade of an extension of Forest St. from its present terminus to the northeast line of Ferguson's land. The Board decided to hold a public hearing on this petition on April 23d at 8 o'clock. J. J. Donovan release of land. John J. Donovan came before the Board and the matter of securing a release from the Town of Arlington of a strip of land to be used as a street to connect Bow St. with Cliff Ave., was discussed. Mr Donovan was requested to take up the matter with Jacob W. Wilbur who owns some property in that neighborhood, and he agreed to do so. A true record, Attest : Charles W. Wilbur Co., stating that the Company would be willing to give a part of lot no 11. on Massachusetts Avenue Terrace for street purposes. Providing the Town accepts the street, he will agree to do so before the lot is sold. Franklin Rd. — Petition rec'd to layout Petition was received from Frederick O. Woodruff, et als, asking the Board to lay out and determine the bounds of an existing private street to be called Franklin Road, running from Somerset Rd. easterly and southerly to Somerset Rd. near its junction with Merriam St., and recommend its acceptance to the Town. Summer St Extension. Referring to the matter of the extension of Summer St., from the Arlington line the chairman agreed to see Eugene D. Monahan and endeavor to persuade him that the benefits which he will derive from this new street would be sufficient to warrant him in giving his land to the Town free of expense. Ferguson and others for approval of plans showing lay-out and grade of Forest St. Extension. Approval of plan of part of Forest St. extension The Board took up the matter of approving the plan of Forest St. extension, and discussed the same with Mr. Ferguson. It was finally voted to approve the plan showing the lay-out and grade of this extension of Forest St. from its present terminus to a point 478.2 feet from the northeasterly corner of Clark and Forest Streets. Cliffe Avenue A public hearing was declared open upon petition of John J. Donovan, et al, for the approval of plans showing the lay out and grade of an extension of Cliffe Avenue to connect with Bow St. No person appearing in opposition — the Board voted to approve the plan that was submitted and the same was signed and placed in the hands of the Town Clerk. This extension is to take the place of an Avenue known as Leighton Avenue, the Board having refused to approve the lay-out on account of the steep grade. The Town of Arlington voted on May 20, 1915 to release to the Town of Lexington the land owned by Arlington, which might be included in this extension of Cliffe Avenue. A deed was also received from Jacob W. Wilbur conveying his interests in this extension. Mr Donovan agreed to procure a deed from Mrs. Heck conveying her interests to the Town. Petition was received from Arthur C. Whitney asking for the approval of plans of a new street running from Merriam St. to an extension of Oakland St., and street to be called Abbott Road. Grades of Charles St & Cliff Ave. E. B Smith, Chairman of Committee on Streets of the East Lexington Improvement Association sent a communication requesting that the Board inform him that the grade of Charles St., and Cliff Avenue meets with the approval of the Board of Survey. Mr. Childs not being at this meeting, the Board decided to notify Mr. Smith that they desired to consult with Mr. Childs before replying to his communication. Hearing - new street from Follen Rd. to Fern St. A public hearing was declared open upon petition and of Frank D. Peirce for approval of plan showing the layout and grade of a new Street running from Follen Road to Fern Street. Mr. Peirce explained the proposition and the Board asked various questions. Abbot Rd plans approved 191 A public hearing was declared upon on the petition of Arthur A. Whitney for the approval of a plan showing lay out and grade of a new street running from Merriam Street to an extension of Oakland Street. Peirce came before the Board and the question of approving the lay out and grade of a certain new street proposed to be laid out from Follen Road to Fern Street was considered. The Board felt that the grades in certain sections of the street were too steep, and after talking the matter over, Mr. Peirce agreed to submit a plan showing flatter grades. New street from Follen Road to Fern St. The new plan, showing the lay out and grade of a new street running from Follen Road to Fern Street, was presented by the Frank D. Peirce, The Board looked over the plan and consider ed the matter, and it was left with Mr. Lawrence to go over the proposed street with Mr. Peirce and report whether or not, in his judgment, it was possible to reduce the grades still more. Mr. Lawrence reported the result of his inspection, and it was voted to approve both plans. They were accordingly signed by the Board and turned over to the Town Clerk. Approval of plans Winthrop Rd to Waltham St. - Winthrop Rd. to Bloomfield St. A public hearing was declared open on the perition of Edward P. Bliss for the approval of two plans both showing ectensions of what is commonly called Highland Avenue, one plan being an extension from Winthrop Road to Waltham Street; the other being an extension from Winthrop Road to Bloomfield Street. John L. Norris one of the property owners along the street was present, and stated that he was in favor of the proposition. No person appeared in opposition, and after examining the plans, the Board approved and signed the same and they were placed in the hands of the Town Clerk. A true record, Attest: Charles W. Due notice having been given, a 'public hearing' was declared open on the petitions of abutters for the approval of plans showing layout and grade of Wilson, Arcadia & Cummings & Melrose Aves. No person appeared for or against the petitions, and the hearing was closed. "Blossom Crest" Petition was received from A. P. Gehman asking the Board to approve the lay-out and grade of a proposed new street running from Blossom Street to Waltham Street as shown on the plan entitled "Plan of Lots at Blossom Crest." Plan showing layout and grade of Wilson, Arcadia, Cummings and Melrose Avenues were approved by the Board, a hearing having been given on July 7, 1916, also a portion of Rawson Ave. "Blossom Crest" A public hearing was declared open on petition of A. P. Yehman for approval of plans showing the lay out and grade of new street running between Blossom and Waltham St. No person appeared against the petition but as the new street did not meet with the approval of the Board, it was decided to lay the matter on the table until future meeting. Blossom Crest A hearing on the petition for approval of plans of a new street at Blossom Crest was reopened. Mr. Gehman appeared before the Board and the matter was talked over so far as changing of the entrance of the new street on to Waltham Street. Mr. Gehman stated that he would see Mr. Mague who owns a little triangular piece of land and endeavor to exchange a small piece of his land for a small portion of Mague's land so that the proposed street might enter Waltham Street at a right angle. In the course of the talk Mr. Gehman stated that he would be apparently willing to give land owned by him along Blossom Street if the Board of Selectmen think it advisable to take official action and widen the street. This should appear in Selectmen Records. and not here. 74 Meeting. Oct. 3. 1917. All Members Present. O'Riordan Estate - Lay Out Petition was received from Clarence E. Carter, Civil Engineer of Reading, Mass., asking for the approval of the lay out of a certain portion of the O'Riordan Estate situated on Massachusetts Avenue, East Lexington, near the Railroad Station as shown on the plan submitted with the petition. After considering the matter with the Town Engineer, the Board voted to notify the Surveyor that it did not feel like approving a lay out which showed a grade crossing without a more complete understanding of the situation. The Board also deemed it advisable that the main thoroughfare should be at least fifty feet in width. The Board also judged from the plan that portions of these streets were laid out over land the Board supposed belonged to the Town of Arlington. O'Riordan property - lay out of street. The Board considered the petition of Clarence Carter for the approval of streets on what was formerly the O'Riordan property, and decided to lay the same on the table for further consideration. The Board was not desirous of approving the lay out of the street, showing the grade crossing without further study of the situation. "Vine Brook Farm Lay Out" Albin M. Richards, Atty for Edith A. Richards presented a plan with a petition asking for the approval of the lay out of streets shown on the plan which is entitled "Boundary Survey of Vine Brook Farm Lexington," "By Roy W. Hutchinson, Surveyor, Melrose Mass," with lots and streets plotted on by Charles A. Pearson, Surveyor, Charlestown, Mass, dated August 15, 1917. The Clerk was directed to request Mr. Richards to furnish a plan showing the grade of the streets, also the lay out of a street following about the lines of the present driveway from Lincoln Street to the Farm Buildings, and showing con- 76 connection between this street and some street on the Fair Oaks property which would make direct connection to Waltham or Middle Streets. Carter of Reading, Mass. relative to the plan of streets over the O'Riordan property in East Lexington, and state that the Board of Survey, after considering the plan, did not see its way clear to approve the plan since it contained a street crossing the Boston & Maine RR at grade. [Margin] Valleyfield Farm - boom Mr. McIntosh purchaser of what was known as the Valley Field Farm came before the Board, and the matter of streets through this property was considered. [Margin] Locust Ave. Extension The petition of Paul S. and Robert Burns for the approval of plan showing lay out and grade of proposed extension of Locust Avenue beginning at a point at the easterly end of land of Edward T. Hartman and extending to the land of Tower, was considered. The Board ordered a public hearing to be given on November 23rd at 7:30 o'clock P. M. In connection with this extension, the Board deemed it advisable to have plan showing the acceptance of the street through the lands of Tower to Follen Road, and that this matter be also included in the same hearing. [Margin] Vine Brook Farm The Board also considered the plan submitted by Albin M. Richards, Attorney for Edith M. Richards, showing lay out of streets on the Vine Brook Farm, so called. The Engineer was instructed to make some study of the situation to see what connection can be made between certain streets showing on the plan with a street now existing and running through Fair Oaks property, so called to Waltham Street also to Middle St. Attest: Charles W. Swan Clerk 79 Meeting, Nov. 14, 1917. It having been suggested to the Board by the Town Engineer, that the Board of Survey adopt regulations governing the size of plans, data, etc. relating thereto, the Board voted to adopt the following: "Specifications for Acceptance Plans for Street Layouts." [Margin] Specifications for Street Lay-Outs. All plans hereafter submitted for the approval of the Board of Survey under the provisions of Chapter 191 of the Acts of 1907, and any act or amendment thereto, must be drawn on tracing cloth and be of uniform size, viz: 20 inches high by 30 inches wide, outside dimensions, with a 1/2 inch margin on each side, except on the left where it will be 1 1/2 inches wide. Plans must show scales, date, surveyor's name and address, north point and names of abutting owners. Unless otherwise directed, the scale of all plans must be 40 ft. to an inch, the horizontal scale of profile 40 feet to an inch and the vertical scale 6 feet to an inch. The plans must give sufficient information to accurately locate the proposed street as well as its accurate connection with other existing streets in the vicinity. 80 They shall show ground heights at the centre and both sides of streets at each 50 foot station. All buildings, walks, drives or other fixtures abutting on or near the proposed streets shall be shown, if they are affected by the proposed lay-out. The lines of the proposed street and proposed grades, as well as the figures showing the radii of curves, widths and proposed grades, must be shown in red ink; all other figures and lines in black ink. The minimum width of proposed streets shall be 50 feet. Profiles must show, in addition to the proposed grade, present elevations of the centre of proposed streets every fifty feet. All elevations on the profile shall be referred to Lexington datum which is mean sea level. Bench marks will be furnished on application to the Town Engineer. Unless otherwise directed the street should be so located that the maximum grade will not be more than 7% or less than 0.5%. All connecting street lines must be rounded in a manner satisfactory to the Board of Survey. If a street submitted for approval does not extend through to another street and in the opinion of said Board is 81 likely to be extended in the near future, the plan shall be of the whole street so extended. Upon the approval of said plans by the Board of Survey the petitioner shall place stone monuments or other substantial marks to permanently establish the boundaries of the approved lay-out, in accordance with the directions of the Town Engineer. The idea of extending Locust Avenue through lands Richard Tower to Follen Road, was discussed, and the Board stated that it would like to have the approval of Mr. Tower before taking any action on the extension through this property. Mr. Richards and Mr. Peirce agreed to see the Tower family and ascertain their views on the matter. It was therefor voted to postpone this hearing to Dec. 12 at 5 o'clock in the afternoon. The Board took up the petition of Paul S. and Robert Burns relative to the lay out of Locust Avenue. It was stated that Mrs.Tower is strongly opposed to the extension of this street through the Tower property to Follen Road. The Board voted to approve the lay-out of Locust Avenue from Tower Street to the division line between lands of Burns and Tower. Mr. Burns was also informed that the Board will insert an article in the Warrant for the annual March meeting, recommending the extension of this street as a public highway. The Board also decided to see what steps they could take to have this extension carried through the Tower land to Follen Road. [Margin] Valley Field Farm Development A public hearing was declared open upon petition of Neil McIntosh, Jr. for approval of plans showing the layout of certain streets on property located at the junction of Waltham & Middle Streets it being the corner northeast from Middle treet and southeast from Waltham Street. Mr. McINtosh & his engineer explained 85 the proposition and after some questions and suggestions from the Board, Mr. McIntosh agreed that if the property now owned by the Estate of A. E. Scott should be cut up for development within a reasonable time he would change the location of one of the streets shown on his plans an endeavor to make arrangements with the owners of the Scott property, to carry the street through their land to an intersection with Waltham Street. The Board therefore agreed to approve the plans upon receipt of this written agreement with Mr. McIntosh and after some further work by the Engineer to make clear some details. No person appeared to object in opposition to the petition. [Margin] East Lexington Annex - Development The Board considered the petition of Clarence E. Carter, asking for the approval of lay-out on property known as the East Lexington Annex. This property is located at the northeasterly side of Massachusetts Avenue in that part of the Town known as East Lexington, and not far from the East Lexington Station of the Boston & Maine RR. The Board voted to have a public hearing on this petition on Wednesday, January 16, at 86 7:30 P.M. Vine Brook Farm - Development The Board also voted to take up the petition of Albin M. Richards for the approval of plans showing lay-out and grade of certain streets on property known as Vine Brook Farm situated off Lincoln Street. After considering the matter with the Town Engineer, the Board voted to lay thier petition over for one week. Part of the streets laid out on the plan were laid out at a width of 40 feet, which doesnot meet with the approval of the Board and certain grades shown thereon were not entirely satisfactory to the Town Engineer. Carter on presentation of the Suburban Land Company for the approval of plans showing the lay-out and grade of certain streets on the property of the Company situated on the northeasterly side of Mass- achusetts Avenue near the East Lexington Station of the Boston & Maine RR. The Company was represented by W. Hubert Wood an attorney who stated the reasons why the plans should be approved. Thomas J. Robinson, representing the Town of Arlington objected to the approval of the plans as a portion of the street shown on the plan was laid out over property be- longing to the Town of Arlington. Mr. Robinson claimed that if the plan was approved and recorded the Town of Arlington would lose the right to make any other use of the land. It was decided to adjourn the hearing for three weeks with the understanding that the representative of the Suburban Land Company would take up the matter with the officials of the Town of Arlington with the idea of seeing if any agreement can be made 89 with them whereby the street may be permitted to be laid out over Artlington property. "Farmhurst" A petition was received from Neil McIntosh Jr. asking the Board to approve a plan showing lay-out and grade of certain streets on a tract of landed entitled "Farmhurst", section 3, the streets being designated as Kendall Road Extension and A.B.C. streets. Stone Crusher Land This hearing also took into consideration an article in the Warrant to see whether the Town would purchase or take by right of eminant domain, a certain parcel of land on which our stone crusher is now located, this parcel of land being included in the tract through which certain roads are to be located for which Mr McIntosh asks the approval of the Board. No person objected to the proposition as a whole except that the Town Engineer called attention to excessive grades in some of the streets. Mr McIntosh appeared before the Board and the matter of the lay out of the tract of land known as Kendall Road Extension and "A.B.&C" Streets was considered. Mr McIntosh took away the plans to make certain changes ordered by the Board. The Board approved the lay out of plan entitled "Farm Hurst" in consequence of the letter dated March 14, received from Mr. McIntosh stating that he "would be pleased to deed to the Town of Lexington that portion of any land which is necessary for such extension." This will provide for a better intersection with Valley Field Avenue to Waltham Street, in the event that the land now owned by the Scott Estated is opened up for future development. Horton suggested the advis- ability of acquiring a strip of land 60 feet either side of the brook for the purpose of a highway, believing that such a highway, when developed, might possibly not only enhance the value of the surrounding territory but also might, in the future, become a part of the Metropolitan Park System. The Town Engineer was directed to draw a plan showing the lay-out of a street from Massachusetts Avenue following along Vine Brook to Vine Brook Road and mak- ing a connection near this point with a street already approved by the Board follow- ing along the brook to Waltham Street nearly opposite Forest Street. "Farmhurst" claim of Mr. McIntosh A communication was received from James A. Bailey, Attorney for Neil McIntosh, Jr. relative to the refusal of the Board to approve the lay out of Section 2 of Farmhurst at the corner of Waltham Street and the State Rd. Mr. Bailey stated that his client requested that the Board inform him strongly why his plans had not been approved. The Clerk was requested to turn the matter over to Mr. Ryder. Cerussi Rd. With reference to the lay out of the new street along Vine Brook from Mass. Avenue through land of Daniel Cerussi, the Board gave an informal hearing to Mr. Cerussi at which Mr. Frederick L. Emerby, Chairman of the Planning Board, was present. In discussing the various plans and schemes Mr. Cerussi was given to understand verbally that the Board of Survey would lay out a road substantially as shown on the plan made by the Town Engineer entitled "Plan of Proposed Street, Lexington Horizontal Scale 1" = 40 ft. The Board gave its second hearing on the proposition to lay out a public way along Vine Brook from Massachusetts Ave. through lands of Cerussi. Mr. Cerussi was present. Also town counsel Ryder and F. H. Holmes and Arthur E. Horton. The Town Engineer was also present to explain the plans and assist the Board. Mr. Horton spoke at some length and advocated a liberal treatment of the problem. At about two oclock the hearing was adjourned to Tuesday evening Oct. 15 at Eight oclock. Wm. Hunt, Dr. Valentine and the Planning Board were invited to be present at this adjourned hearing. The meeting came to order by adjournment from the second hearing in Oct 9 called for the purpose of considering the proposition to lay out a road along Vine Brook from Massachusetts Avenue to Vine Brook Road. Chairman Emery and a majority of the members of the Planning Board were present, and a large majority of that Board expressed its approval of a plan showing the layout of an avenue about one hundred feet wide along Vine Brook from Massachusetts Avenue to Vine Brook Road, one half of the avenue to be on each side of the brook. Others present were Engineer Duffy, Counsel Ryder, Arthur E. Horton and F. H. Holmes. The Board and those present discussed the situation and it appeared to be the general opinion that it would be for the towns interest to secure control of a strip of land on both sides of all principal water courses of the town. The hearing was declared closed. Swan Clerk 101 Meeting July 28. 1919 Farmhurst All Members Present Informal Hearing to Mc Intosh This meeting was called at the request of Neil Mc Intosh, Jr. Trustee so that he might have an opportunity to talk with the Board relation to the Boards refusal to approve a layout of Section 3 of "Farmhurst", this tract being the property located at the southerly corner of Middle and Waltham Streets. Those present in addition to the Board were F. J. Emery, Chairman of the Planning Board, R. J. Ryder Town Counsel and Town Engineer Duffy. Mr. Mc Intosh exhibited blank forms of sale showing conditions and restrictions. Mr. Ryder and Mr. Emery claimed that the restrictions did not ammount to anything because Mc Intosh reserved the right to change them by written notice to the purchaser. Mr. Mc Intosh's attention was called to the small shacks now being erected on the property, Mc Intosh having assured the Board that he proposed starting a high class development. Mr. Emery warned the Board 102 to be very careful in its dealing with McIntosh and see that he did not get the best in any scheme. It was stated at the meeting that McIntosh had said that the minimum limit on the cost of any house should be $3500.00 - this Mc Intosh denied, stated that the minimum was $2500.00. The Board took no action at this meeting. A true record Attest Charles W Swan Clerk. 103 Meeting, April 15, 1919 All Members Present. Farmhurst This meeting was held at the request of Neil McIntosh. Jr. to allow him to discuss with the Board matters relative to the Boards refusal to approve the proposed lay out of streets on Section 3 of "Farmhurst" located on the southerly side of Middle Street from its junction with Waltham and also along Waltham Street. Mr. McIntosh was accompanied by his brother and by William P. Martin, his attorney. Mr Martin made the statement that Mr. McIntosh is willing to conform with any lay out that the Board sees fit to make as to width, grade and location of the streets so far as the Board has authority to request such lay-out, and if the plan which has been presented for approval does not meet the ideas of the Board as to width, grade and location, he is willing to change such plan until it does meet with the approval of the Board. The Chairman then made the following statement : - At a meeting of the Board of Survey of the Town of Lexington, Mass. held this day 104 it was, Voted that the action of the Board under date of March 20, 1918 approving a plan of lay out and development of a plot of land at the North East corner of Middle Street and Waltham Street in Lexington as shown on a blue print marked. "Farmhurst" be reconsidered and that the approval of said lay out then granted be and the same is hereby withdrawn and rescinded upon the ground that the representation made in behalf of the development and in reliance upon which said approval was granted have not been fulfilled. After some discussion it was decided to adjourn this meeting to 7:30 o'clock P.M. on April 20, 1919. A true record; Attest: 105 Meeting April 22, 1919 All Members Present. Farmhurst Restrictions Neil McIntosh Jr. with his attorney, William P. Martin, and a stenographer were present at this meeting, it being an adjourned hearing held last week. The Town Counsel and the Chairman of the Planning Board were also present. Mr Neil McIntosh submitted a sheet of typewritten restrictions which he is willing to have placed on his property known as Farmhurst. These restrictions did not meet with the approval of the Board and Mr McIntosh was told that the Board would submit such restrictions on the property as it thought necessary before the following Monday. The restrictions as drawn up by the Town Counsel and delivered to Mr. McIntosh are as follows: Voted: That the Board of Survey refuse to accept the proposition submitted by Neil McIntosh Jr. Trustee, with reference to the placing of restrictions upon the Farmhurst Tract, so called, in Lexington, and that the Board submit the following offer to said McIntosh, namely: That in consideration of Mr. McIntosh placing restrictions upon the Farmhurst Tract 106 so called, in accordance with the terms of the restrictions herein submitted, the Board of Survey agree that they will approve the lay out of Streets as submitted by Mr. McIntosh and that they will further agree that they will, as Selectmen, waive the option of a renewal of the lease of the stone crusher property and remove the crusher from the premises after the expiration of the present term of the lease. Restrictions to be placed upon the Lots of the Farmhurst Tract Belonging to Neil McIntosh Jr. 1. That no building shall be erected or placed thereon with a flat roof. 2. That no building shall be erected or placed thereon to accommodate more than two families. 3. That no building shall be erected or placed thereon nearer than twenty feet from the street line of any street which shall be hereafter constructed, provided, however, that the steps, window and porticos and other similar projections appurtenant, may be within said distances, and also provided that on corner lots, the side of a building other than the front may be extended to within ten feet of the line of any side street. 107 4 That no building shall be erected or placed thereon to be used for manufacturing on merchantile purposes or any business or trade that shall be offensive to the neighborhood. 5. That no dwelling house on said premises erected or designed for the occupancy of one family only, shall cost less than Thirty-five Hundred Dollars and no dwelling house erected or designed for the occupancy of two families shall cost less than Five Thousand Dollars, exclusive of the cost of trading for each such house. These restrictions are to be applied to all lots on Farmhurst Tract as shown on Sections 1, 2 and 3 of plan entitled "Farmhurst, Lexington, Mass. Belonging to Neil McIntosh, Trustee, C. E. Gannett, C. E" excepting Lots 27, 28 and 29 in Section 1 and in Section 2, Lots 29 to 68 inclusive, lots 85 to 90 inclusive, lots 95 to 111 inclusive, lots 3 to 5 inclusive and lot 145, and in section 3, lots 131 to 146 inclusive and lot 25. No dwelling house on lots excepted from the foregoing restrictions erected or designed for the use of one family shall cost less than Twenty-Five Hundred Dollars, and no dwelling house erected on said lots for the use of two families shall cost less than Four Thousand Dollars, exclusive of the cost of grading for 108 each such house. The foregoing restrictions shall not be binding upon lots 145 and 25 unless said lots are used for the erection of dwelling houses. All Members Present. Suburban Land Co. Hearing At the request of W. Hubert Wood, atty for the Suburban Land Co., the Board reopened the hearing which was begun on Jany 16, 1918. and adjourned to allow the Company to adjust with the Town of Arlington the question of the laying out of a portion of one of the streets on property belonging to the Town of Arlington, it being a portion of the Arlington Water Works property and also to change its plans to show all streets to be of a width of not less than 50 ft, and also to give the Company an opportunity to make arrangements to obviate the necessity of a grade crossing over the tracks of the Boston & Maine RR. Mr. Wood stated that arrangements had been made whereby Arlington gave its consent to the laying out of a portion of one of the streets over the Arlington land and that the main street had been made 50 feet wide, and enquired if the plan now met with the approval of the Board. The Board told Mr. Wood that they would not approve the plans as now presented nor would they do so until all streets were laid out to a width of not less than 50 ft., and further 110 arrangements were made with Arlington to secure a way at least 50 ft. wide where the principal entering street passes over a certain dam or causeway and also because of grade crossing of this same principal street, (named Fottler Ave, on plan) over tracks of Boston & Maine R.R. "Farmhurst" A letter was received from Mr. McIntosh informing the Board that there were no changes in the plans which were approved by the Board on May 28, 1919 except the obliteration of Osborne Road, Valley Field Ave., and Valley Field Square. Kendall Rd. Mr. McIntosh asked the Board to view Kendall Road, and he would like to have the town accept the same so that he could have water in there by Spring. The Board will set a date later on at which time they will view the street. "Farmhurst" McIntosh stated that in other towns the Board would place water pipes in street which were approved by the Board of Survey before the streets were accepted by the Town. Mr. McIntosh inquired if this Board would take the same attitude in this matter as other Towns. 113 Mr. Ryder's opinion was requested in this matter and he stated that owing to previous votes of the Town water could not be put in unaccepted streets by the town only in cases where the abutters pay the costs. The Board agreed to view the premises of Neil McIntosh, Jr., on Monday October 13th in the afternoon. Suburban Land Co. Case. The case of the Suburban Land Company being brought before Judge Martin, it was requested that he case be divided for two decisions, that is one on the Legality and Right of posting the Board of Survey sign 116 and the other on the layout-out of streets, before approval by the Board of Survey. Lovett representing the Home Guardian Co., for approval of plan showing development of lands on the south-westerly side of Bedford Street, about 1/4 of a mile south-east of Summer St., Mr. Lovett appeared for petitioners. The Chairman of the Planning Board and two members appeared and stated that the plans had been previously examined by the Board and that the lines and grades met with its approval but on account of the swampy character of the land the Board suggested that in so far as it may be lawful, no building permits shall be granted on the area until the streets had been brought to the trade approved by the Board of Survey. Pursuant to the vote passed by the Board at its meeting on the seventh of the current month and the Terms of the notice recorded with the minutes of that meeting, a public hearing was held in the Selectmen's Room in the Town Hall, on the evening of December 21st, 1920, at quarter before 8 o'clock. Notice of the hearing had been given by publication once a week for two successive weeks in the Lexington Minute-man, a newspaper published in this town, the first publication of which notice was in the issue of Friday, December 10th, current and the last, in the issue for Friday, December 17th (last Friday). Board of Survey. 10dec2w A preliminary topographical plan, prepared at the request of this Board by the Town Engineer, and covering the section of land referred to in said notice, was submitted for examination by all present at the hearing; and the Board invited suggestions as to the best lay out of streets for the territory. Mr Harvey S. Bacon, representing the owners of the land under consideration, submitted a blue print with a lay out of streets and lots thereon, which he said would be satisfactory to the owners, and which they would like to have the Board consider when decided upon a plan. Mr. Roger S. Greeley of the Town Planning Board criticized the suggested layout of the owners because it ignored the natural grades 129 and contours of the land; also because the streets were too narrow. He advocated a lay-out which should conform to the topography of the territory. It was suggested by several present that the meeting be adjourned for one week, the Board of Survey meanwhile to make further studies and be prepared at the adjourned session to present sketches showing such locations, directions, grades, etc., of streets for the territory as to the Board may seem best. [Margin] Adjourned Meeting - Board of Survey An adjourned meeting of the Board of Survey was held at the Selectmen's room in the Town Hall, Lexington, Mass. the 28th day of December, 1920, the same being an adjourned session of the hearing which was begun under the published notice dated December 7, 1920. [Margin] "Greenacre" The Town Engineer under the direction of the Board of Survey had prepared and presented at the meeting a sketch plan showing a suggested lay-out of the area bounded by Bedford Street, Burlington Street and Grove Street and North Hancock Street including the premises entitled "Greenacre" owned by the Stewart Land Trust and formerly known as the Kendall Farm (the same embracing the tract mentioned in said notice of December 7th) this sketch plan following the topographical lines and showing the streets to be fifty feet in width. A number of citizens were present and made suggestions concerning the proposed plan. The Chairman of the Planning Board, Mr. Greeley explained that he had gone over the plan. He explained in detail the various features of the plan which would be of benefit to both the 131 Stewart Land Trust and the adjoining property as well as the public interest of the Town of Lexington. Mr. Harry D. Bacon representing the Stewart Land Trust made suggestions for the re-location of some of the proposed streets as shown on the sketched plan and for the elimination of some of the other streets. It was suggested by the Board of Survey that Mr. Bacon have the Engineer of the Land Trust some to the Town Hall at some time in the near future and go over the plan with the Town Engineer in order that something definite could be arrived at that would satisfactory both to the Company and to the Board of Survey. To this proposal Mr. Bacon assented. The Chairman of the Board of Survey stated that the authorities of the Town desired to co-operate in any way possible for the best interest of all concerned. Mr. Bacon intimated that possibly the Land Trust might go ahead and sell their lots irrespective of any survey or plan other than their own, to persons who were ignorant of the Board of Survey Act and regardless of whatever attitude the Town authorities might assume. Mr. Frederick L. Emery who was present, stated that he did not feel that the Town would be helpless, in such a situation and had no doubt that the Courts would, if such a condition arose, properly protect the interest of the Town and 132 its citizens. Upon motion duly made and seconded, the meeting was adjourned with the understanding that the Board of Survey, with the help of such suggestions as they had received, would complete a plan, after which they would give a second hearing in accordance with the terms of the Board of Survey Act. McClary for the approval of plan of a parcel of land, formerly known as the "Lexington Park," and located on the northwesterly side of Bedford Street. The Town Engineer had previously gone over the plan and suggested a compromise plan. After many suggestions were made it was finally agreed that Mr. Branch, Engineer for Mr. McClary, should confer with our Town Engineer and present a plan which may later be approved by the Board of Survey. "...towns having a population of less than ten thousand may create a board, to be known as the planning board, whose duty it shall be to make careful studies of the resources, possibilities and needs of the ... town, particularly with respect to conditions which may be injurious to the public health or otherwise injurious in and about rented dwellings, and to make plans for the development of the municipality with special reference to the proper housing of its people ...
