(1) This is to certify that the Board of Fence Viewers of
the Town of Lexington, Massachusetts, received on August 8, 1905,
a complaint from George E. Lothrop, who is the owner of the
improved lot of land on the northerly side of Massachusetts
Avenue, in said Town of Lexington, extending between said Avenu
and the location of the Boston and. Lowell Railroad just north o
Pierce's Bridge Station in said Lexington, that Mrs. Lydia E.
Wheaton, who is the owner of the premises adjoining said land
on the south next to said railroad location, refuses and neglec s
to build or share in building a division fence between her prop
erty and the property of said George E. Lothrop, and called upo
us to view said premises and determine the matter as provided
by law.
(2) That we gave to said George E. Lotiirop and said Lydia E.
Wheaton on August 8, 1903, written notice of the reception of
said complaint, and also gave written notice that said Board of
Pence Viewers would view said premises on the afternoon of
Saturday, the 15th day of August, 1903, and hear the parties
interested. Copies of the notices given to said Fence Viewers
by said Lothrop, and by said Fence Viewers to said Lothrop and
said Wheaton, are annexed hereto.
(3) This is to further certify that after viewing said prem-
ises in accordance with said notice, and after hearing the
parties, we have determined that the centre of the ditch, creek
or brook marks the dividing line between tim properties of said
Wheaton and Lothrop and is insufficient as a fence; that it is
impracticable to fence on the boundary line, namely, the centre
of said creek or brook, without unreasonable expense.
(4) We have determined that a partition fence is required,
and therefore direct George E. Lothrop to build and maintain a
suitable fence, constructed of rails, timber, boards, iron or

stone, which shall be at least four feet high above the ground,
along the edge of said creek or brook, beginning on his said

land adjoinir�& the property of the heirs of I'lilliam Brigham,
thence running along the line of said creek or brook, as near to
its edge as is practicable, a distance of one hundred and eigity
one (181) feet and six (6) inches, there to connect with a felice
which we are directing Ifrs. Lydia E. Wheaton to erect. Pie fur-
ther direct that said fence shall be erected as aforesaid wit
in fifteen (15) days from the 20th day of August, 1903.
(5) 1ve also direct Lydia E. Wheaton to build and maintain
a fence at least four feet high above the ground, constructed
of rails, timber, boards, iron or stone, along the edge of
said creek or brook on the northerly side thereof on said George
E. Lothrop's land, beginning at the line which divides the land
of said Wheaton from the land of said Lothrop and where it
adjoins the land of the Boston and Lowell Railroad, and. running
along said dividing line until it reaches said creel: or brook,
thence along the edge of said creek or brook as near as is
practicable thereto, a distance of one hundred and eighty-one
(181) feet and six (6) inches, and until it reaches and connects

said Board of Fence Viewers gave written notice to William A.
Tower and George E. Lothrop that said complaint had been receiv d

The Fence Viewers of the Town Of Lexington, having
been duly requested by one Michael i!cQuade, of said Lexington,
to view the property of said Michael McQuade and Patrick
Mulvey on Woburn Street, Lexington, or the land of Delia
Mulvey, wife of said. Patrick Mulvey, in whoever the title
to said property now is, we hereby certify that we did on the
third day of May, 1904, give notice to said McQuade and said
Patrick Mulvey that the said Board of Fence Viewers would
view said premises on the 7th day of May, 1904; that we
viewed said prenises on said day, and on said day before
viewing said premises we received a protest from said Patrick
Mulvey that he did not own the land adjoining the land of

ian; that the lands of said Bashians and myself are improved lands;
that the boundary lines between the said two estates consists of a
stone wall, a part of which is out of repair; that a large portion of
the division fence between said estates was rebuilt by the man of
whom I purchased my estate; that I desire to use my property for the

Arlington, Nov. 22, 1895.
Messre Geo, D. Tufts and Edwin S. Farmer, Selectmen of
Arlington, Edwin F. Spaulding, Selectman of Lexington, with Mr.
Geo. W. Sampson, as substitute, met this day for the purpose of
perambulating the boundary lines between said towns.
Beginning at a monument, braced with iron rods, situated on a ledge
which is the corner bound between Lexington, Winchester and Arling-
ton, and is marked "L". "W.0"."W". Thence we proceeded to a stone
monument situated in an open pasture nearly east of the house of
Oliver Winship. Thence in the same direction (southwesterly) to a
monument beside the old Turnpike now called Westminster Avenue.

Thence in the same direction to a monument standing on the northerly
side of Lowell Street. Thence in the same direction to a monument
standing on the northerly side of Massachusetts Avenue. Thence in
the same direction to a monument in the woods about two (2) rods
northeast of a "pond hole", on land of W. W. Ehenery: Thence to
a monument standing in a pasture. Thence to a monument standing
beside the road nearly opposite the old"Bowman house". Thence to
a monument on top of a hill which is the corner boundary between
Arlington,LLexington and Belmont.

The last named monument stands on a ledge,to which it is fastened by
an iron bolt.

between Arlington and Lexington and found the monuments marking

authorized by the Board of Selectmen of the Town of Lexington,
and Aldermen John `R. Hudson, William r,, Mi Loon and Fdgar A. F�merson,
with Bertram Brewer, City Engineer, thereto duly authorized by the
Board of Aldermen of the City of 'Paltham, met on the boundary of the
two municipalities and examined the same to establish the bound
marks thereof.
Beginning at the Corner of Belmont, Lexington and"altham,
a granite monument marked "B L ti's" and Situated on a ledge, about
one hundred feet (1001) easterly from the summit of a hill, about
one thousand feet (10001) southerly from the buildings on the farm
of Martin Connerney; thence north, sixty degrees, six rjinutesI west
(N. 6006'w.) sixteen thousand five hundred and thirty feet (16,5301)
to the corenr. of Lexington, Lincoln and 11'altham, a granite monument
marked "L L VV" and situated near the easterly shore of the. Hobbs
Brook reservoir of the Cambridge water works and fifteen hundred
feet (15001) north of Lincoln Street.
Between the Corners as above described intermediate road and
line stones were found at the following points:

The undersigned hereby certify that on the sixteenth day of
November, 1910, they perambulated the boundary line between '"'inchester
and Lexington, and found the monuments establishing the line between
7inchester and Lexington, excepting a corner monument designated corner
4, and a line stone marking an intermediate point between corner 4 and
corner 3, which last named monument marks a corner of the towns of
Arlington, Lexington and Winchester,
Failing to locate the above mentioned monuments, the represent-
atives present of the Board of Selectmen of 7inchester delegated
James Hinds, Town Engineer of 1"inchester, to meet the Board of Selectmen
of Lexington on the seventeenth day of November, 1910, and to locate and
certify to the positions of the town bounds not found the previous day.
At the meeting of the Selectmen of Lexington and the
representative of the Selectmen of Winchester or November seventeenth,
the remaining bounds were found. The monuments establishing the boundar-.-
line between ',inchester and Lexington throughout its entire length are
located and described as follows:
Beginning at a stone monument marked L W W situated on the
westerly side of a fence on land of the William Winning estate, about
100 feet southeast of the barn and Fbout ^50 feet south of the house,
said monument being a large, rough, granite stone about 5.8 feet high
and about 6" x 9" in section, thence the line runs South 32004' East
about 1101 feet to a stone monument marked L V7 standing at the junction
of two stone walls about 1300 feet southerly from the house of the
'Tilliam [;inning estate, thence South 45001' Bast about 1872 feet to a
rough stone monument marked L 17 standing near the wall on the north
side of High St., once known as the old Woburn and Lexington Road, thence
South 45014' East about 1778 feet to a rough granite monument marked
L WC No. 11 1830,,standing at the old corner of Woburn and West
Cambridge on a hill belonging to the Josiah Locke estate on Ridge St.,
Winchester, said bound being situated about three feet from a stone wall
and about forty feet from a break in the stone wall, thence South 39040'
[`Jest about 1857 feet to a stone monument on a ledge, said monument being
marked W 17C L. and being held in place by an iron bolt fastened into the
ledge and being supported by two iron rods. The above monument marks
the corner of the towns of !Arlington, Lexington and Winchester.
In addition to the above described monuments which mar'_ the
angles or changes in direction of the Winchester -Lexington line, the
following line stones were found in place:
Between the end of the first described Bourse and the end of
the second course, an irregular shaped .stone, leaning out of perpendic-
ular.
Between the end of the second course and the end of the third
course, a granite stone about three fe high, standing near a cedar
tree and about fifty-five feet from a bar way in a wall, 5" x 10" in
section and marked L We
Between the end of the third course and the end of the fourth
course, which is the corner of Arlington, Lexington and Winchester, a
granite bound about 4.5 feet high, 8" x 8" in section and marked L w0.

Whereas a controversy having arisen between John N. Morse
and Sarah E. F. Swan of Lexington about their respective rights in a
partition fence in the line between their lands situated at said Lex-
ington, Hancock Avenue,we the subscribers Fence Viewers of the Town of
Lexington, having on the application of the said John N. Morse and
after having given due notice to the said Sarah E. F. Swan, viewed the
premises and duly considered the matter in dispute, do hereby assign
to each of the said parties his and her share of said fence as fol-
lows viz:
The said John N. Morse shall build and keep in repair a good
and sufficient fence from the southerly corner of the land of him and

side of the Chase estate and made the following decisions
Whereas a controversy having arisen between Michael
Curran(estate of John Curran) and H. L. Chase about their
respective rights in a petition fence in the line between their
land situated in said Lexington,
We the Fence Viewers of Lexington having on application
of the said Michael Curren (estate of John Curran) and after
having given due notice to the said H. L. Chase, viewed the
premises and duly considered the question in dispute, decided.
First; That that portion of the line beginning at the
junction of the Stone and Curran estates, running in a south-
westerly direction to the main ditch between the estates of John
Curran and H. L. Chase, then at right angles in an easterly
direction on the main ditch to a stake making the total length
687 feet be set off; A fence four feet high with four inch
posts set not more than twelve feet apart be built, and maintained
by the said H. fi. Chase;
Second; THe other half (687 feet) along the main ditch
be set off. The ditch be cleaned to :allow the flow of water, and

Gentlemen,-

Representing Dr. George L. Lothrop, the owner of the improved
lot of land on the northerly side of Massachusetts Avenue, extending
between said Avenue and the location of the Boston & Lowell Railroad,
just North of the Pierces Bridge Station, at Lexington, I would make
complaint that Mrs. Lydia R. Wheaton, the owner of a portion of the
premises adjoining said land on the South next to said railroad location,
refuses and neglects to build or share in the building of a division
fence between her property and the said Lothrop's, and in behalf of
Dr. lotnrop, I hereby respectfully call. upon you to view said premises
and determine said matter as soon as possible in the mariner provided
by law.

Gentlemen:
In behalf of Dr. George P.. Lothrop, wio owns the improved
field between Massachusetts Avenue and the steam railroad location
at Pierces' Bridge Station, about which I wrote you recently, I would
say that it seems that the division line between said lot on the North
and the adjoining land of Col. William A. Mower is not known, or is, at
loast, not well established, and in order that the same may be properly
determined, we call upon your Board to view the same and to establish
the proper division line in the manner provided by law, and if this can
be done upon the same day on which the view is taken of the division
line between_ the said Lothrop's land and that of Mrs. Wheaton, it may be
an accommodation to all parties. I will see that the deeds, or copies,
of these properties are furnished you, aid from the nature of the con-
veyance, you may require some measuring or surveying, and if the survey
which has recently beennade is of any service to you, I shall be glad to
place it at your disposal and do anything I can toward an early, andcable
and satisfactory Settlement of all questions involved.

The undersigned this day met at the corner of Woburn, Winchester and
Lexington southeast of the house on the John Winning Estate and proceeded
to perambulate the boundary line between the City of Woburn and the Town
of Lexington, Commencing at said corner at which place a monument was
found; thence to a monument standing in the open field of said Winning
Estate marked L,W,; thence to a monument beside the County Road,called
"Lexington Street" marked L,W,; thence to a monument near a small barn
owned by Graham marked L,W,; thence to a monument in the pasture north-
west of the house of Graham marked L,W,; thence to a monument near the
wall in the woods near line of Jones and sAid Graham marked L,W,; thence
to a monument in the woods in a northwesterly direction toward. Russell
Street; thence to a monument beside the County Road called Russell Street
marked L,W,; thence to a monument near the old Middlesex turnpike in
Lexington, making a corner with Lexington and marked L,W,; thence to a
monument at the corner of Lexington, Burlington and Woburn near the
house owned now or formerly by Packard, the last monument being marked
L,W,B,
Recommendations;
We recommend that the monument in the open field on the VTinning
Estate be reset and raised to an upright position, and also, that a new
boundary stone be erected to replace the monument located near the old
Middlesex turnpike in Lexington,
We agree that the Town authorities of Lexington procure the monument
to be placed near the old Middlesex turnpike in Lexington, and also reset
the monument in the open field on the Winning jqskate,
Town of Lexington;
