CONSERVATION COMMISSION
MINUTES
Monday November 27, 2017
6:30 P.M.

Chair Phil Hamilton opened the meeting at 6:31pm in the Parker Room.
Commissioners Present: Duke Bitsko, Dick Wolk, Kevin Beuttell, Ruth Ladd, Alex Dohan.

Request to present potential Annual Town Meeting Warrant Article for prohibitinguse se of plastic
bags by retailers in town

Ms. Mullins stated that the commission should do a site visit to view the changes from the
approved plan.

Issue Order of Conditions: 25 Hathaway Road, DEP 201-1077, BL 1034
The commission stated that they want to condition spot grades on driveway to ensure it is
draining to the trench train. The commission also stated that they want to condition FENO
markers along the 25 ft. buffer.
Motion to issue Order of Conditions made by Mr. Wolk and seconded by Mrs. Dohan. Vote: 7-0
in favor.

Approve minutes from 11/13/2017
Motion to approve the minutes of 11/13/2017 with edits made by Mr. Langseth and seconded by
Mr. Beuttell. Vote: 7-0 in favor.

Applicant: Angie Kavlakian
Project: Confirmation of wetlands line
Ms. Mullins explained that the prior site visit with the wetlands scientist was cancelled because
of weather. The site visit is rescheduled for 11/28/2017 at 9am.
Motion to continue the hearing to 212/11/2017 at the applicant's request made by Mr. Wolk and
seconded by Mrs. Dohan. Vote: 7-0 in favor.

Mrs. Dohan reported that she is somewhat familiar with the proposal to ban plastic bags in
Lexington. She stated that a few residents are trying to get the proposal to Town Meeting in
2018. She will follow up with them to have them present the proposal to the commission.
Mr. Hamilton stated that he will circulate the most up to date draft regarding the buffer zone
regulations.

Applicant: Nash Quadir, KUQ Construction
Project: Raze and rebuild SFD and associated site work
Rich Kirby- LEC Environmental, and Nash Quadir- KUQ construction
Mr. Kirby explained that they are proposing to demolish the existing home and rebuild a single
family home on the site. There will be a decrease in impervious surface. The home will be
outside the 100 ft.buffer. No grading is proposed on the site. Mr. Kirby explained that it appears
that there is historic fill on the site. They are proposing to restore the 25ft. buffer by removing
the fill in that area to the native soils. Additionally, they will place FENO markers along the 35
ft. buffer. No storm water management is proposed since the entire house is outside the buffer.
Questions and comments from the commission:
The commission asked for clarification regarding the location of some of the wetland flags. Mr.
Kirby stated that he will go back out with the surveyor to clarify these issues.
The commission stated that they want to see elevations and flood zones shown on the plan.
The commission requested that the bottom floor elevations be added to the plan.
The commission stated that they want more information regarding the filling.
The commission stated that they are concerned about the location of the wetlands because of the
fill that is on the site. The commission explained that the location of the bufferzones may change
if it is discovered the wetlands were filled.
The commission asked questions about the proposed dry wells.
Motion to continue on 12/11/2017 at the applicant's request made by Mrs. Dohan and seconded
by Mr. Beuttell. Vote: 7-0 in favor.

Applicant: Dani Chedid, Pheonix Construction Group Inc.
Project: Reconstruction of existing parking lot
Mary Trudeau- wetlands scientist
Ms. Trudeau stated that since the last meeting, they have revised the plan to show a curb around
the perimeter of the parking lot. Extra spot elevations were added to the plan. The project
narrative was updated to reflect that the entire parking lot will have full depth reconstruction.
Motion to close the hearing made by Mr. Wolk and seconded by Mr. Langseth. Vote: 7-0 in
favor.

New Meetinus/Hearings
Rule for Performance Standards, Section 5(9) Work on Steep Slopes
Mr. Hamilton explained that over the last few months, the commission has been working on a
proposal to introduce a new regulation regarding building on steep slopes near wetlands. He
stated that today's meeting was to get input from the public and answer questions about the new
regulation.
Mary Trudeau asked if the commission looked at the regulations for the Town of Topsfield. Mr.
Hamilton stated that they have not, but they will.
Rich Kirby asked if the commission will offer guidelines. Mr. Hamilton stated that it is up to the
applicant to prove to the commission that there will be no effects on the wetlands.
The commission explained that each situation will be looked at on a case by case scenario. The
commission also explained that this does not have to go to Town Meeting because it is a
regulation change rather than a by-law change. The commission will leave the hearing open for
30 days for public comment.
