This Conservation Commission meeting was held remotely via Zoom, an online meeting
platform. Public participation via calling in or using your computer was encouraged.

Conservation Plan Modification: CPM-25-3, 22 Wyman Road
Ms. Mary Trudeau, Wetland Consultant, presented and stated that the applicant proposes a minor
modification to the front yard. Ms. Trudeau stated that a small permeable patio between the
driveway and the front door is now proposed which is replacing an impervious walkway
previously proposed.
On a motion by Mr. Beuttell and seconded by Ms. Dohan, the Commission voted 5-0 by roll call
vote to approve the plan modification.

Conservation Plan Modification: CPM-25-4, 1367 Massachusetts Ave
Mr. Raj Janu, owner of 1367 Massachusetts Ave, presented and stated that the existing stairway
in the rear was not previously included in the submitted plans. Mr. Janu stated that there is a
second stairway in the rear of the dwelling that is now proposed along with a bay window in the
front of the dwelling. Ms. Ladd asked if water and sewer lines will need to be replaced. Mr. Janu
stated that DPW has reviewed the waterlines and that they will need to be connected.
On a motion by Ms. Dohan and seconded by Mr. Whelan, the Commissio n voted 5-0 by roll call
vote to approve the plan modification.

Review request for Amended Order of Conditions: 56 Grassland St
Mr. Richard Kirby, LEC Environmental, presented the overview of the proposed amendment to
the Order of Conditions which was filed for the July 22, 2025 meeting. This is the third request
for an amendment to the Order of Conditions. Ms. Ladd stated that the permeable patio is within
the 25-foot Buffer Zone and expressed concern for the proposed work within the 25 -foot Buffer
Zone. Mr. Kirby stated that there is Bordering Vegetated Wetlands surrounding the property. Mr.
Beuttell stated that a new Notice of Intent Application would need to be submitted for any newly
proposed excavation in the wetlands.

On a motion by Ms. Dohan and seconded by Mr. Whelan, the Commission voted 5-0 by roll call
vote to approve the 6/10/2025 minutes.

Mr. Scott Gatchell, Lexington Housing Assistance Board (LexHAB), presented and Mr. Lester
Savage, LexHAB, was also present. Mr. Gatchell stated that a walkway is proposed at the rear of
the property to a new entrance at the rear of the building. Mr. Gatchell also stated that the
pathway at the front of the dwelling will be replaced with permeable pavers.
Mr. Beuttell stated that the back corner of the grade change onsite goes beyond the 25 -foot
buffer zone on the proposed plan and stated that mitigation would be needed for the
encroachment into the 25-foot buffer zone. Ms. Ladd stated that the delineation is dated over
three years back. Ms. Mullins stated that the resource area is an isolated wetland and is less
prone to changing over time. Ms. Mullins stated that there is no existing conditions plan
submitted for this property as the previous owner’s filing’s plans were never completed.
On a motion by Mr. Beuttell and seconded by Ms. Dohan the Commission voted 6-0 by roll call
vote to issue a negative determination with conditions.

Ms. Meg Buczynski, Activitas, presented and stated that the composite decking of two of the
three boardwalk sections of the site are in disrepair and need replacement. The construction
access point will be from the Hayden Recreation area. Ms. Buczynski stated that the work will be
done on the existing boardwalk as much as possible to avoid the contractor needing to access the
site from within the vegetation. The proposal includes tree re moval to be completed by the
Department of Public Works and the Tree Warden has already determined which trees are
hazardous.
Ms. Ladd stated there is a maximum spacing of the boards included but does not include a
minimum spacing. Ms. Buczynski stated t hat the plan can be revised to include the minimum
spacing as well which will be one quarter inch for water flow between the boards. Ms. Ladd
asked for further information regarding the trees proposed for removal such as their size.
Mr. Beuttell asked for clarification on the equipment anticipated to be used for the project such
as bobcats or other equipment . Ms. Buczynski stated that they initially marked the plan with
areas of plywood to be placed for usage of equipment such as a bobcat and that they are trying to
avoid usage of any equipment that cannot fit on the existing boardwalk. Mr. Beuttell asked if the
boardwalk near the large maple tree onsite could be moved away from the tree to prevent it from
being removed. Ms. Buczynski stated that she will check with the Tree Warden on if keeping this
tree is permitted.
Ms. Dohan asked if possible to leave the trunks of any of the trees proposed for removal as this is
beneficial for wildlife. The trunks will be left onsite for this benefit. Ms. Mullins stated that the
comments from the Commission can be included as conditions in the Order of Conditions.
On a motion by Mr. Beuttell and seconded by Mr. Bitsko the Commission voted 6-0 by roll call

Ms. Alyssa Jacobs, Epsilon Associates, presented, Ms. Meg Buczynski, Activitas, and Ms.
Melissa Battite, Town of Lexington Recreation, were also present . Ms. Jacobs stated that the
proposal includes maintenance dredging to remove accumulated sediment onsite. Ms. Jacobs
stated that the pond where the dredging will be done is connected to Kiln Brook. The wetlands
are located along the perimeter of the pond. Ms. Jacobs stated that this process also occurred ten
years ago during frozen ground conditions.
Mr. Beuttell asked what time of year the project would take place. Ms. Jacobs stated the
preference is to complete the work in the Fall or Winter. Ms. Ladd stated this project is done
every ten years and that there are two wells onsite and asked where the wells are located and why
they are not sufficient for providing enough irrigation water onsite. Ms. Buczynski stated that
there are two wells located on the second fairway and these wells pump water to the Upper Pond
and the site will be reevaluated for any upgrades to the irrigation system overtime which would
require further studies onsite.

Mr. Richard Kirby, LEC Environmental, presented and stated that a Request for Determination
of Applicability was filed previously for this project which determined there was likely an
Isolated Wetland in the backyard of the property and a small Isolated Wetland was delineated
onsite. Mr. Kirby stated that the proposed house has been shifted as far from the resource area as
possible. The existing house is 19 feet from the wetland boundary at its closest point and the
proposed dwelling is further from the wetlands. A restoration planting plan has been submitted
as mitigation.
Bob Avallone, 21 Constitution Road, asked if there will be trees removed in the front lawn. M r.
Kirby stated that a red maple tree, outside of jurisdiction, and one American beech tree, within
jurisdiction, will be removed. Mr. Avallone asked when the project will occur. Mr. Kirby stated
that a construction schedule will be submitted as a requirement after the Commission approves
the project.
Mr. Fernando Dalfior, applicant, stated the driveway can be completed only with pavers to
address the Commission’s concern with a trench drain being necessary. Mr. Kirby stated a
condition could be included by the Commission for either the proposed pavers in the driveway or
a trench drain dependent on what the grading onsite will allow. The Commission agreed to this
condition.
On a motion by Mr. Bitsko and seconded by Ms. Dohan the Commission voted 6-0 by roll call
vote to close the hearing.

Mr. Richard Kirby, LEC Environmental, presented and stated that the grade will be lowered
onsite and to mitigate this, a retaining wall is proposed onsite as well. Mr. Kirby stated that the
roof overhang measures 99 feet from the resource area. Two infiltration systems are proposed
onsite and a restoration plan is included to restore lawn area to a natural state.
Ms. Dohan stated regret for the three maple trees proposed for removal. Mr. Whelan and Ms.
Ladd expressed agreement with Ms. Dohan regarding the maple trees proposed to be removed.

Ms. Mary Trudeau, Wetlands Consultant, presented on behalf of Westview Homes. Ms. Trudeau
stated that the existing house is within the 200-foot Riverfront Area. The new flood plain
elevation of this property is 179.4 according to the new FEMA maps effective on this date. Ms.
Trudeau stated that all existing impervious area is within the 100 -foot buffer zone and the
proposed plans include a nine percent reduction in impervious surface in the Riverfront Area.
Ms. Ladd asked if any grading is proposed in association with the patio. Ms. Trudeau stated that
the lot’s grade is proposed to remain the same. Ms. Mullins stated that the floodplain has a 100-
foot buffer zone. Ms. Trudeau stated that the plans will be updated to show the flood zone
updates.
Ms. Kathy Slain, 128 Adams Street, asked if the property line has been extended out and
expressed concern that the property boundary was extended into the corner of Westwood and
Adams Street. Ms. Trudeau stated that she will speak with her client to discuss the co ncerns with
the Town to ensure the corner is safe for residents.

Mr. Richard Kirby, LEC Environmental, presented and stated that flag 2B has been eliminated
based on the previous hearing ’s concerns and the vernal pool onsite has been marked on the site
plans along with the associated 100-foot buffer zone. Ms. Ladd stated at least one more flag
should be noted on the plan below flag 1B. Mr. Kirby stated another flag ca n be added to the
plan and the applicant would like to move forward with this as a condition. Ms. Ladd also noted
topographical layers should be added to the plan. Mr. Kirby stated that if a Notice of Intent is
applied for on this site, they would include a topographic survey on the site plan.
Ms. Mullins stated an elevation form should be included for the vernal pool flagging as well and
the highest elevation of the vernal pool would need to be documented. The Commission’s
procedures require topography shown on existing conditions plans submitted through the filing
process.
Ms. Janet Lane, 21 Hayward Ave, stated that the ditch onsite has water that flows and asked if
this affects the site. Mr. Kirby stated that the existing ditch does not appear to be ju risdictional
since it does not flow annually. Ms. Lane stated that abutters have noticed salamanders far from
the vernal pool. Ms. Ladd stated that salamanders can travel up to 1000 feet from the vernal pool.
Mr. Beuttell asked the Commission to clarify if they will be requiring a topographical survey on

Mr. Montgomery Nsamba, Stamski and McNary, presented and stated that a restoration plan has
been submitted to address the encroachment into wetlands. The area of disturbance that occurred
in the wetlands has been marked on the submitted plans.
Ms. Ladd stated that the proposed plan and the mitigation planting plan do not correspond. Ms.
Ladd also stated that a portion of the restoration area is encroaching on the abutting property
which would need to be discussed with the abutting property owner . Mr. Nsamba stated that
disturbance has occurred that encroaches on the abutting property. Ms. Mullins stated that the
areas of disturbance are not clear.
Ms. Dohan stated that the lot does not allow for the garage to move much further from the
wetlands. Ms. Ladd stated that the restoration plan does not show the proposed garage o n it. Mr.
Whelan asked how the wetland will be protected while work is being conducted onsite since the
limit of work line is close to the wetland line. Mr. Nsamba stated that sediment barriers can be
doubled onsite to protect the wetlands.
Mr. Bitsko asked if there is a wetland consultant involved in the project. Mr. David Crossman,
B&G Associates, has provided consultation to Stamski & McNary on the creation of the
restoration plan. Ms. Dohan stated that the replanting should occur after the construct ion of the
garage to ensure the plantings survive and are not harmed through the construction.
Mr. Beuttell stated that the project is now a raze and rebuild and would require an engineering
review since it exceeds the square footage threshold. Ms. Ladd stated that erosion controls need
to be added to the plans.

DEP has not issued a file number and this hearing cannot be closed until a DEP file number is
issued. Mr. David Sperduto, Wetland Consultant, presented and stated that the stormwater
infiltration systems have been revised to separate the overflow discharge to two outlets rather
than the previously proposed singular outlet for overflow stormwater. Mr. Sperduto also stated
that there is an evaluation area offsite that has been included on the revised plans and the team
cannot confirm if there are wetlands past this evaluation area as he was not permitted to review
past the submitted evaluation area by abutters.
Mr. Mat Gauvin, abutter, expressed gratitude for the project team revising the stormwater
overflow discharge. Mr. Gauvin also stated concern for lack of screening due to the removal of
many trees. Ms. Ladd stated the Commission cannot require the applicant to provide new
screening onsite.
