HomeMy WebLinkAbout1984-08-02LEXINGTON BOARD OF APPEALS August 2, 1984 The Board of Appeals held a regular meeting in the Selectmen's Meeting Room at 7:45 P.M. Present and acting on petitions were.- Thomas ere:Thomas G. Taylor, Chairman Natalie H. Riffin, Vice Chairman Robert M. Gary Clarence D. Turner Eric T. Clarke, Associate Public hearings were held on the following petitions. 1749 Mass. Ave., J & J Ice Cream of Lexington, Inc. requested a modification of the special permit issued by the Board on April 12, 1984, by extending the hours of operation from 10 a.m. to 11 p.m., seven days a week, to 10 a.m. to 12 -midnight, seven days a week. 92-100 Hayden Ave., Sprague Electric Co. requested a special permit to place lettering on an existing free-standing monument, which was used for a former sign, approved by the Board of Appeals in 1964. Sprague will be the only tenant occupying the building numbered 92-100 Hayden Ave. 700 Waltham St., John P. Carroll requested a special permit (Section 3.3), pursuant to Table 1, line 2.3, to continue the uses allowed under the previous permit, to pick-up and keep cars on the premises at 700 Waltham St., formerly known as 31 Allen St. 9 Ward St., Frank Compangone requested appeal from the decision of the Building Co mmissicner,'to issue a building permit for 9 Ward St., Lots one (1) and two (2). The appeal is made in accordance with Lexington Zoning By -Law Section 3.2.1 and Mass. G.L. Ch. 40A Section 15. 10 Maguire Rd., Itek Corp, requested a special permit, pursuant to ZBL Section 3.4 and other related sections to allow four additions, identified as L. M, T and G wings, at 10 Maguire Rd. 10 Maguire Rd., Itek Corp. requested a variance from SLction 7, Dimensional Controls, to allow the maximum height of an addition, identified as the "M" wing to be seventy (70) feet, as required for specialized equipment. Decisions filed with the Town Clerk. 1749 Mass. Ave. - SP was modified (by vote of 4 to 1, Robert M. Gary not in favor). 92-100 Hayden Ave. - SP granted by unanimous vote. 700 Waltham St. - SP granted for 3 years by unanimous vote (exp. 7/18/97). 9 Ward St. - The Board voted to uphold the decision of the Building Commissioner by vote of 4 to 1, Mr. Taylor voting in the negative. 10 Maguire Rd. - Hearing rescheduled for Sept. 27. 1984. ✓ Other action: Kenneth Virgile and Helene Mayer asked the Board to modify the wording of a 5/10/84 decision to read, "The addition will be no closer to the rear lot line than the existing building."
