The Board of Appeals held a regular meeting in the Selectmen's Meeting Roan at
7:45 P.M.
Present and acting on petitions were: Thomas G. Taylor, Chairman
Natalie H. Riffin, Vice Chairman
Anne R. Scigliano
Clarence D. Turner
John J. McWeeney, Associate
Public hearings were held on the following eight petitions.
537 Lowell St., Hugh M. Leichtman requested a temporary special permit to continue
the use of the remodeled "barn" as living quarters solely for use by a person
employed by Dr. Leichtman to care for his child, and that person's family, subject
to the same conditions of the former permit.
307 Wood St., James V. Cosgrove requested special permits to continue to operate a
roadside stand for the purpose of selling poultry, eggs, plants, produce, wood,
Christmas trees and wreaths in season, and also to use the standing sign with
removable inserts, used only when the stand is in operation.
33 Center St., Kenneth A. and Beverly A. Mills requested a special permit, pursuant
to ZBL Section 5.7, for construction of an above ground swimming pool.
195 Woburn St., Elaine Paul requested a special permit, pursuant to Sections 3.3 and
7.4.9, to allow a shed and pool house to remain as located.
' 12 Glen Rd., Fleming M. Fox requested a variance of dimensional controls (ref. ZBL
Sections 6 and 7 and Table 2) to add an addition to the (100 yr. old) house at 12
Glen Rd. The addition would have insufficient side yard adjacent to Oakland St.
65 Cliffe Ave., Mary T. Brennan requested a variance of ZBL dimensional controls,
Section 7 and Table 2, to allow a house to be built at 65 Cliffe Ave. with
insufficient side yard.
34 Cary Ave., Thomas C. and Mildred Bartee requested a variance of ZBL dimensional
controls (ref. Sections 6, 7 and Table 2) to add an 8'x8'3 addition to the rear of
the house (built in 1926). The addition would be no closer to the lot line than
the existing structure.
53 Simonds Rd., Malcolm & Victoria Blier requested a special permit, pursuant to ZBL
Sections 3.3 and 7.4.9, to allow the garage to remain as located; and a variance of
Section 7 and Table 2 to add a deck on the easterly side of the house.
The Chairman agreed to write a letter of thanks to Erik Lund, who represented
the Board at the Mass. Appeals Court (Case No. 83-1272, the Planning Board et al,
v. the Board of Appeals, et al (the "Butts" case, 258 Marrett Rd.).
Decisions filed with the Town Clerk: Granted: 537 Lowell St., 307 Wood St.,
33 Center St., 195 Woburn St., 12 Glen Rd., 34 Cary Ave. and 53 Simonds Rd.
Denied: 65 Cliffe Ave. All decisions dere by unanimous vote.
From this time forward all decisions will be typed using the short form, per
instructions of Chairman Thomas G. Taylor (see attached sample).
The meeting adjourned at 11:22 P.M.

DECISION OF BOARD OF APPEALS
Subject Property: 10 Tower Road, Assessors Map , Lot
Petitioners: Edwin B. and Myrtle Y. Cox
Hearing Date: April 26, 1984
Pursuant to notice in the Lexington Minuteman,
a newspaper of general circulation in the Town of
Lexington, published on April 12 and 19, 1984, and
notice sent by mail, postage prepaid, to all interested
parties pursuant to the provisions of Massachusetts
General Laws, a public hearing was held on April 26,
1984, in the Town office Building on the
petition,of Edwin B. and Myrtle Y. Cox filed on
April 6, 1984 -for a special permit under zoning
By-laws, Section 7.4.91 to allow the garage at
10 Tower Road to remain as it has been located since
1931.
Acting on the petition were: Vice Chairman
Natalie H. Riffin, Robert M. Gary, Anne R. Scigliano,
Clarence D. Turner, and Associate John J. McWeeney.
Prior to the hearing, the petition and supporting
data were reviewed by [Town Officials].
Edwin B. Cox and Myrtle Y. Cox were present
at the hearing and Mr. Cox said that they purchased
the property in 1966. At that time, nothing was said
about any violation of zoning By-law setback requirements.
He said that they were selling their home. They dia
not build the garage. it was there when they bought
the house. The house and garage were built in 1931.
No building permit can be located.
No one registered opposition to the request.
