September 29, 1977
The Board of Appeals held a regular meeting on Thursday, September 29, 1977,
beginning at 7:30 p.m., in the Selectmen's Meeting Room, Town Office Building.
Present: George P. Wadsworth, Chairman

Public hearings were held on the following petitions, notices of the hearings
having been mailed and hearings advertised in the Lexington Minute -Man newspaper
as required by statute..
Suprokash Sarker - special permit, pursuant to Section 30.3, to build an addition
at 40 Garfield Street. The addition will be a 12 ft. x 20 ft. garage which will
have sufficient front aid rear yards but will have a side yard of 3 ft. instead of
7 1/2 ft.
Bernard Donahue - variance of Section 27 of the Lexington Zoning By-laws in order
to complete construction of a fenced in above ground 4 ft. deep swimming pool
located at the rear of 27 Carville Avenue. The pool is located a distance of 7.5
ft. from the abutters' property line on the right side and a distance of 4 ft.
from the conservation land located in the rear. The fence surrounding the pool
will be stained redwood. Petitioner is willing to provide shrubbery or any other
planting suggested to keep, the pool aesthetically pleasing to users of the conser-
vation land.
DECISIONS: The Board made the following decisions, all in open meeting. See de-
cisions filed with the Town Clerk and in Board of Appeals' files for more details.
Sarker - granted unanimously.
Mroczkowski - granted unanimously.
Hail - denied unanimously.
Donahue - granted unanimously subject to certain conditions.
Other information and discussion:
Mrs. Morey has been appointed a member of the "Select Committee" established
for the purpose of updating our zoning by-laws.
Problems with Sections 25, 30 and 40 continue to be expressed by Board Members.
Home occupations is another category for questions under definitions. The Board
agreed to make recommendations to Town Meeting especially in regard to their posi-
tions on Use Variances, PUD's (Section 33) and Non -Conforming Uses.

of the building at 1656 Massachusetts Avenue.

The Board approved the wording of a letter to Miller and Nylander (surveyors
and engineers) asking them to warn their clients at the time of purchase of plot
plans, that steps, roof overhangs, etc. are included in determining setback
requirements of the Zoning By-law.
The meeting adjourned at 10:50 p.m.
