HomeMy WebLinkAbout1977-07-14 BOARD OF APPEALS July 14, 1977 The Board of Appeals held a regular meeting on Thursday, June 9, 1977; beginning at 7 30 p m. , in the Selectmen's Meeting Room of the Town Office Building Present George P Wadsworth, Chairman Ruth Morey, Vice Chairman Woodruff M. Brodhead Robert M. Gary, Associate William J Scouler, Associate Public hearings were held on the following petitions, notices of the hear- ings having been mailed and hearings advertised in the Lexington Minute-Man newspaper as required by statute Joseph P DiMatteo - variance of Section 27 in order to build a carport with a front yard setback of 20 ft instead of the required 30 ft on the property at 216 Lincoln Street Thomas J Casey - variance of Section 27 in order to build a shed (12' x 12' x 12') of plywood covered with aluminum at 9 Alpine Street for storage of garden tools and summer furniture George E Foote, Jr - special permit, pursuant to Section 25 81 of the Use Regulation Schedule of the Zoning By-laws, to have a law office at 69 Oak Street to conduct the practice of law on a part-time bases, i e between the hours of 5 p m. and 9 p m. on weekdays and on weekends during the day Bernard Donahue - variances of Section 27 of the Lexington Zoning By-law in order to complete construction of an above ground 4 foot deep swimming pool located at the rear of 27 Carville Avenue Construction of the pool was begun a distance of approximately 1 5 ft from the rear lot line instead of the re- quired 15 ft and approximately 1.5 ft from the side lot line instead of the required 10 ft Moore Homes, Inc - special permit, pursuant to Section 38 (multi-dwelling- RD) and related sections of Lexington's Zoning By-law for the development of Fiske Common for 45 living units consisting of 4 one-bedroom units, 18 two-bedroom units and 23 three-bedroom units (these units in 19 buildings) plus garages on a parcel of land on the southerly side of East Street and the Northeasterly side of Fiske School, land containing 16 35 acres and described in Section 22 52 of Zoning By-law Article 86 of March 1977 Town Meeting rezoned subject parcel plan to RD and accepted plans as presented to it Petitioner requests a variance from the provisions of Section 27 to permit 10 ft and 20 ft distances between buildings and garages (as indicated in peti- tion) instead of the required 30 ft Also Petitioner requests a variance from Section 25 80 (which states garage space for parking not more than 3 automobiles) to allow parking of no more than 6 automobiles per garage, all as shown on plans and described in data submitted to the Board Board of Appeals (continued) Hearings July 14, 1977 -2 DECISIONS The Board made the following decisions, all in open meeting See decisions for details, all in Board of Appeals' files and also filed with the Town Clerk DiMatteo - denied unanimously Casey - granted unanimously Foote - granted (4 to 1) , Mrs Morey not in favor Donahue - denied unanimously Moore Homes - unanimously granted, subject to certain conditions The meeting adjourned at 10 40 p m Respectfully submitted, Evelyn F Cole Administrative Clerk BOARD OF APPEALS 1
