The Board of Appeals held a regular meeting on Thursday, May 26, 1977;
beginning at 7:30 p.m., in the Town Office Building, Selectmen's Meeting Room.

Public hearings were held on the following petitions, notices of the hearings
having been mailed and hearings advertised in the Lexington Minute -Man newspaper
as required by statute.
Bruce G. Forsyth - special permit, pursuant to Section 30.3, to build an addition
to an existing house at 31 Oakland Street with a present front yard setback of 26'
instead of the required 30' (according to the present by-law). The addition is a
2'6" extension to the existing porch, which will then be enclosed for use as a
study. Materials will be consistent with the existing house.
Martin J. Cregan - special permit, pursuant to Section 30.3, to add a deck town
existing house, which house has a side yard of 9.75' instead of the required 15'.
The deck will be in conformity with the present zoning by-law. The address of
the property is 5 Liberty Avenue.
Marjorie T. Lunday and Donald F. Lunday - special permit, pursuant to Section 30.3,
to add a 24' x 12' addition (dining area and front porch) to the side of the dwell-
ing at 24 Middleby Road. The existing dwelling has a setback of 22.86' instead of
22.86' instead of the required 30'. The addition will be in keeping with the archi-
tectual lines of the house.
Albert G. Hale - special permit, pursuant to Section 30.3, to add a bay window
which will have a 28' setback instead of the required 30'. The existing house at
41 Woodcliffe Road is non -conforming inasmuch as the front steps have a setback
of approximately 27' instead of: -the required 30'.
Betsy Filz - special permit, pursuant to Section 30.3, in order to add a 3'6" x
9'0" addition and a 12'0" x 8'6" Redwood deck to an existing dwelling at 17 Adams
Street. The dwelling has a setback Of approx. 10' instead of the required 30'
and a sideyard of 13'5" instead of the required 15'.
Robert F. McSweeney —variance to subdivide the lots at the corner of Bertwell Rd.
and Eaton Rd. into two lots as follows:
(1) Lots 22, 23 and part of Lot 24 into a single lot having the existing
frontage of 110' on Eaton Road and 8,969 sq. ft. of land; and
(2) Lots 26, 25 and part of Lot 24 into a single lot having 57.37' of frontage
on Bertwell Road and 5,516 square feet of land.
Jerome J. Green for Sun Valley Associates, Inc. - to revise the plans under the
' special permit which allowed the building of a concrete tennis backboard (10' x 45'
and 12" thick) and to pave an additional area (45'x50') on one side of the wall.
In the revised plans the concrete backboard would be 10'x42' and 12" thick and
would be in the same approximate location (10' further back from the edge of the
basketball court than was indicated in the original plans). The additional paved
area would be 10.5'x42' adjacent to the basketball court and 43'x42' on the other

side. This change has been requested for safety reasons by several Sun Valley
-families. In the revised plans the backboard will be a safer distance (15')
from the edge of the basketball court than in the original plans (5'). The
total now paved area in the revised plans is the same as in the original plans.

DECISIONS: The Board made the following decisions, all in open meeting. See
dicisions for details, all in Board of Appeals' files and also filed with the
Town Clerk.
Forsyth - granted unanimously.
Cregan - granted unanimously.
Lunday - granted unanimously.
Hale - granted unanimously.
Filz - granted unanimously.
Sun Valley Associates, Inc. - granted unanimously, subject to certain conditions.
McSweeney - unanimously denied.
The meeting adjourned at 10:20 p.m.
