HomeMy WebLinkAbout1977-01-27BOARD OF APPEALS ' January 27, 1977 The Board of Appeals held a regular meeting on Thursday, January 27, 1977, beginning at 7:30 p.m. in the Town Office Building, Selectmen's Meeting Room. Present: George P. Wadsworth, Chairman Ruth Morey, Vice Chairman Woodruff M. Brodhead Robert Cataldo, Associate Robert M. Gary, Associate Pudic hearings were held on the following petitions, notices having been mailed as required by statute and hearings advertised in the newspaper. Brewstets Inc. - special permit under Sections 30.3 and 12.2 and other applic- able sections of the Zoning Bylaw, to allow for the construction of an entrance to the existing building at 903 Waltham Street. The proposed entrance will be approxitiately 5.5 feet by 6 feet and will act as a wind -break at the front door. Also requested is a variance from Section 27 to allow said entrance to have a front yard setback of approximately 22 feet rather than the required 30 feet. The applicator is the owner of the premises. Wilfrid'B. and Mary Veldkamp - variance of the Lexington Zoning Bylaw in order to maintain an existing garage on the premises at 7 Bird Hill Road (formerly numbered 6 Rockville Avenue), with a rear yard setback 19.2 feet from Bird Hill ' Road instead of the required 20 feet. John Lord and Karolyn Lord - variance to maintain existing house at 35 Moon Hill Road with 10.1 ft. sideyard instead of the 15 ft. required by Section 27 of the Lexington Zoning Bylaw. Lexington Enterprises, Inc., P.C. Wong, Pres. - special permit under Section 25.69, to be granted to Lexington Enterprises, Inc. d/b/a Peking Garden Restau- rant use. Petitioner has an agreement with the owners of the premises at 31 WalthamiStreet to purchase the property. The petitioner, after purchasing the propertt, intends to break a portion of the wall between the two buildings and join them together for access to each building. It also intends to add an addi- tional stariway for access to a common basement for both buildings and add a new men's acid a new women's rest room (including facilities for handicapped persons), and also will add new odor minimizing filters to the kitchen exhaust system. The Board made the following decisions, all in open meeting. See decisions for details, all in Board of Appeals' files and also filed with the Town Clerk. Brewster's - granted unanimously. Veldka - granted unanimously. Lord - 4ranted unanimously Lexington Enterprises - denied, two in favor, three in opposition. Inlfavor: Woodruff M. Brodhead In opposition: Robert M.
