June 24, 1976
The Board of Appeals held a regular meeting on Thursday, June 24, 1976,
beginning at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office
Building. Present were: Chairman Nickerson, Vice Chairman Wadsworth, Regular
Members: Ruth Morey and Woodruff M. Brodhead; and Associate Member, Haskell W.
Reed. Also present were a room full of townspeople, a representative of the
League of Women Voters and a Lexington Minute -Man Reporter.
Public hearings were held on the following petitions, notices having been
mailed to the proper persons and advertised in the newspaper as required by
law.
Lexington Historical Society - On January 21, 1975 the Lexington Historical
Society and Lexington Bicentennial Committee were granted permission to install
30 markers to designate the course of three walking tours and were given permis-
sion to keep these markers in place until the fall of 1976. They are now peti-
tioning to extend the use and keep them in place until the fall of 1978.
Dorothy W. Kilpatrick - variance of Section 27 to maintain the residential
dwelling at 59 Farmcrest Avenue with sideyards of 7.1 feet instead of the
required 7.5 feet.
Boston Edison Company - special permit, pursuant to Section 25.23 (buildings and
uses for other public services) to construct and install an electrical substa-
tion (to be known as substation no. 533) together with associated equipment for
transforming, switching and regulating electricity for the purposes heretofore
described in Department of Public Utilities docket DPU 18319. The parcel of
land is owned by Boston Edison Company, is located on the easterly side of Hart-
well Avenue on Maguire Road, is situated within a CM district, contains approxi-
mately four acres of land, and is identified as Lot number one on the Town of
Lexington Property Map number 80.
Jefferson Union Company - special permit to erect a free standing sign in front
of the building at 789 Massachusetts Avenue.
Lester A. Goldberg - variance for permission to erect and maintain a tower with
a height of 100 feet, notwithstanding the provisions of Section 26.56 of the
Zoning Bylaw, on Lot 10, 49 Sanderson Road, which lot is currently owned by
Village Development Corporation and which applicant has agreed to purchase pur-
suant to an agreement dated May 5, 1976.
The Board made the following decisions, all in open meeting with spectators
remaining to the end to hear the verdicts. See permits for details.
Historical Markers - granted unanimously.
Kilpatrick - granted unanimously.
Boston Edison - granted unanimously.
Jefferson Union Co. - denied, 3 in favor, 2 in opposition (Chairman & Vice Chairman).
Goldberg - denied 4 to 0 (G. Wadsworth abstaining)
All pertinent material is on file in the Board of Appeals' office under the
name of petitioner.
The meeting adjourned at 11:58 p.m.
